Removal of Restrictions on Alienation of Native Land.

ONSLOW, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-third day of November, 1891.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS application has been made to the Governor in Council by Komene Paipa, the Native owner of the lands described in the second column of the Schedule hereto, praying that the restrictions on the alienation of such lands contained in the Crown grant, bearing date the twenty-eighth day of November, one thousand eight hundred and eighty-two, described in the first column of the said Schedule, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has reported that the provisions of the law in that behalf have been complied with: And whereas it appears expedient to grant such application:

Now, therefore, His Excellency the Right Honourable William Hillier, Earl of Onslow, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by "The Native Land Act, 1888," and acting with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that all restrictions imposed by the said Crown grant on the alienation of the said lands are hereby removed.

Particulars of Grant or Instrument containing Restrictions. Description of Lands.
Crown grant, dated 28th November, 1882, in favour of Komene Paipa, and containing the following restriction: "Inalienable by sale, or by lease for a longer period than twenty-one years, or by mortgage, except with the consent of the Governor being previously obtained to every such sale, lease, or mortgage." All those parcels of land in the Provincial District of Wellington containing 2 acres 3 roods 18 perches, and known as Subsection 8 and part Subsection 7 of Section 3, Hutt District.

Rates of Interest on the Moneys forming the Common Fund of the Public Trustee's Account.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-sixth day of November, 1891.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS by the eleventh section of "The Public Trust Office Acts Amendment Act, 1891," it is, among other things, provided that the interest payable to the respective properties, the moneys of which shall form the common fund of the Public Trustee's Account within the meaning of the said Act, shall be at a rate to be from time to time determined by the Governor in Council: Provided that on the moneys arising from one property no rate shall be allowed higher than five pounds per centum per annum on an amount not exceeding three thousand pounds, or higher than four pounds per centum per annum on any amount in excess of twenty thousand pounds: And whereas it is expedient that the rates of interest payable to the respective properties as aforesaid shall be determined as hereinafter mentioned:

Now, therefore, His Excellency William Hillier, Earl of Onslow, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority vested in him by the said in part recited Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby order and determine that, on and after the first day of December next, the rates of interest payable to the respective properties, the moneys of which form one common fund within the meaning of the said Act, shall be those hereinafter respectively set forth, namely:—

  1. Where the moneys arising from one property do not exceed three thousand pounds, five pounds per centum per annum;
  2. Where the moneys so arising are in excess of three thousand pounds, then on any amount so in excess, four pounds per centum per annum.

And also doth declare that such rates of interest shall be computed from the first day of the month following the receipt of such moneys into the Public Trustee's Account, and shall be allowed clear of any charges for the receipt or collection thereof.
