Addition to the Mercer Domain brought under "The Public
Domains Act, 1881."

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this ninth
day of October, 1889.
Present:
THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

BY virtue of the powers and authorities vested in me by
the twenty-fourth section of "The Public Reserves
Act, 1881," I, William Hillier, Earl of Onslow, the Governor
of the Colony of New Zealand, by and with the advice and
consent of the Executive Council of the said colony, do
hereby order and declare that the reserve made for public
recreation in the Provincial District of Auckland, and known
as Mercer Recreation-ground, and described in the Schedule
hereto, shall be and the same is hereby brought under the
operation of and declared to be subject to the provisions of
"The Public Domains Act, 1881; and such domain shall
hereafter be managed, administered, and dealt with, in
manner directed by the said Act, by the Domain Board con-
stituted by an Order in Council issued on the twenty-sixth
day of June, one thousand eight hundred and eighty-eight.

SCHEDULE.

ALL that parcel of land in the Land District of Auckland,
containing by admeasurement 20 acres 3 roods, more or less,
being Section No. 139, Parish of Koheroa. Bounded towards
the north generally by a road reservation, 1 chain wide, along
the Maungatawhiri River; towards the east by a public road-
line, 100 links wide, 1600 links; towards the south-east by a
public road-line, 100 links wide, 1160 links; towards the
south-west by Section No. 90, Parish of Koheroa aforesaid,
2097 links; and towards the north-west by Section No. 136,
parish aforesaid, 757 links: be all the aforesaid linkages more
or less.

Removal of Restrictions on Alienation of Native Land.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this ninth day
of October, 1889.
Present:
THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS application has been made to the Governor
in Council by Heremaia Paora, the Native owner
of the land described in the second column of the Schedule
hereto, praying that the restrictions on the alienation of
such lands contained in the certificate of title, bearing date
the eighth day of October, one thousand eight hundred and
eighty-six, described in the first column of the said Schedule,
may be removed: And whereas it appears expedient to grant
such application:

Now, therefore, His Excellency the Right Honourable
William Hillier, Earl of Onslow, the Governor of the Colony
of New Zealand, in pursuance and exercise of the powers
conferred on him by "The Native Land Act, 1888," and
acting with the advice and consent of the Executive Council
of the said colony, doth hereby order and declare that all
restrictions imposed by the said certificate of title on the
alienation of the said lands are hereby removed.

WHEREAS application has been made to the Governor
in Council by Weta Puna (successor), the Native
owner of the land described in the second column of the
Schedule hereto, praying that the restrictions on the aliena-
tion of such lands contained in the Crown grant, bearing
date the twenty-first day of November, one thousand eight
hundred and sixty-seven, described in the first column of
the said Schedule, may be removed: And whereas it appears
expedient to grant such application:

Now, therefore, His Excellency the Right Honourable
William Hillier, Earl of Onslow, the Governor of the Colony
of New Zealand, in pursuance and exercise of the powers
conferred on him by "The Native Land Act, 1888," and
acting with the advice and consent of the Executive Council
of the said colony, doth hereby order and declare that all

viously obtained to every such

Regulations under "The Land Act, 1885."

ONSLOW, Governor.

IN pursuance and exercise of the powers and authorities
conferred upon me by the fourth section of "The Land
Act, 1885," I, William Hillier, Earl of Onslow, the Governor
of the Colony of New Zealand, do hereby make the following
regulations for the purposes of the said Act, that is to
say,-

  1. All timber and other produce (except kauri gum) within
    any forest on Crown lands (other than State forest) may
    be disposed of either by auction at per 100ft., or by ap-
    praisement for a single tree; and all moneys which shall
    be payable for such timber or products shall be paid to the
    Receiver of Land Revenue.

  2. It shall be a condition precedent to the sale of any
    quantity of timber other than a single tree that a Crown
    Lands Ranger shall first report on the estimated quantity,
    quality, and general position and value of such timber; and
    thereupon the Land Board of the district may order the
    sale in manner above described.

  3. When timber is sold by auction it shall be a condition
    that fifty per centum on the value of the estimated quantity
    be paid to the Receiver of Land Revenue on the fall of the
    hammer, and the balance upon such date as shall be stated
    in the license, and when sold by the single tree that the
    price fixed be paid at the time of sale. If any balance of
    purchase-money remains unpaid for the space of seven days
    after the time limited for payment thereof, the Land Board
    may declare the contract of sale, and all rights and privi-
    leges of the purchaser thereunder, to be at an end, and there-
    upon any moneys paid in respect of such contract shall be
    absolutely forfeited to Her Majesty.

  4. Before any license is issued to any purchaser of timber
    bought at auction, all timber so sold shall be branded by a
    Crown Lands Ranger, and only such timber as bears such
    brand shall be felled, cut, or sawn.

As witness the hand of His Excellency the Governor,
this twelfth day of October, one thousand eight
hundred and eighty-nine.
