SPECIAL ORDER.

RESOLVED, That a special rate of one-sixteenth of a penny in the pound be made upon all property in the Whatuapoko Road District for a period of twenty-six years, commencing on the 1st day of January, 1890, and ending on the 31st day of December, 1916, for the purpose of providing interest upon a sum of £230, found necessary to be raised to complete the works for which the former loan of £2,300 was raised by this Board.

The rate to be due and payable on the 1st days of February and August.

That an application be made to the Government for a sum of £230, in terms of “The Government Loans to Local Bodies Act, 1886,” for the purpose of completing the works in North Gisborne.

I certify that the foregoing special order was made by the Whatuapoko Road Board, and that all the requirements of the law have been complied with.

Importation of New Zealand Sheep into South Australia prohibited.—Notice No. 230.

PROCLAMATION by His Excellency the Right Honourable ALGERNON HAWKINS THOMOND, EARL OF KINTORE, LORD FALCONER OF HALKERTON, LORD KEITH OF INVERURIE, a Member of Her Majesty's Most Honourable Privy Council, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Governor and Commander-in-Chief in and over the Province of South Australia and the Dependencies thereof, &c.

By virtue of the provisions of “The Stock Diseases Act, 1888,” I, the Governor, with the advice and consent of the Executive Council, for the purpose of preventing the introduction of the disease called scab into the said province, do hereby proclaim, order, and direct that the importation of sheep from the Colony of New Zealand into the said province shall be and is hereby absolutely prohibited for a period of two years; and I direct that this Proclamation shall take effect from the first day of November, one thousand eight hundred and eighty-nine.

Given under my hand and the public seal of the said province, at Adelaide, this thirtieth day of October, in the year of our Lord one thousand eight hundred and eighty-nine, and in the fifty-third year of Her Majesty's reign.

Regulations under "The Patents, Designs, and Trade-marks Act, 1889."

I, GEORGE FREDERICK RICHARDSON, the Minister acting for the Commissioner of Trade and Customs, do hereby make the following regulations under section 104 of "The Patents, Designs, and Trade-marks Act, 1889," that is to say,—

  1. Goods prohibited to be imported for having applied to them forged trade-marks, false trade descriptions, or marks, names, or descriptions otherwise illegal, which upon examination are detected by the officers of Customs, are to be detained by them without the requirement of previous information.

  2. In giving information with a view to detention an informant must fulfil the following conditions, namely:—
    (i.) He must give to the Collector of Customs of the port of expected importation notice in writing stating—
    The number of packages expected, as far as he is able to state the same;
    The description of the goods by marks or other particulars sufficient for their identification;
    The name or other sufficient indication of the importing ship;
    The manner in which the goods infringe the Act;
    The expected day of the arrival of the ship.
    (ii.) He must deposit with the Collector a sum sufficient, in the opinion of that officer, to cover any additional expense which may be incurred in the examination required by reason of his notice.

  3. If upon arrival and examination of the goods the Collector is satisfied that there is no ground for their detention, they will be delivered. If he is not so satisfied, he will decide either to detain the goods, as in a case of detention upon ordinary examination, or to require security from the informant for reimbursing the Commissioner or his officers all expenses and damages incurred in respect of the detention made on his information and of any proceedings consequent thereon.

  4. The security thus required must be an immediate ad valorem deposit of £10 per cent. on the value of the goods, irrespective of duty, as fixed by the Collector from the quantities or value shown by the entry; and also, subsequently, a bond, to be completed within four days, in double the value of the goods, with two approved sureties. The ad valorem deposit will be returned upon completion of the bond, and will not be required if, as an alternative where time permits, the informant prefers to give a like bond before examination, upon estimated value of the goods declared to by him under statutory declaration. If the security is not duly given as above required, there will be no further detention of the goods.
