Fishing for Trout, &c., in the Aparima River authorised.

GLASGOW, Governor.
ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this thirteenth day of December, 1892.

Present:
THE HONOURABLE SIR P. A. BUCKLEY, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by an Order in Council dated the seventh day of September, one thousand eight hundred and ninety-two, and published in the New Zealand Gazette No. 71, of the eighth day of the same month, certain regulations were made under “The Fisheries Conservation Act, 1884,” providing for trout-, perch-, and tench-fishing in the Southern Acclimatisation District:

And whereas the Aparima River and its tributary streams or waters, with the exception of the Otautau River, were excepted from the operation of such regulations: And whereas it is expedient that fishing should be permitted in the said Aparima River and all its tributary streams and waters, subject to the provisions of the said recited regulations and to the regulations hereby made:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the powers conferred by “The Fisheries Conservation Act, 1884,” and of all other powers and authorities enabling him in that behalf, doth hereby amend regulation one of the said Order in Council by striking out the words “with the exception of the Aparima River and its tributary streams or waters” in the second and third lines thereof; and doth hereby declare that fishing for trout and perch in said River Aparima may be permitted, subject to the provisions of the said recited regulations of the eighth day of September aforesaid, in the same manner as if the said river and its tributary streams had not been excepted from the operation of the said regulations; and in exercise of the like powers and authorities, and acting with the like advice and consent, His Excellency doth hereby make the following regulation, and doth hereby declare that the same shall form part of the recited regulations aforesaid, and shall be read and construed accordingly:—

15A. Notwithstanding anything herein contained, the Governor in Council may at any time, if it shall seem expedient so to do, close the said River Aparima and all its tributary streams and waters, and prevent any fishing or angling whatever therein as from a date to be fixed, and from and after such date all fishing or angling in the said river shall absolutely cease, and no person by reason of such closing of the said river shall be entitled to the refund of any license-fee or moneys by way of compensation or otherwise.

And, lastly, it is hereby declared that this Order in Council shall come into force on the twenty-second day of December instant, and shall apply to the Aparima River and all its tributary streams and waters.

Powers delegated to the Scotsburn Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this fourteenth day of November, 1892.

Present:
THE HONOURABLE SIR P. A. BUCKLEY, K.C.M.G., PRESIDING IN COUNCIL.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the fourth day of June, one thousand eight hundred and eighty-nine, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Scotsburn Public Domain Board, namely,—

GEORGE JAMES DENNISTOUN,
JAMES PITHIE,
ROBERT THEW, and
DUGALD MACFARLANE

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the third Friday in each month, at three o’clock p.m., at the Road Board Office, Peel Forest, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Friday, the twentieth day of January, one thousand eight hundred and ninety-three.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Monday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be Chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

SCHEDULE.

ALL that parcel of land in the Orari Survey District, Land District of Canterbury, containing 50 acres, more or less. Bounded north-eastward by the road south-west of Section No. 15391, 2850 links; south-eastward by a line at right angles to the said road; and westward by a road-line: and numbered 1554 (in red) on the official map in the Survey Office, Christchurch.

Increasing the Holding Area of Land to Settlers in the Waimate and Studholme Junction Village Settlements.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this fourteenth day of November, 1892.

Present:
THE HONOURABLE SIR P. A. BUCKLEY, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by an Order in Council issued on the twenty-sixth day of April, one thousand eight hundred and ninety-two, under the authority of the one hundred and sixty-seventh section of “The Land Act, 1885” (hereinafter termed “the said Act”), the terms and conditions upon which certain village-settlement lands therein enumerated should be disposed of were duly fixed, and it was provided that no person would be allowed to acquire more than one allotment in the village settlements on Reserves one thousand one hundred and twenty-six and one thousand one hundred and seventy-eight:

And whereas it is expedient to allow one person to hold more than one allotment in the said settlement:

Now, therefore, His Excellency the Governor, in pursuance of the power conferred by section one hundred and sixty-nine of “The Land Act, 1892,” and of all powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby amend the Order in Council aforesaid so far as it affects the areas in which the land in the said village settlements shall be held, and doth declare that, on and after the date hereof, any selector at present residing in the village settlements aforesaid may apply for and acquire the additional allotments of land mentioned in the Schedule hereto; and it is hereby further declared that all the provisions of the Order in Council of the twenty-sixth day of April, one thousand eight hundred and ninety-two, aforesaid, shall apply, except as regards the area in which the sections may be held, to the village settlements on Reserves one thousand one hundred and twenty-six and one thousand one hundred and seventy-eight.
