Harbour Regulations.

ONSLOW, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this first day of February, 1892.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS by the two hundred and twelfth section of “The Harbours Act, 1878,” it is enacted that the Governor in Council may, for the purposes specified in the said section, from time to time make regulations to be called “General Harbour Regulations,” and which shall be in force in all the ports of the colony:

And whereas General Harbour Regulations were made by Order in Council dated the fifth day of June, one thousand eight hundred and eighty-three, and published in the New Zealand Gazette No. 49, of the seventh day of the same month:

And whereas it is desirable to amend the said regulations:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities vested in him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby make the regulations set forth in the Schedule hereto, and doth hereby declare that the said regulations shall, on and after the first day of February, one thousand eight hundred and ninety-two, be in force in all ports or harbours in the colony, those numbered thirty and thirty-four to be in place of regulations numbered thirty and thirty-four of the said General Harbour Regulations, and such regulations, together with the regulation numbered twenty-five (A) in the Schedule hereto, shall be deemed to form a part of the said General Harbour Regulations.

SCHEDULE.

25A. No ship or boat shall convey gunpowder or other explosive substance or compound to or from any ship in a harbour unless such ship or boat has been specially approved for that purpose by the Harbourmaster, which approval may at any time be altered, modified, or revoked.

  1. When steamships having ships in tow are steering opposite courses in a confined channel in a harbour, both ships shall, before meeting, slacken speed when practicable until they have passed each other.

  2. Steamships about to pass any dredging-machine at work in any harbour, or any licensed ferry, or public work in progress, must slow their engines at such a distance before approaching any such dredge, ferry, or work as to insure their passing it at a speed not greater than dead-slow.

Revoking Order in Council prohibiting Export of Oysters.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this first day of February, 1892.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS an Order in Council prohibiting the export from the colony of all oysters known as Ostrea purpurea, Ostrea glomerata, Ostrea mordax, or the rock, shore, drift, or mangrove oysters, or by whatever name they may be locally known, taken or produced in the waters of the colony, was made under the powers conferred by “The Fisheries Encouragement Act, 1885,” on the sixth day of October, one thousand eight hundred and ninety-one, and published in the New Zealand Gazette No. 77, of the fifteenth day of the same month: And whereas it is desirable to revoke so much of the said Order in Council as prohibits the exportation of shore oysters or mangrove oysters:

Now, therefore, I, William Hillier, Earl of Onslow, the Governor of the Colony of New Zealand, in exercise of the powers conferred by “The Fisheries Encouragement Act, 1885,” and of all other authorities enabling me in this behalf, and acting by and with the advice and consent of the Executive Council of the said colony, do hereby revoke so much of the said Order in Council of the sixth day of October, one thousand eight hundred and ninety-one, as prohibits the exportation from the colony of shore oysters or mangrove oysters.

Wellington Subdivision of the Wellington Sheep District exempted from Wool-branding Sheep, under Section 67, “Sheep Act, 1890.”—Notice No. 340.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this first day of February, 1892.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS a petition has been presented to His Excellency the Governor, signed by a majority of the owners of sheep in the Wellington Subdivision of the Wellington Sheep District (representing the ownership of not less than two-thirds of the total number of sheep in the said subdivision), requesting that such subdivision may be exempted from the operation of section sixty-seven of “The Sheep Act, 1890”: And whereas it appears expedient to grant the prayer of the said petition:

Now, therefore, His Excellency the Right Honourable William Hillier, Earl of Onslow, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred by “The Sheep Act, 1890” (hereinafter termed “the said Act”), and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the Wellington Subdivision of the Wellington Sheep District, as defined under the said Act, shall be exempt from the operation of section sixty-seven of the said Act; and it is hereby declared that this Order in Council shall come into force upon the publication thereof in the New Zealand Gazette.

Regulations under “The Post and Telegraph Classification and Regulation Act, 1890.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this first day of February, 1892.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

IN pursuance and exercise of the power and authority contained in “The Post and Telegraph Classification and Regulation Act, 1890” (hereinafter termed “the said Act”), and of all other powers and authorities enabling him in that behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and direct that the list of officers which by Regulation twenty-four (subsection four) of the regulations made under the said Act, and published in a Supplement to the New Zealand Gazette on the twenty-fourth of January, one thousand eight hundred and ninety-one, is directed to be published in January of each year, shall for the year one thousand eight hundred and ninety-two be published in the month of March: And I do hereby further order and declare that the said recited regulations shall be read and construed subject to the alterations hereby made or intended so to be.

Native Land proposed to be taken for a Road in Opua-whanga Survey District.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this thirtieth day of December, 1891.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work authorised to be constructed by the Government, to wit, the construction of a road:

And whereas the said land is held or occupied by Native owners:

Now, therefore, in pursuance and exercise of the powers vested in him by “The Public Works Act, 1882,” and the amendments thereof, and of all other powers in anywise enabling him in this behalf, His Excellency William Hillier, Earl of Onslow, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the Government work known as a road shall and may be constructed on or through the land mentioned in the Schedule hereto.
