of all other powers enabling him in that behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby delegate to the Tuapeka County Council the powers conferred upon him by section six of “The Cemeteries Act, 1882,” as to the appointment and removal of Trustees for the cemeteries described in the Schedule hereto, and doth declare that this Order in Council shall take effect as from the day of the date hereof.

SCHEDULE.

ALL that piece or parcel of land in the Land District of Otago, containing by admeasurement 5 acres, more or less, being Section No. 24, Block VII., Crookston District. Bounded towards the north-east by a road-line, 553 links; towards the east by Section No. 7, Block VII., 865 links; towards the south by said Section No. 7, 536 links; and towards the west by Section No. 8, Block VII., 1000 links: be all the aforesaid linkages more or less.

Removal of Restrictions on Alienation of Native Land.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of November, 1888.

Present:

His Excellency the Governor in Council.

WHEREAS application has been made to the Governor in Council by Hori Kerei Taiaroa, comprising a majority in number of the Native owners of the land described in the second column of the Schedule hereto, praying that the restrictions on the alienation of such land contained in the Crown grant, bearing date the twenty-first day of March, one thousand eight hundred and seventy, described in the first column of the said Schedule, may be removed: And whereas it appears expedient to grant such application:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by “The Native Land Act, 1888,” and acting with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that all restrictions imposed by the said Crown grant on the alienation of the said land are hereby removed.

Particulars of Grant or Instrument containing Restrictions. Description of Lands.
Crown grant No. 10684, in favour of Hori Kerei Taiaroa and Hone Wetere Korako, dated 21st March, 1870, containing the following restrictions: “Inalienable by sale, or by lease for a longer period than twenty-one years, or by mortgage, except with the consent of the Governor previously obtained.” All that piece or parcel of land situated at Otago Heads, in the Provincial District of Otago, containing 1,333 acres 3 roods, more or less, being the block of land known by the name of Otago Heads, Lot 25.

Removal of Restrictions on Alienation of Native Land.

WHEREAS application has been made to the Governor in Council by Henare Kaihau, comprising a majority in number of the Native owners of the land described in the second column of the Schedule hereto, praying that the restrictions on the alienation of such land contained in the certificate of title, bearing date the fourteenth day of June, one thousand eight hundred and eighty-seven, described in the first column of the said Schedule, may be removed: And whereas it appears expedient to grant such application;

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by “The Native Land Act, 1888,” and acting with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that all restrictions imposed by the said certificate of title on the alienation of part of the said land are hereby removed.

Particulars of Grant or Instrument containing Restrictions. Description of Lands.
Certificate of title under the Land Transfer Act in favour of Henare Kaihau, dated the 14th June, 1887, containing the following restrictions: “Absolutely inalienable by sale, gift, mortgage, or lease for a longer period than twenty-one years.” All that parcel of land in the Provincial District of Auckland, in the Colony of New Zealand, containing by admeasurement 258 acres, be the same little more or less, and being part of Allotment No. 385, Parish of Waipipi. Bounded on the north commencing from a point on the sea-coast by a creek and by lines, 1292 links, 2816 links, 213 links, 392 links, 600 links, 170 links, 194 links, 165 links, 206 links, and 154 links; on the north-east by lines, 1002 links, 913 links, 1055 links, 852 links, 400 links, and 400 links; on the east by lines, 392 links, 841 links, 956 links, 184 links, 2000 links, 3650 links, and 1885 links; on the south-west by the sea; on the north-west, south, and south-east by other part of said allotment, known as the Wahi-tapu, or Maori burial-place; again on the south-west, north-west, west, south, south-east, south-west, north-west, and south by lines dividing the portion of the land desired to be exchanged from other portion of said Allotment No. 385, used as a wahi-tapu, or Native burial-place.

IN exercise and pursuance of the powers and authorities conferred by “The Post Office (Foreign Parcels) Act, 1888,” and “The Post Office Act Amendment Act, 1886” (hereinafter termed “the said Acts,”) His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make, for the purposes of the parcel post between New Zealand and the United Kingdom, the several regulations set forth in the Schedule hereto, and doth hereby declare that such regulations shall come into force on and after the twenty-eighth day of November instant.

REGULATIONS.

INTERPRETATION.

“PARCEL” means any package or parcel which may be conveyed, or be intended to be conveyed, by means of the Post Office, under the Acts and regulations from time to time in force relating to the Post Office; and either posted in New Zealand for transmission to any place in the United Kingdom, or posted at any place in the United Kingdom for transmission to a place in New Zealand.
