"The Native Land Act, 1888," and acting with the advice
and consent of the Executive Council of the said colony,
doth hereby order and declare that all restrictions imposed
by the said Crown grant on the alienation of the said lands
are hereby removed.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-
ninth day of January, 1889.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers and authorities
conferred upon him by the thirty-fourth section of "The
Land Act Amendment Act, 1887," His Excellency the
Governor of the Colony of New Zealand, by and with the
advice and consent of the Executive Council of the said
colony, doth hereby make the following regulations, that is
to say,-

REGULATIONS.

  1. Every application to select rural land which is open for
    selection under the deferred-payment system, or under the
    perpetual-lease system, in accordance with the provisions of
    "The Land Act Amendment Act, 1887," shall be accom-
    panied by a statutory declaration made and signed by the
    applicant, and forwarded to or deposited with the Commis-
    sioner of Crown Lands for the district in which the land is
    situated before such selection is made.

  2. No such application will be received from any one
    person for more than one allotment, i.e., one section or group
    of contiguous sections. The area to be selected shall not
    exceed that authorised under the provisions of "The Land
    Act Amendment Act, 1887."

  3. In the case of applications to select such land upon
    deferred payment, the declaration aforesaid shall be in the
    form marked I. in the Schedule hereto, or to the effect
    thereof; and, in the case of applications to select such land
    upon perpetual lease, the declaration aforesaid shall be in
    the form marked II. in the said Schedule, or to the effect
    thereof.

  4. The statutory declaration required to be made by a
    licensee or lessee under these regulations shall, in case of
    the transfer of a license or lease, or in the case of a sub-
    lease, be made by such transferee or sub-lessee before he
    shall be admitted into possession or occupation of the land
    comprised in such license or lease; and the declaration
    hereby required to be made by such transferee or sub-lessee
    shall be made in such one of the forms hereby prescribed, or
    to the effect thereof, as shall be applicable.

  5. The regulations made under the fourth section of "The
    Land Act, 1885," by warrant under the hand of the Governor,
    bearing date the twenty-fifth day of Jauuary instant, shall
    be and the same are hereby incorporated with these regula-
    tions, so far as the same apply to unsurveyed lands purchased
    for cash or selected upon deferred payment or perpetual lease.

  6. Nothing in these regulations shall be deemed to inter-
    fere with or restrict the operation of any express provision
    of "The Land Act, 1885," or any of its amendments.

SCHEDULE.

I.

I, A.B., of [Insert place of abode and occupation], do
solemnly and sincerely declare as follows:-

(1.) I am of the age of seventeen years and upwards.
(2.) I am making the present selection of land [or I am
desirous of becoming the transferee of a license for land
held by

], under the system of deferred
payments, under "The Land Act, 1885," and its amendments,
bona fide for my own exclusive use and benefit, and not
directly or indirectly for the use or benefit of any other
person whomsoever, and for the purpose of cultivation.
(3.) I have not at any time acquired the freehold of any
land under the deferred-payment system, or under the home-
stead system, which, with my present application, will
exceed 640 acres in all.
(4.) I am not the holder, either in my own name or in the
name of any other person, of, and that I am not beneficially
interested in, any lands of the Crown within the colony
under the deferred-payment system, or under the perpetual-
lease system, or under any agricultural lease, to an amount
which, added to the acreage comprised in this present appli-
cation, would exceed 640 acres in extent.
(5.) I am not the owner of a pre-emptive right, or of 640
acres of land in all.

And I make this solemn declaration conscientiously
believing the same to be true, and by virtue of an Act of the
General Assembly of New Zealand intituled "The Justices
of the Peace Act, 1882."

ment Act, 1887," 2,000 acres).
(5.) I have not, within three years prior to the date hereof,
surrendered a lease granted under "The Land Act, 1885," or
its amendments, with perpetual right of renewal of the lands
for a lease whereof I am now applying.

And I make this solemn declaration conscientiously
believing the same to be true, and by virtue of an Act of the
General Assembly of New Zealand intituled "The Justices
of the Peace Act, 1882."

Regulations under "The Land Act, 1885."

IN pursuance and exercise of the powers and authorities
conferred upon me by the fourth section of "The Land
Act, 1885," I, William Francis Drummond Jervois, the
Governor of the Colony of New Zealand, do hereby rescind
regulations numbered respectively one hundred, and one
hundred and one, of certain regulations made under the said
Act on the nineteenth day of May, one thousand eight hun-
dred and eighty-six, and published in Gazette No. 30 of the
same year, and also a certain regulation made under the
said Act on the twelfth day of June, one thousand eight
hundred and eighty-eight, and published in Gazette No. 34
of the same year.

And, in further pursuance and exercise of the said powers
and authorities, I do hereby make the following rules,
regulations, and orders for the purposes of the said Act, that
is to say,-

(1.) The following rules, regulations, and orders shall
extend and apply to unsurveyed rural lands open for pur-
chase or selection.
(2.) The following charges for surveys of such lands are
hereby imposed :-
