ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fourth day of April, 1888.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the New Plymouth Harbour Board, being a leasing authority within the meaning of "The Public Bodies' Powers Act, 1887" (hereinafter termed "the said Act"), has requested that these presents should issue, and it appears expedient to make the order herein contained:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the New Plymouth Harbour Board shall, as from the date of the publication hereof in the New Zealand Gazette, be subject to the provisions of the said Act.

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the Arrowtown Borough Council shall, as from the date of the publication hereof in the New Zealand Gazette, be subject to the provisions of the said Act.

Terms and Conditions of Sale of the Mangatainoka, Hastwell, and Mauriceville East Village Settlements, Wellington Land District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fourth day of April, 1888.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the one hundred and sixty-seventh section of "The Land Act, 1885," it is enacted that the Governor in Council may fix the terms and conditions upon which the lands comprised in any village settlement shall be disposed of, and the mode of payment for the same:

And whereas His Excellency the Governor of the Colony of New Zealand has, by Proclamation, set apart the lands enumerated in the Schedule hereto for sale as village settlements:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the hereinbefore in part recited Act, and by and with the advice of the Executive Council of the Colony of New Zealand, doth hereby fix the following terms and conditions upon which the said village settlements shall be disposed of, and the mode of payment for the same, that is to say,β€”

  1. The lands enumerated in the Schedule hereto shall be disposed of as village and small-farm allotments for cash.

  2. The day upon which the lands shall be open for application shall be Wednesday, the twenty-third day of May, one thousand eight hundred and eighty-eight, at the Land Office, Wellington.

  3. No person shall be allowed to acquire more than one section.

  4. The prices stated in the Schedule hereto shall be the prices at which the lands shall be open for application.

  5. If there should be more than one application for any of the village allotments, the right to purchase the same shall be determined by auction amongst the applicants; and if there shall be more than one applicant for any of the small-farm allotments, the right to purchase the same shall be determined by lot amongst the applicants only.

  6. The purchaser of any lands described in the Schedule, upon the full payment of the purchase-money, will be entitled to his Crown grant, to be issued in the usual way upon payment of the fees prescribed by law.

  7. Each application must be accompanied by the total amount of the upset price of the allotment applied for.
