Declaring a certain Road in the County of Inangahua to
be a County Road.
ONSLOW, Governor.
ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eighteenth
day of November, 1889.
Present:
THE HONOURABLE E. MITCHELSON PRESIDING IN COUNCIL.
IN pursuance and in exercise of the powers vested in him
by "The Public Works Act, 1882," and of all other
powers in anywise enabling him in this behalf, His Excellency
the Right Honourable William Hillier, Earl of Onslow, the
Governor of the Colony of New Zealand, by and with the
advice and consent of the Executive Council of the said
colony, doth hereby order that the road in the County of
Inangahua, described in the Schedule below, shall, on and
after the date above mentioned, become a county road.
SCHEDULE.
ALL that area situate in the Reefton Survey District, County
of Inangahua, being a road, 1 chain wide, the centre-line of
which commences at a point on the eastern side of the Reef-
ton to Westport and Buller Road about 1254 links northerly
from the south-western corner of Section No. 96, Block IX.,
and proceeds in a northerly direction, intersecting the said
Section No. 96 and a river reserve, to the Waitahu River;
thence across that river, and intersecting river reserve and
Sections Nos. 250, 249, and 248 of the said Block IX., to a
road intersecting the last mentioned section at a point dis-
tant 5425.5 links on a line bearing N. 10° 14′ 52" W. from
the commencing-point: as the same is more particularly
delineated on the plan marked S.G. 12364A, deposited in the
General Survey Office, at Wellington, in the Provincial Dis-
trict of Wellington, and thereon coloured red.

Vesting a Water Reserve in the Papatoitoi Road Board.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eighteenth
day of November, 1889.

THE HONOURABLE E. MITCHELSON PRESIDING IN COUNCIL.
WHEREAS the land mentioned in the Schedule hereto
was reserved for a water reserve: And whereas, in
the opinion of the Governor, it is expedient to vest the said
land in the Papatoitoi Road Board:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, by and with the advice and consent of the
Executive Council of the said colony, and in exercise of the
powers and authorities vested in him by the fourth section of
"The Public Reserves Act, 1881," doth hereby declare that,
from and after the day of the date hereof, the said reserve
shall become vested in the Papatoitoi Road Board, in trust,
for a water reserve.
SCHEDULE.
ALL that parcel of land in the Land District of Auckland,
being Section No. 41 of the Parish of Manurewa, and con-
taining by admeasurement 3 acres 1 rood 10 perches, more or
less. Bounded towards the north-east by a public road, 520
links; towards the south-east by a public road, 350 and 685
links; towards the south-west by Section No. 107 of the
Parish of Manurewa, 147 links; and towards the north-west
by said Section No. 107, 842 links, to the point of commence-
ment: be all the aforesaid linkages more or less.

Gisborne Harbour Board subject to the Provisions of "The
Public Bodies' Powers Act, 1887."

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eighteenth
day of November, 1889.

THE HONOURABLE E. MITCHELSON PRESIDING IN COUNCIL.
WHEREAS the Gisborne Harbour Board, being a
leasing authority within the meaning of "Th
Public Bodies' Powers Act, 1887" (hereinafter termed "the
said Act"), has requested that these presents should issue,
and it appears expedient to make the order hereinafter con-
tained:
Now, therefore, His Excellency the Governor of the
Colony of New Zealand, acting by and with the advice and
consent of the Executive Council of the said colony, doth
hereby order and declare that the Gisborne Harbour Board
shall, as from the date of the publication hereof in the New
Zealand Gazette, be subject to the provisions of the said
Act.

"Westland and Nelson Coalfields Administration Act,
1877."—Authorising Construction of a Railway.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eighteenth
day of November, 1889.
Present:
THE HONOURABLE E. MITCHELSON PRESIDING IN COUNCIL.
WHEREAS by the twenty-first section of "The West-
land and Nelson Coalfields Administration Act,
1877," it is enacted that the Governor may, by Order in
Council, authorise any lessee under a lease granted for coal-
mining purposes, and his servants or workmen, full and
free liberty of making, and using when so made, any rail-
ways, tramways, bridges, inclines, staiths, or other means
of transit over the lands described in the First, Second, and
Third Schedules to the said Act, and whether the sam, shall
be demised by any lease for coal-mining purposes or not, on
the conditions mentioned in sections twenty-two and twenty-
three of the said Act:
And whereas Edward Percy Simpson, of the City of
Sydney, in the Colony of New South Wales, Solicitor, is a
lessee of the Crown under a lease granted for coal-mining
purposes, and has complied with the conditions set forth
in sections twenty-two and twenty-three of the said Act, and
is desirous of constructing a railway, bridges, inclines, and
staiths over the lands mentioned in the Schedule below,
which said lands form part of the lands described in the
Third Schedule to the said Act:
Now, therefore, His Excellency the Governor, in exercise
and pursuance of the above-recited power, and by and with
the advice and consent of the Executive Council of New
Zealand, doth hereby authorise the said Edward Percy Simp-
son and his assigns, and his or their servants and workmen,
full and free liberty of making, and using when so made, a
railway, bridges, inclines, and staiths over the land described
in the Schedule hereto: Provided, however, that the autho-
rity hereby given shall be concurrent with the coal-mining
lease from the Queen to the said Edward Percy Simpson,
dated the twenty-eighth day of March, one thousand eight
hundred and eighty-nine, and being for a term of sixty-three
years from the first day of January one thousand eight
hundred and eighty-nine; and such authority shall de-
termine, without further notice, at the expiration of the
said sixty-three years, or at such prior time as the said lease
may expire or be determined: Provided, further, that the
right is hereby reserved to the Government to construct a
road, if necessary, over any portion of the land mentioned
in the Schedule below that is not occupied by the railway,
bridges, inclines, and staiths aforesaid; and also that the
Government may permit the County Council or the Road
Board to construct a road over such land upon the like
condition.
