mentioned in the Schedule hereto shall be subject to the
provisions of sections one hundred and ninety-eight to two
hundred and nineteen of Part VII. of “The Land Act,
1885,” relating to small grazing runs.

1877.”—Authorising Construction of a Railway.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
seventh day of March, 1888.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the twenty-first section of “The West-
land and Nelson Coalfields Administration Act,
1877,” it is enacted that the Governor may, by Order in
Council, authorise any lessee under a lease granted for coal-
mining purposes, and his or their servants and workmen,
full and free liberty of making, and using when so made, any
railways, tramways, bridges, inclines, staiths, or other means
of transit over the lands described in the First, Second, and
Third Schedules to the said Act, and whether the same shall
be demised by any lease for coal-mining purposes or not, on
the conditions mentioned in sections twenty-two and twenty-
three of the said Act:

And whereas the Mokihinui Coal Company (Limited) is a
lessee of the Crown under a lease granted for coal-mining
purposes, and has complied with the conditions set forth in
sections twenty-two and twenty-three of the said Act, and is
desirous of constructing a railway, bridges, incline, and
staiths over the lands mentioned in the Schedule below,
which said lands form part of the lands described in the
Third Schedule to the said Act:

Now, therefore, His Excellency the Governor, in exercise
and pursuance of the above-recited power, and by and with
the consent of the Executive Council of New Zealand, doth
hereby authorise the Mokihinui Coal-mining Company
(Limited), its servants and workmen, full and free liberty of
making, and using when so made, a railway, bridges, inclines,
and staiths over the land described in the Schedule hereto:
Provided, however, that the authority hereby given shall be
concurrent with the company’s coal-mining lease from the
Queen, dated the fifth day of June, one thousand eight
hundred and eighty-five, and being for a term of forty-two
years from such last-mentioned date; and such authority
shall determine, without further notice, at the expiration of
the said forty-two years, or at such prior time as the said
lease may expire or be determined: Provided, further,
that the right is hereby reserved to the Government to
construct a road, if necessary, over any portion of the land
mentioned in the Schedule below that is not occupied by
the railway, bridges, inclines, and staiths aforesaid; and
also that the Government may permit the County Council
or the Road Board to construct a road over such land upon
the like condition.

Validating and fixing Local Option Poll.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
seventh day of March, 1888.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section two hundred and twenty-seven
of “The Licensing Act, 1881” (herein termed “the
said Act”), it is provided that, if, through any accidental or
unavoidable impediment, misfeasance, or omission, anything
required by the said Act to be done is omitted to be done,
or is not done within the time fixed, the Governor in Council
may take all such measures as may be necessary for removing
such impediment or rectifying such misfeasance or omission,
and may validate anything which may have been irregularly
done in matter of form, so that the intent and purpose of the
Act may have effect:

And whereas on the thirty-first day of January, one thou-
sand eight hundred and eighty-three, the Licensing Districts
of Westport North, Westport Central, and Westport South
were amalgamated under the name of the Westport Licensing
District: And whereas no regulations were made for the
due administration of the said Act within the amalgamated
district as required by “The Licensing Act Amendment Act,
1882,” but nevertheless a poll was taken within the said West-
port Licensing District in the month of May, one thousand
eight hundred and eighty-five: And whereas it is expedient
to validate the taking of such poll, and to make provision as
hereinafter mentioned:

Now, therefore, His Excellency Sir William Francis Drum-
mond Jervois, the Governor of the Colony of New Zealand,
in pursuance and exercise of the powers and authorities
conferred by the said Act, and of all other powers enabling
him in this behalf, and by and with the advice and consent
of the Executive Council of the said colony, doth hereby
validate the taking of the said poll within the Westport
Licensing District aforesaid; and, in exercise of the like
powers and authorities and with the like advice and consent
as aforesaid, His Excellency doth hereby further order and
declare that the next poll of the ratepayers of the said West-
port Licensing District to be taken under the provisions of
section forty-six of the said Act shall take place on the
fourteenth day of the month of April next.
