Prescribing Dues and Rates for J. Webster's Wharf,
Opononi, Hokianga.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this ninth

day of January, 1890.

Present:

THE HONOURABLE E. MITCHELSON PRESIDING IN COUNCIL.

WHEREAS John Webster, of Opononi, was, by Order in

Council dated the nineteenth day of February, one
thousand eight hundred and eighty-nine, and issued under
"The Harbours Act Amendment Act, 1883," licensed to use
and occupy a part of the foreshore and land below low-water
mark immediately contiguous thereto, as shown on plan
marked M.D. 1491, for the purpose of constructing a wharf
at Opononi, Hokianga Harbour: And whereas the said
wharf has been constructed, and it is expedient to prescribe
dues and rates to be charged for the use thereof and other-
wise as hereinafter provided:

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, by and with the advice and consent of the
Executive Council of the said colony, and in pursuance and
exercise of the power and authority granted to him by "The
Harbours Act, 1878," and of all other powers and authorities
enabling him in that behalf, doth hereby prescribe that,
from and after the date of the publication hereof in the New
Zealand Gazette
, the dues and rates set forth in the Schedule
hereto shall be charged and taken for the use of the said
wharf.

SCHEDULE.

  1. The dues and rates hereby prescribed shall apply to the
    wharf so constructed by John Webster as aforesaid.

  2. Every person who shall use the wharf for landing goods,
    or whose goods are stored in any shed on the wharf, shall
    pay wharf-dues in respect of the landing, storage, receiving
    and delivering such goods, as follows, that is to say,—

(a.) For all goods (except such as are hereinafter provided
for) landed, stored, received, or delivered, at weight or
measurement, according to shipping usage.

Redefining Boundaries of Awatere and Wairau Road
Districts, County of Marlborough.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this ninth
day of January, 1890.

Present:

THE HONOURABLE E. MITCHELSON PRESIDING IN COUNCIL.

WHEREAS by "The Road Boards Act, 1882" (herein-
after termed "the said Act"), it is, among other
things, enacted that all road districts and highway districts
existing under the provisions of the Acts and Ordinances
thereby repealed should, notwithstanding any defect in their
constitution, be deemed to be road districts as therein
mentioned; and by the said Act it is also provided that the
Colonial Secretary should, as soon as conveniently might be
after the coming into operation of the said Act, by notices in
the Gazette, define the boundaries of all road districts in
existence on the coming into operation of the said Act, and
of the subdivisions thereof, as they existed on the date of
such notice:

And whereas under the authority lastly hereinbefore re-
cited, and after the coming into operation of the said Act,
the Colonial Secretary did, by notice published in the
Gazette of the thirtieth day of April, one thousand eight

hundred and eighty-three, define the boundaries of the
Awatere Road District and the Wairau Road District in the
Marlborough County, and also the subdivisions of the said
several road districts:

And whereas a portion of the Taylor Pass Road, which
then was included in the boundaries of the Awatere Road
District, was by error included in the boundaries of the
Wairau Road District, so defined and published as aforesaid:

And whereas by the said Act it is also provided that in any
case in which no sufficient provision is made by the said Act,
or where anything is irregularly done in matter of form, the
Governor may, by Order in Council, gazetted and publicly
notified from time to time, make provision for any such case
so irregularly done in matter of form, so that the true intent
and purpose of the said Act may have effect:

And whereas it hath been made to appear that the said
portion of the Taylor Pass Road, which is particularly
described in the First Schedule hereto, ought of right to
have been included in the boundaries of the Awatere Road
District, so defined as aforesaid, and not in those of the
Wairau Road District, as hereinbefore mentioned, and that
the same was included in the notice published in the Gazette
as aforesaid by error, which ought to be rectified, and also
that the several matters hereinafter provided for, and for
which no sufficient provision is made by the said Act, should
be provided for as and in manner hereinafter set forth:

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of the power and
authority vested in him by the said Act, to the end that the
true intent and purpose thereof may have effect, and by and
with the advice and consent of the Executive Council of the
said colony, doth hereby order and declare that the said
notice so published in the Gazette of the thirtieth day of
April, one thousand eight hundred and eighty-three, shall be
and the same is hereby amended by including within the
boundaries of the Awatere Road District, as defined as
aforesaid, the portion of Taylor Pass Road particularly
described in the First Schedule hereto; and in further pur-
suance and exercise of the power and authority aforesaid,
and by and with the advice and consent aforesaid, doth also
order and declare that the boundaries of the said Wairau
and Awatere Road Districts, and of the several subdivisions
thereof, shall be and be deemed to have been those respec-
tively set out and described in the Second Schedule hereto,
and as if the same had been so described in the said Gazette
of the thirtieth day of April, one thousand eight hundred and
eighty-three.

FIRST SCHEDULE.

ALL that area in the County of Marlborough situated in the
Taylor Pass Survey District, being the road known as the
Taylor Pass Road, which commences at the northern
boundary of Section No. 48, Block III., and proceeds in
southerly and easterly directions to the Taylor River, at the
base of the hill called the Maori.

SECOND SCHEDULE.

AWATERE ROAD DISTRICT.

ALL that area in the Provincial District of Marlborough
bounded towards the north-east by the ocean, from Cape
Campbell to the mouth of the Awatere River; thence towards
the north and north-west by the Awatere River aforesaid to
a point in line with the south-western boundary-line of Sec-
tion No. 30, Clifford Bay Survey District; thence again
towards the north-east by a right line across the Awatere
River aforesaid to and thence by Section No. 30 aforesaid;
thence again towards the north-west by a road fronting Sec-
tion No. 31, aforesaid survey district; thence again towards
the north-east generally by a road, and Sections Nos. 29, 28,
and 4 of Block I., 6 of Block II., 15 of Block II., and 14 of
Block II., Clifford Bay Survey District aforesaid; thence
again towards the north-west by Section No. 14 of Block II.
aforesaid and Section No. 27 to the Maxwell Pass Stream;
thence again towards the north-east and east generally by
that stream to the watershed; thence to and by a tributary
of the Taylor River to the Taylor River, at the base of the
hill called the Maori; thence by the said Taylor River and
by the eastern side of the Taylor Pass Road to its junction
with the road between Sections Nos. 28 and 48, Taylor Pass
Survey District; thence towards the north by that road; thence
towards the west and south-west by the western side of the
Taylor Pass Road to the confluence of the Taylor Pass Creek
with the Taylor River aforesaid, and by that river to a place
near to the south-western boundary-line of Section No. 44 of
Block I., Taylor Pass Survey District; thence by a line to
the saddle, and by the summit of the dividing range between
the Wairau and Awatere Valleys to Barefell Pass; thence
by the Guide River and the Acheron River to the confluence
of the latter with the Clarence River; thence towards the
south-east by the boundary-line between the Provincial Dis-
tricts of Marlborough and Nelson to the Clarence River
aforesaid; thence again towards the south-east and towards
