Validating Election of Chairman of Waitara Harbour Board.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-second day of May, 1888.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS it is provided by the two hundred and thirty-third section of “The Harbours Act, 1878” (hereinafter termed “the said Act”), that in any case in which, by any misadventure or accident, anything is at any time done after the time required by the said Act, or is otherwise irregularly done in matter of form, the Governor may, by Order in Council duly gazetted from time to time, make provision for any such case, or may extend the time within which anything is required to be done, or may validate anything so done after the time required or so irregularly done in matter of form, so that the true intent and purpose of the said Act may have effect: And whereas on Monday, the twelfth day of March, one thousand eight hundred and eighty-eight, the Waitara Harbour Board elected Thomas Bayly to be Chairman of the Board for the ensuing year: And whereas such election should have been held on Tuesday, the thirty-first day of January, one thousand eight hundred and eighty-eight, that being the date on which, in pursuance of the provisions of section fifty-two of the said Act, the said election should have been held: And whereas it is expedient to validate the said election:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers conferred upon him by the said Act, doth hereby validate the said election, and doth declare that Thomas Bayly, the person elected on the said twelfth day of March, one thousand eight hundred and eighty-eight, by the Waitara Harbour Board to be Chairman of the Board, shall continue to hold office as Chairman of the Waitara Harbour Board in the same manner as if the irregularities hereinbefore mentioned in connection with such election had not taken place.

Extending Close Season for Seals.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by “The Fisheries Conservation Act, 1884” (hereinafter termed “the said Act”), it is, among other things, enacted that the Governor in Council may, from time to time, make, alter, and revoke regulations for the purposes therein mentioned, which said regulations shall have force and effect only in any waters or places specified therein: And whereas by Order in Council dated the tenth day of January, one thousand eight hundred and eighty-eight, certain regulations were made, in exercise of the powers conferred by the said Act, prescribing, among other things, a close season for seals: And whereas it is expedient to extend such close season for seals:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers conferred on him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulation:—
The close season for seals in the Colony of New Zealand, prescribed by the regulations made under the said Act by Order in Council bearing date the tenth day of January, one thousand eight hundred and eighty-eight, is hereby extended until the first day of June, one thousand eight hundred and eighty-nine.

At the Government House, at Wellington, this first day of May, 1888.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work authorised to be constructed by the Government, to wit, the Cuvier Island Lighthouse:
And whereas the said land is held or occupied by Native owners:
Now, therefore, in pursuance and exercise of the powers vested in him by “The Public Works, Act, 1882,” and the amendments thereof, and of all other powers in anywise enabling him in this behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the Government work known as the Cuvier Island Lighthouse shall and may be constructed on the parcel of land more particularly mentioned in the Schedule hereto.

IN pursuance and exercise of the powers and authorities conferred upon me by the third section of “The Land Act Amendment Act, 1887” (hereinafter termed “the said Act”), I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, having received the report of the Surveyor-General in this behalf, as in the said section is provided, do hereby declare that the rural lands enumerated in the Schedule hereto shall be open for sale or selection, after the lapse of a period of forty-five days from the date of the first public notification hereof, in the manner and upon the conditions mentioned in the said Act, and at the price per acre respectively set opposite such land in the said Schedule.

Section 40 contains fairly good soil with some valuable totara timber, which has been recently fired.
The soil on Section 41 is shingly, and carries some totara in the same condition as that on Section 40.

COOK COUNTY.
Taitai Block.—Unsurveyed.
1,097 acres; cash price, 10s. per acre.
Description of Land: It is rather broken, but has good flats along the Mangahewa River. The soil is good, and carries a growth of light scrub and heavy manuka. It is approached by a surveyed road leading to the Waiapu–Ormond Road.
