A PROCLAMATION.

IN pursuance and exercise of the powers and authorities conferred upon me by the one hundred and sixty-sixth section of "The Land Act, 1885," I, William Hillier, Earl of Onslow, the Governor of the Colony of New Zealand, do hereby set apart the lands enumerated in the Schedule to an Order in Council of even date herewith, and made under the one hundred and sixty-seventh section of the said Act, for sale as a village settlement, upon such terms and conditions as are set forth in the said Order in Council.

Given under the hand of His Excellency the Right Honourable William Hillier, Earl of Onslow, of Onslow in the County of Salop; Viscount Cranley, of Cranley in the County of Surrey; Baron Onslow, of Onslow in the County of Salop, and of West Clandon in the County of Surrey; Baron Cranley, of Imbercourt; Baronet; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty's Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at Dunedin, this twenty-fourth day of December, in the year of our Lord one thousand eight hundred and eighty-nine.

A PROCLAMATION.

BY virtue and in exercise of the powers and authorities vested in me by the two hundred and thirty-seventh section of "The Land Act, 1885," and of every other power and authority enabling me in that behalf, I, William Hillier, Earl of Onslow, the Governor of the Colony of New Zealand, do hereby revoke the Proclamations dated the thirty-first day of October, one thousand eight hundred and eighty-three, and the sixteenth day of August, one thousand eight hundred and eighty-eight, in so far as they relate to the sections of land enumerated in the Schedule hereto, which were, with other lands, set apart for sale for cash and on deferred payments under the provisions of "The Land Act 1877 Amendment Act, 1882," "The Land Act, 1885," and "The Land Act Amendment Act, 1887."

Terms and Conditions of Sale or Selection of the Molyneux Village-settlement Small-farm Allotments, in the Otago Land District.

ORDER IN COUNCIL.

At the Government House, at Dunedin, this twenty-fourth day of December, 1889.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the one hundred and sixty-seventh section of "The Land Act, 1885," it is enacted that the Governor in Council may fix the terms and conditions upon which the lands comprised in any village settlement shall be disposed of, and the mode of payment for the same:

And whereas His Excellency the Governor of the Colony of New Zealand has, by Proclamation issued under the provisions of section one hundred and sixty-six of the said Act and the fourteenth section of "The Land Acts Amendment Act, 1888," set apart the lands enumerated in the Schedule hereto as a village settlement:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the hereinbefore in part recited Act, and by and with the advice of the Executive Council thereof, doth, by this present order, fix the following as the terms and conditions upon which the village-settlement allotments enumerated in the Schedule hereto shall be disposed of, and the mode of payment for the same, that is to say,--

  1. The lands enumerated in the Schedule hereto shall be open as small-farm allotments for sale or selection either for cash, or on deferred payments, or on perpetual lease.

  2. The day upon which the lands shall be open for sale or selection shall be Wednesday, the fifth day of February, one thousand eight hundred and ninety.

  3. The purchaser for cash of any of the lands enumerated in the Schedule hereto will be required to make the following declaration:--

I, , of , in the Land District and Colony of New Zealand, do solemnly and sincerely declare--

  1. That I am the person who, subject to the provisions of "The Land Act, 1885," am purchasing Section , Block , District.

  2. That I am purchasing such land solely for my own use and benefit, and not directly or indirectly for the use or benefit of any other person whomsoever.

  3. That I am not the owner, tenant, or occupier, directly or indirectly, either by myself or jointly with any other person or persons, of any lands anywhere in the colony exceeding in the whole one acre.

And I make this solemn declaration conscientiously believing the same to be true, and by virtue of an Act of the General Assembly of New Zealand intituled "The Justices of the Peace Act, 1882."

  1. The purchaser for cash of any of the lands enumerated in the Schedule hereto must deposit with the Receiver of Land Revenue for the land district one-fifth of the purchase-money at the time of application, and shall pay the whole remainder of the purchase-money within thirty days of the granting of his application; and if not paid within thirty days his deposit shall be forfeited, and the lands shall be again open for sale or occupation forthwith; and upon full payment of the purchase-money he will be entitled to a Crown grant, to be issued in the usual way.

  2. If any of the lands enumerated in the Schedule hereto are selected upon deferred payments, the selector shall be subject to the provisions relating to Part III. of "The Land Act, 1885."

  3. If any of the lands enumerated in the Schedule hereto are selected under the perpetual-leasing system, the selector shall be subject to the provisions of Part IV. of "The Land Act, 1885."

  4. The prices stated in the Schedule hereto shall be the prices at which the lands shall be open for sale for cash. If the lands are selected on deferred payments, an addition of one-fourth to the cash price of the section will be made; and, if the lands are selected for perpetual leasing, the annual rental of the sections will be five per cent. on the cash price of the sections.

  5. No person shall be allowed to select more than one section.

  6. If there shall be more than one application on the same day for any allotment, the right to occupy the same shall be determined by lot amongst the applicants.

  7. Each applicant for a deferred-payment section will be required to make the declaration prescribed by section one
