Terms and Conditions of Sale or Selection of Village-settle-
ment Small-farm Allotments in the Auckland Land Dis-
trict.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
eighth day of December, 1888.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by the one hundred and sixty-seventh sec-
tion of "The Land Act, 1885," it is enacted that the
Governor in Council may fix the terms and conditions upon
which the lands comprised in any village settlement shall be
disposed of, and the mode of payment for the same:
And whereas His Excellency the Governor of the Colony
of New Zealand has, by Proclamation issued under the
provisions of section one hundred and sixty-six of the said
Act, set apart the lands enumerated in the Schedule hereto
as a village settlement:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of the powers
and authorities conferred upon him by the hereinbefore in
part recited Act, and by and with the advice of the Executive
Council thereof, doth hereby fix the following as the terms
and conditions upon which the village settlement enume-
rated in the Schedule hereto shall be disposed of, and the
mode of payment for the same, that is to say,-

The said lands shall be open as small-farm allotments
for selection on perpetual lease only. -
The day upon which the lands shall be open for selec-
tion shall be Wednesday, the thirteenth day of February,
one thousand eight hundred and eighty-nine. -
The lands shall be subject to the provisions of Part IV.
of "The Land Act, 1885," with the exception of section
one hundred and forty-three, saving the declaration, which
shall be altered to suit the system of application instead of
tendering, also excepting sections one hundred and fifty and
one hundred and sixty. -
The annual rental of the sections shall be five per cent.
on the capital value of each section. -
If there shall be more than one application on the
same day for any allotment, the right to occupy the same
shall be determined by lot amongst the applicants. -
No person shall be permitted to acquire the fee-simple
of any of the sections enumerated in the accompanying
Schedule. -
Each applicant shall be required to deposit with the
Receiver of Land Revenue for the land district a sum equal
to one half-year's rent of the allotments included in the
application, and such payment shall be in discharge of the
half-year's rent due on the first day of January or July
which shall first ensue after the commencement of the term,
together with the sum of thirty shillings for the lease and
registration thereof. -
Each applicant will be required to make a statutory
declaration in terms of section one hundred and forty-three
of "The Land Act, 1885," that he is applying for the land
solely for his own use and benefit, and not for the use and
benefit of any other person or persons whomsoever.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fifteentli
day of January, 1889.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by "The Justices of the Peace Act, 1882,"
it is, amongst other things, provided that the fees to
be taken and paid in respect to proceedings to which the
said Act relates, as set forth in the Third Schedule thereto,
may be fixed, varied, and abolished as the Governor in
Council may from time to time direct and appoint: And
whereas it is expedient to vary or abolish the said fees in
part as hereinafter appears:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of all powers
and authorities in this behalf enabling him, and by and
with the advice of the Executive Council of the said colony,
doth hereby order and fix that, from and after the twenty-
first day of January instant, the fees specified in the said
Third Schedule to "The Justices of the Peace Act, 1882,"
shall not be taken in proceedings under "The Destitute
Persons Act, 1877," or any Act amending the same.

Board.

At the Government House, at Wellington, this fifteenth
day of January, 1889.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS it is enacted by section forty-six of "The
Harbours Act, 1878" (hereinafter termed "the said
Act"), that if at any time it shall be made to appear to the
Governor that a local governing body or association electing
or appointing a member or members of a Harbour Board has
ceased to exist, or has been incorporated with or united to
some other local governing body or association, the Governor
may, by Order in Council, declare what other local governing
body or association shall return a member in lieu of the body
or association so ceasing to exist or being incorporated or
united as aforesaid:
And whereas it is provided by "The Auckland Harbour
Board Act, 1885," that one member of the Auckland Harbour
Board shall be elected by the Northcote and Birkenhead
Road Boards sitting together and acting as one Board at a
