ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of September, 1888.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by an Order in Council dated the thirtieth day of September, one thousand eight hundred and eighty-six, His Excellency the Governor of the Colony of New Zealand did, in exercise and pursuance of the powers vested in him by "The Government Life Insurance Act, 1886," and "The Government Insurance and Annuities Act, 1874" (hereinafter referred to as "the said Acts"), order and direct that the several tables set forth in the Second Schedule to an Order in Council dated the eighth day of April, one thousand eight hundred and eighty-five, should be the tables to be used for the purposes of the said Acts until other provision should be lawfully made in that behalf:

And whereas it is expedient to revoke the said Order in Council of the thirtieth day of September aforesaid in so far as it directs the use of the several tables aforesaid, and to make other provision in that behalf:

And whereas the Government Insurance Commissioner has, since the making of the Order in Council of the thirtieth day of September, one thousand eight hundred and eighty-six, entered into certain contracts of assurance upon the basis of the tables set forth in the Schedule hereto, upon the assumption that such tables were in force by virtue of the said last-mentioned Order in Council, and it appears expedient to validate such contracts in manner hereinafter appearing:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in him by the said Acts, and by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the said recited Order in Council of the thirtieth day of September aforesaid in so far as it directs the use of the several tables contained in the said recited Order in Council of the eighth day of April aforesaid, and in lieu thereof doth hereby order and direct that the several tables to be henceforth used for the purposes of the said Acts shall be those set forth in the Schedule hereto. And in exercise of the like powers and authorities, and with the like advice and consent, His Excellency the Governor doth hereby order and direct that no contract of assurance entered into by the Government Insurance Commissioner for the time being since the thirtieth day of September, one thousand eight hundred and eighty-six, shall be invalid or be liable to be set aside by reason only that such contract was made as aforesaid upon the basis of the tables set forth in the Schedule hereto; and it is hereby further ordered that this Order in Council shall come into force and take effect as from the date of the publication hereof in the New Zealand Gazette.
