Extending Time for the Return of the Writ for the Hokitika District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighteenth day of October, 1887.

Present:

His Excellency the Governor in Council.

WHEREAS in pursuance of the provisions of “The Regulation of Elections Act, 1881,” the Clerk of the Writs caused to be issued to the Returning Officer for the Electoral District of Hokitika a writ directing him to proceed according to law to the election of a member to serve in the House of Representatives for the said district: And whereas such writ should have been returned to the Clerk of the Writs on or before the fifth day of October, one thousand eight hundred and eighty-seven: And whereas owing to unavoidable delay in obtaining the voting-papers from the polling-booths at Arawata, Oakura, Bruce Bay, Gillespie’s Beach, Okarito, Mapourika, and Wateroa, in the said district, the said Returning Officer was unable to return the said writ within the time aforesaid, and the same has not yet been returned: And whereas by the seventy-sixth section of the said “Regulation of Elections Act, 1881,” it is, inter alia, enacted that, within twenty-one days after the day appointed for doing any act, matter, or thing by that Act required to be done on or before a day certain, it shall be lawful for the Governor in Council to extend the time allowed for doing any such act, matter, or thing: And whereas, therefore, it is desirable, in pursuance of the above-recited power, to extend the time for the return of the said writ as hereinafter appears:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby, in pursuance of the powers and authorities conferred upon him by the above-recited section, and of all other powers and authorities in anywise enabling him in that behalf, order and declare that the time within which the said writ above mentioned, with the name of the person so elected indorsed thereon, may be returned by the said Returning Officer to the Clerk of the Writs, shall be on or before the fifteenth day of October, one thousand eight hundred and eighty-seven, in lieu of the fifth day of October, one thousand eight hundred and eighty-seven, as specified in the said writ.

Altering Date of Election of Councillors in certain Counties.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of October, 1887.

Present:

His Excellency the Governor in Council.

WHEREAS by section eighty-eight of “The Counties Act, 1886” (hereinafter termed “the said Act”), it is provided that the general election of members of the various County Councils throughout the colony shall be held on the second Wednesday in November, which this year will fall on the ninth of that month: And whereas the ninth of November in each year is generally observed as a public holiday in honour of the birthday of His Royal Highness the Prince of Wales, and it appears desirable to postpone the time for holding the said general election this year to the following Wednesday, namely, the sixteenth day of November, as hereinafter set forth: Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise of the powers and authorities vested in him by section three hundred and twenty-two of the said Act, and of all other powers in anywise enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby extend the time for holding the general election of Councillors for all counties constituted under the said Act throughout the colony (excepting those counties specified in the Schedule hereto), and doth hereby order and declare that, with the exceptions aforesaid, the said general election shall be held and take place on Wednesday, the sixteenth day of November next ensuing, in lieu of Wednesday, the ninth day of November proximo.

Mongonui, Whangaroa, Hobson, Rodney, Wairoa, Hawke’s Bay, Mackenzie, and Rotorua.

Vesting Reserves in the Geraldine Road Board.

At the Government House, at Wellington, this eighteenth day of October, 1887.

His Excellency the Governor in Council.

WHEREAS the lands mentioned in the Schedule hereto were reserved for gravel-pits and a quarry: And whereas, in the opinion of the Governor, it is expedient to vest the said lands in the Road Board of the Geraldine District:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the said reserves shall become vested in the Road Board of the Geraldine District, in trust, for gravel-pits and a quarry.

Native Land proposed to be taken for Portion of the Thames to Hikutaiā Section of the Waikato-Thames Railway.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of September, 1887.

Present:

His Excellency the Governor in Council.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work authorised to be constructed by the Government, to wit, the Thames-Hikutaiā Section of the Waikato-Thames Railway:

And whereas the said land is held or occupied by Native owners:

Now, therefore, in pursuance and in exercise of the powers vested in him by “The Public Works Act, 1882,” and the amendments thereof, and of all other powers in anywise enabling him in this behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the Government work known as the Thames-Hikutaiā Section of the Waikato-Thames Railway shall and may be constructed on or through the parcels of land more particularly mentioned in the Schedule hereto.

SCHEDULE.

ALL that piece or parcel of land containing by admeasurement 3 acres 3 roods 16 perches, being portion of Native land, commencing at the southernmost corner of Tawhitirahi No. 1, 1333. Bounded North-westerly by a line, 266 links; North-easterly by a road, 1356 links; South-easterly by a line, 312 links; South-westerly by high-water mark and by lines to commencing-point, 377 and 988 links respectively.

All those pieces or parcels of land containing by admeasurement 15 acres 2 roods 11 perches, being portions of Native land east of Kopu Block, commencing at the point of intersection of the eastern boundary of Kopu Block with the north-west boundary of Kopu Road. Bounded Westerly by a line, 70 links; North-easterly by a line, 68 links; South-easterly by Kopu Road to commencing-point, 40 links.
