of the purposes hereinbefore mentioned, and all the pro-
visions of the said Act in respect of such licenses shall,
mutatis mutandis, apply accordingly: And whereas there
being no Harbour Board empowered to grant such license,
the Akaroa Borough Council (hereinafter called “the said
Council”) has applied to the Governor in Council for a license
under the said Act to occupy a part of the foreshore, and the
land below low-water mark immediately contiguous to such
foreshore, in order to erect and maintain thereon baths and
bath-houses in Akaroa Harbour; and, in accordance with
the one hundred and fifty-sixth section of “The Harbours
Act, 1878,” has deposited plans in the office of the Marine
Department, at Wellington (marked M.D. 1463 and 1464),
showing the place in the said harbour where it is intended to
erect such baths and bath-houses, and the manner in which
it is proposed to erect the same, and the area of foreshore
or land below low-water mark intended to be occupied for
such purposes: And whereas it has been made to appear to
the Governor in Council that the proposed work will not be or
tend to the injury of navigation; and the said plans have,
prior to the making of this Order in Council, been approved
by the Governor in Council, without modification or addition :
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of the power and
authority vested in him by the said Act, and with the advice
and consent of the Executive Council of the said colony, doth
hereby license and permit the said Council to use and occupy
those parts of the foreshore and of the land below low-water
mark immediately contiguous thereto which are particularly
shown and delineated on the plans so deposited as aforesaid,
for the purpose of constructing or erecting thereon baths and
bath-houses in accordance with the said plans, such license
to be held and enjoyed by the said Council upon and subject
to the following terms and conditions, that is to say,--

The concessions and privileges conferred by this Order
in Council shall extend and apply only to the parts of the
foreshore and of the land below low-water mark required for
the construction of the baths, bath-houses, and any enclosure
or fence necessary for the protection or privacy of the same,
as shown and delineated on the said plans as aforesaid. -
The foreshore included in this license shall be used
solely for bathing purposes. -
The said Council shall, during the subsistence of this
Order in Council, provide and maintain proper and sufficient
baths, with all necessary appliances and conveniences
thereto, as will enable the public to use and enjoy the same,
and all other advantages hereby conferred in respect of the
use and occupation of the foreshore and land below low-
water mark, and with or without any charge for the same,
and under such regulations for the decent and orderly use
thereof as the said Council may make. -
A printed copy of the regulations affecting the use of
the said baths, and advantages as aforesaid, shall be put up
by the said Council in such baths. -
That the rights, powers, and privileges conferred by this
Order in Council shall continue in force for fourteen years,
computed from the date of this Order in Council, unless
in the meantime such rights, powers, and privileges shall
be altered, modified, or revoked by competent authority ;
and the said Council shall not assign, charge, or part with
any such right, power, or privilege without the previous
written consent of the Minister first obtained. -
That the said rights, powers, and privileges may be at
any time resumed by the Governor, without payment of any
compensation whatever, on giving to the said Council three
calendar months’ previous notice in writing. Any such
notice shall be sufficient if given by the Minister, and de-
livered at or posted to the last known address of the said
Council. -
In case the said Council shall—
(1.) Commit or suffer a breach of the conditions herein-
before set forth, or any of them; or
(2.) Cease to provide or maintain the said baths for the
use of the public for bathing purposes,
then and in any of the said cases this Order in Council and
every right, power, or privilege may be revoked and deter-
mined by the Governor in Council without any notice
to the said Council or other proceeding whatsoever; and
publication in the New Zealand Gazette of an Order in
Council containing such revocation shall be sufficient
notice to the said Council, and to all persons concerned or
interested, that this Order in Council and the rights and
privileges thereby conferred have been revoked and deter-
mined. -
In these conditions the term “Minister” means the
Minister having charge of the Marine Department, as defined
by “The Shipping and Seamen’s Act, 1877,” and includes
any officer, person, or authority acting by or under the direc-
tion of such Minister.

IN pursuance of the powers and authorities conferred upon
me by “The Special Powers and Contracts Act, 1886,”
I, William Francis Drummond Jervois, the Governor of the
Colony of New Zealand, do hereby declare that the land
described in the Schedule hereto shall be a recreation-ground,
to be dealt with under the provisions of “The Public Domains
Act, 1881,” and “The Public Reserves Act, 1881,” or any
Acts amending the same.
SCHEDULE.
All that parcel of land in the Land District of Wellington,
containing by admeasurement 115 acres 1 rood, more or less,
being Section No. 115, Block IX., Paikakariki Survey Dis-
trict. Bounded on the north by Sections Nos. 90 and 68 ;
on the east by Sections Nos. 67, 65, and 64, the mouth of
the Pahantunui River, and Section No. 63 ; on the south by
Sections Nos. 7 and 116, and a public road ; and on the west
by Porirua Harbour : as the same is delineated on the plan
deposited in the office of the Chief Surveyor, Wellington.
As witness the hand of His Excellency the Governor,
this fifteenth day of October, one thousand eight
hundred and eighty-eight.

IN pursuance and exercise of the powers and authorities
conferred upon me by the third section of “The Land
Act Amendment Act, 1887” (hereinafter termed “the said
Act”), I, William Francis Drummond Jervois, the Governor
of the Colony of New Zealand, having received the report of
the Surveyor-General in this behalf, as in the said section is
provided, do hereby declare that the rural lands enumerated
in the Schedule hereto shall be open for sale or selection,
after the lapse of a period of three months from the date of
the first public notification hereof, in the manner and upon
the conditions mentioned in the said Act, and at the price
per acre respectively set opposite such land in the said
Schedule.

Sections 35933 and 35934 are situated near the Raincliff
Homestead, they are both rough hilly lands, a portion of the
latter has been ploughed and sown down in English grass ;
the other sections are also on the old Raincliff Run. Section
35940, on the Kakahu and Burke’s Pass Road, is partly
fenced and a portion laid down in English grass; 35941,
between Braddick’s and Talbot’s land, is partly ploughable
and partly hilly land; 35943, an old pre-emptive-right section,
partly cultivated, part first-class land, rest small gullies with
light soil on north side Opihi River, at the crossing of
Tandro’s Road, two miles from Fairlie Creek.

Between Jefcoate’s Road and Talbot’s land it is broken by
a deep rocky gully, the land on the top is cut off from the
road, suitable only for grazing purposes.
