Vesting a Reserve in the Mount Somers Road Board.

ORDER IN COUNCIL.

At the Government House, at Wellington, this ninth day
of October, 1883.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto
was reserved for a gravel-pit: And whereas, in the
opinion of the Governor, it is expedient to vest the said land
in the Road Board of the Mount Somers District:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, by and with the advice and consent of the
Executive Council of the said colony, and in exercise of the
powers and authorities vested in him by the fourth section of
"The Public Reserves Act, 1881," doth hereby declare that,
from and after the day of the date hereof, the said reserve
shall become vested in the Road Board of the Mount Somers
District, in trust, for a gravel-pit.

SCHEDULE.

ALL that parcel of land in the Provincial District of Can-
terbury, containing by admeasurement 1 acre, more or less,
being Section No. 2737 (in red), situate in the Spaxton Sur-
vey District. Bounded towards the north by a road-line, 261
links; towards the east by a road-line, 497 links; towards
the west by a line bearing 181Β° 18', 372 links; and towards
the south by a line at right angles to western boundary, 230
links: be all the aforesaid linkages more or less; as the
same is delineated on the plan deposited in the District
Survey Office, Christchurch.

ORDER IN COUNCIL.

At the Government House, at Wellington, this ninth day
of October, 1883.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN exercise and pursuance of the powers and authorities
vested in him by "The Public Domains Act, 1881," His
Excellency the Governor of the Colony of New Zea-
land, by and with the advice and consent of the Execu-
tive Council thereof, doth hereby revoke a certain Order
in Council, dated the twenty-ninth day of January, one thou-
sand eight hundred and eighty-five, making delegation of
certain powers in manner as therein appears; and doth,
with the like advice and consent, by this present order,
delegate, but only with respect to the piece or parcel of
land described in the Schedule hereto, all the powers con-
ferred by the Act aforesaid, except the powers under or
conferred by sections five and twelve thereof, to the under-
mentioned persons, who shall be known as the Oxford
Public Domain Board, namely,--

JOSEPH PEARSON, Senior,
JOHN R. GORTON,
GEORGE PLASKETT,
JOHN INGRAM, and
ALBERT POLLARD PRICHARD

(herein referred to as "the Board"), subject to the stipula-
tions hereinafter contained, that is to say,--

  1. The Board shall meet for the transaction of business
    on the first Monday in each month, at half-past seven o'clock
    p.m., at the office of the Oxford Road Board, or at such other
    time or place as may from time to time be fixed by the
    Board. The first meeting shall be held on Monday, the
    fifth day of November, one thousand eight hundred and
    eighty-eight.

  2. Special meetings may be convened by the Chairman or
    by any two members of the Board, provided that two days'
    notice of such meeting be given to each member, specifying
    the business to be transacted at such special meeting, and
    no other business than that so specified shall be transacted
    at such meeting.

  3. Any three of the said Board shall form a quorum. Any
    meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting,
    and thereafter at an annual meeting to be held on the first
    Monday in February in every succeeding year thereafter,
    elect one of themselves to be Chairman, who may join in the
    discussion, and shall have an original as well as a casting
    vote. The Chairman shall hold office until the election of
    his successor.

  5. If at any meeting the Chairman is not present at the
    time appointed for holding the same, the members present
    shall choose some one of their number to be Chairman of
    such meeting.

  6. If, by resignation, death, or incapacity, or otherwise,
    the office of Chairman shall be or become vacant, the mem-
    bers may at any monthly or special meeting appoint a
    Chairman.

  7. All questions shall be determined by the majority of
    votes of the members of the Board present at a meeting.

SCHEDULE.

ALL that area in the Provincial District of Canterbury, con-
taining by admeasurement 216 acres, more or less, being
Section No. 1651 (in red). Bounded towards the west by
Section No. 25509 for a distance of 48 chains 64 links;
towards the south by the Eyre Road South for a distance of
34 chains 88 links; and towards the east by Section No.
24130, and also by a line in continuation of its western
boundary, a distance altogether of 51 chains 55 links: as the
same is delineated on the official map in the Provincial Dis-
trict Survey Office, Christchurch.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

dated the second day of October, one thousand eight hun-
dred and eighty-three, making delegation of certain powers in
manner as therein appears; and doth, with the like advice
and consent, by this present order, delegate, but only with
respect to the pieces or parcels of land described in the
Schedule hereto, all the powers conferred by the Act afore-
said, except the powers under or conferred by sections five
and twelve thereof, to the under-mentioned persons, who
shall be known as the Christchurch Domains Board,
namely,--

Leonard Harper,
Sir John Hall,
The Hon. William Rolleston,
John Holland Baker,
Richard James Strachan Harman,
Hugh Percy Murray-Aynsley,
Charles Christopher Bowen,
The Mayor of the Borough of Christchurch, and
The Chairman of the Selwyn County Council,

subject to the stipulations hereinafter contained,--

  1. The Board shall meet at such times and places as shall
    be from time to time appointed by the Chairman, or when it
    shall be convened by him; and the business shall be con-
    ducted under such regulations as shall be determined on
    by the Board.

  2. The Board shall keep proper minutes and records of all
    its proceedings, and full accounts of its receipts and expendi-
    ture; and a yearly statement of the same, together with a
    general report of its proceedings, shall be forwarded to the
    Governor once in every year.

  3. This delegation of powers to the Board shall not in any
    way affect any lease or contract now validly in force in
    respect of any portion of the lands named in the Schedule
    hereto, nor any agreement in respect of the dedication of
    any portion of the said lands to any purpose of public
    recreation or amusement.

  4. None of the powers delegated shall be exercised in
    respect of the ground occupied by the building known as the
    Canterbury Museum, or by any building pertaining thereto
    which has been or may hereafter be erected in connection
    therewith, or to such enclosures in connection therewith as
    may be approved by the Board and the Governor.
    The Trustees of the said Museum, and their officers and
    servants, shall at all times have the right of ingress and
    egress to and from the said Museum, at such times as shall
    be determined by the said Trustees.
