As the said roads are more particularly delineated on the plan marked P.W.D. 15618, deposited in the office of the Minister for Public Works, at Wellington, in the Provincial District of Wellington.
Given under the hand of His Excellency Sir William Francis Drummond Jervois, Lieutenant-General in Her Majesty’s Army, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Companion of the Most Honourable Order of the Bath, Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at the Government House, at Wellington, this fourteenth day of July, in the year of our Lord one thousand eight hundred and eighty-eight.

Terms and Conditions of Sale of the Tapanui Village-settlement Small-farm Lots, Otago Land District.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fourteenth day of July, 1888.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by the one hundred and sixty-seventh section of “The Land Act, 1885,” it is enacted that the Governor in Council may fix the terms and conditions upon which the lands comprised in any village settlement shall be disposed of, and the mode of payment for the same:
And whereas His Excellency the Governor of the Colony of New Zealand has, by Proclamation of even date herewith, set apart the land enumerated in the Schedule hereto for sale as village-settlement small-farm lots:
Now, therefore, His Excellency the Governor of the said colony, in exercise and pursuance of the powers and authorities conferred upon him by the hereinbefore in part recited Act, and by and with the advice of the Executive Council of the said colony, doth hereby fix the following terms and conditions upon which the said village-settlement small-farm lots shall be disposed of, and the mode of payment for the same, that is to say,—

The land enumerated in the Schedule to the Proclamation aforesaid shall be disposed of as village-settlement small-farm allotments upon deferred payments.

The day upon which the land shall be open for application shall be Wednesday, the twenty-second day of August, one thousand eight hundred and eighty-eight, at the Land Office, Dunedin.

The land enumerated in the Schedule to the Proclamation aforesaid shall be sold on deferred payments, at the price stated in the said Schedule, and shall be subject to the provisions relating to suburban lands of Part III. of “The Land Act, 1885.”

No person shall be allowed to acquire more than one section.

If there should be more than one application for any small-farm allotment in the said Schedule the right to occupy the same shall be determined by lot amongst the applicants.

Each applicant for a deferred-payment section will be required to make the declaration prescribed by section one hundred and thirteen of “The Land Act, 1885,” and shall at the time of application deposit with the Receiver of Land Revenue for the Otago Land District one-tenth of the price of the allotment. Such payment shall be deemed to be a discharge of the license-fee for the six months due on the first day of January, one thousand eight hundred and eighty-nine.

The purchaser of the land described in the said Schedule, upon the full payment of the purchase-money, and also the fulfilment of the terms and conditions prescribed by “The Land Act, 1885,” relating to land on deferred payments, will be entitled to his Crown grant, to be issued in the usual way upon payment of the fees prescribed by law.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1882,” and of all other powers in anywise enabling him in this behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the road in the County of Raglan, described in the Schedule below, shall, on and after the date above mentioned, become a county road.
