in the Provincial District of Auckland, was not held in the
month of February last, as provided by the regulations for
the annual election of Native Assessors for Native licensing
districts: And whereas it appears expedient to make pro-
vision for holding the said election:
Now, therefore, I, William Francis Drummond Jervois,
the Governor of the Colony of New Zealand, in pur-
suance and exercise of the powers vested in me by “The
Licensing Act, 1881,” and acting by and with the advice and
consent of the Executive Council of the said colony, do
hereby appoint Tuesday, the twenty-second day of May
instant, as the day, and the Courthouse, Tolago Bay, as the
place, for receiving nominations of an Assessor for the Native
Licensing District of Tolago aforesaid; and do hereby
appoint Monday, the twenty-eighth day of May instant, as
the date, and the Courthouse, Tolago Bay, aforesaid, and
the Courthouse, Awanui, as the places, for holding the elec-
tion of an Assessor for the said licensing district, should
such election be necessary.

Otago High Schools Board to be subject to the Provisions
of “The Public Bodies’ Powers Act, 1887.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
second day of May, 1888.
Present:
His Excellency the Governor in Council.
WHEREAS by section four of “The Public Bodies’
Powers Act, 1887” (hereinafter termed “the said
Act”), it is provided that the Governor may, by Order in
Council, from time to time declare that any leasing authority
shall be subject to the provisions of the said Act, but that
no such order shall have any effect unless it be issued at
the request or upon the recommendation of the leasing
authority on whose behalf such order is issued:
And whereas it has been made to appear that the Otago
Boys’ and Girls’ High Schools Board are a leasing authority
within the meaning of the said Act, and have requested
that they may be brought under the provisions thereof:
Now, therefore, His Excellency Sir William Francis
Drummond Jervois, the Governor of the Colony of New
Zealand, by and with the advice and consent of the Execu-
tive Council thereof, and in pursuance and exercise of the
powers and authorities conferred on him by the said Act,
doth hereby order and declare that, from and after the date
hereof, the Otago Boys’ and Girls’ High Schools Board shall
be subject to the provisions of “The Public Bodies’ Powers
Act, 1887.”

WHEREAS by section four of “The Public Bodies’
Powers Act, 1887” (hereinafter termed “the said
Act”), it is provided that the Governor, by Order in Council,
may from time to time declare that any leasing authority
shall be subject to the provisions of the said Act, but that

Validating and fixing Local Option Poll.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
second day of May, 1888.
Present:
His Excellency the Governor in Council.
WHEREAS by section two hundred and twenty-seven
of “The Licensing Act, 1881” (herein termed “the
said Act”), it is provided that if, through any accidental or
unavoidable impediment, misfeasance, or omission, anything
required by the said Act to be done is omitted to be done,
or is not done within the time fixed, the Governor in Council
may take all such measures as may be necessary for removing
such impediment or rectifying such misfeasance or omission,
and may validate anything which may have been irregularly
done in matter of form, so that the intent and purpose of the
Act may have effect:
And whereas in the month of April last a Licensing Com-
mittee for the Licensing District of Waipu was elected:
And whereas the said Committee elected Niel Campbell to
be its Chairman: And whereas the said Niel Campbell, as
such Chairman, appointed the fourteenth day of May instant
to be the day on which a poll should be taken within the
said district under the said Act: And whereas the election
of the said Committee for the said district has been declared
to be void, but nevertheless a poll was taken within the said
Waipu Licensing District on the said fourteenth day of May
instant, as appointed by the said Chairman: And whereas
it is expedient to validate the taking of such poll:
Now, therefore, His Excellency Sir William Francis Drum-
mond Jervois, the Governor of the Colony of New Zealand,
in pursuance and exercise of the powers and authorities
conferred by the said Act, and of all other powers enabling
him in this behalf, and by and with the advice and consent
of the Executive Council of the said colony, doth hereby
validate the taking of the said poll within the Waipu
Licensing District aforesaid.

the Acting Chairman of the Licensing Committee for the
said district, and a poll of the ratepayers was then taken in
the usual manner: And whereas it appears expedient to
validate the taking of the said poll in manner hereinafter
appearing:
Now, therefore, His Excellency Sir William Francis Drum-
mond Jervois, the Governor of the Colony of New Zealand,
in pursuance and exercise of the powers and authorities
conferred by the said Act, and of all other powers enabling
him in this behalf, and by and with the advice and consent
of the Executive Council of the said colony, doth hereby
validate the taking of the said poll on the said fifteenth
day of May instant as aforesaid; saving, however, as far as
practicable, to all persons concerned, the like rights and
remedies as would have been available had the said poll
been taken during the month of March last in the ordinary
course.
