Validating By-laws of the Borough of Gisborne.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of November, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Gisborne Borough Council, by special order made on the twentieth day of September, one thousand eight hundred and eighty-seven, repealed the then existing by-laws in force in the said borough as from the thirty-first day of October: And whereas by a further special order, dated the twentieth day of September aforesaid, the said Council made new by-laws, to come into force in the said borough on the first day of November instant, but the provisions of section one hundred and twenty-one of “The Municipal Corporations Act, 1886,” were not strictly complied with so far as regards such last-mentioned order, inasmuch as the subsequent meeting called to confirm the original resolution was advertised to be held sooner than by the said recited section is provided: And whereas the said original resolution was subsequently confirmed by the said Council, and it appears expedient to validate such last-mentioned special order in manner hereinafter set forth:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise of the powers conferred upon him by “The Municipal Corporations Act, 1886,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the said special order of the twentieth day of September, one thousand eight hundred and eighty-seven, shall be and be deemed to be good, valid, and effectual, notwithstanding the irregularity hereinbefore specified, or anything otherwise irregularly done in matter of form relative to such order, and that no by-law made thereunder shall be deemed to be ultra vires or be liable to be called in question by reason only of the irregularity aforesaid.

Abolishing all Petty Sessions Districts.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of November, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Petty Sessions Act, 1865” (hereinafter termed “the said Act”), it is enacted that the Governor, from time to time, by Order in Council (whereof notice shall be published in the New Zealand Gazette), may constitute and define districts within and for which Courts of Petty Sessions respectively shall be held, and such districts, or any of them, may from time to time in manner aforesaid abolish, and the boundaries thereof may define or alter:

And whereas by Orders in Council, bearing various dates, districts have been defined to be districts within and for which Courts of Petty Sessions should be held for the purposes of the said Act, and some of such districts have not been abolished:

And whereas it is expedient to abolish the said districts:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, Governor of the Colony of New Zealand, in pursuance and exercise of the power in this behalf vested in him by the said Act, doth hereby, with the advice and consent of the Executive Council of the said colony, abolish, as from the date of the publication hereof in the New Zealand Gazette, all districts constituted and now existing under or by virtue of the said Act for which Courts of Petty Sessions have heretofore been held.

Amending Order in Council as to the Carriage of Parcels.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of November, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section four of “The Post Office Act 1881 Amendment Act, 1886” (hereinafter termed the “said Act”), it is provided, inter alia, that the Governor in Council may from time to time fix and prescribe what sum or sums of money shall be paid in respect of the carriage of parcels under the said Act, and that such sum or sums may be so fixed generally or in respect of any particular service: And whereas by Order in Council made under the above recited provision, and dated the fifth day of October, one thousand eight hundred and eighty-seven, certain general rates of payments were fixed and prescribed for the carriage of parcels under the said Act, and it is expedient to amend the said Order in Council in manner hereinafter set forth:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and of all other powers and authorities enabling him in this behalf, doth hereby revoke the second proviso to the first clause of the rates of payments so fixed and prescribed by Order in Council as aforesaid, and doth hereby order and declare that the following proviso to the said clause shall be read in lieu of such second proviso, namely: “Provided, further, that any mail contractor, company, or person who is receiving payments under any contract for the carriage of mails between a post office and any wharf or railway-station shall be entitled to receive one-quarter only of the foregoing rates in addition to the sums payable under any such contract, unless the Postmaster-General shall in writing otherwise direct.

Native Land proposed to be taken for Portion of the Thames to Hikutaia Section of the Waikato-Thames Railway.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of September, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work authorised to be constructed by the Government, to wit, the Thames-Hikutaia Section of the Waikato-Thames Railway:

And whereas the said land is held or occupied by Native owners:

Now, therefore, in pursuance and in exercise of the powers vested in him by “The Public Works Act, 1882,” and the amendments thereof, and of all other powers in anywise enabling him in this behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the Government work known as the Thames-Hikutaia Section of the Waikato-Thames Railway shall and may be constructed on or through the parcels of land more particularly mentioned in the Schedule hereto.

SCHEDULE.

ALL that piece or parcel of land containing by admeasurement 3 acres 3 roods 16 perches, being portion of Native land, commencing at the southernmost corner of Tawhitirahi No. 1, 1333. Bounded North-westerly by a line, 266 links; North-easterly by a road, 1356 links; South-easterly by a line, 312 links; South-westerly by high-water mark and by lines to commencing-point, 377 and 988 links respectively.

All those pieces or parcels of land containing by admeasurement 15 acres 2 roods 11 perches, being portions of Native land east of Kopu Block, commencing at the point of intersection of the eastern boundary of Kopu Block with the north-west boundary of Kopu Road. Bounded Westerly by a line, 70 links; North-easterly by a line, 68 links; South-easterly by Kopu Road to commencing-point, 40 links.

Also all that other piece or parcel of land commencing at the north-west corner of Mimiakaiarau Block, 4363. Bounded North-westerly by a road, 1096 links; Westerly and South-westerly by lines, 297, 408, and 849 links respectively; South-easterly by a line, 143 links; South-westerly by a line, 1389 links; South-easterly by a line, 101 links; North-easterly by a line, 1406 links; South-easterly by lines, 157 and 520 links respectively; North-easterly by lines to commencing-point, 308 and 854 links respectively.

Be all the above areas and linkages either more or less; the several parcels of land being situate in the Provincial District of Auckland, Colony of New Zealand; and are more particularly delineated upon the plan marked P.W.D. 8330, deposited in the office of the Minister for Public Works, at Wellington, in the Provincial District of Wellington, and thereon coloured red.
