Regulations for Trout-fishing, Nelson District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighteenth day of October, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance of the powers and authorities vested in him by “The Fisheries Conservation Act, 1884,” His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations for the Provincial District of Nelson and the waters thereof; and doth hereby declare that these regulations shall, as from the date of the publication thereof in the New Zealand Gazette, supersede all regulations at variance therewith.

REGULATIONS.

  1. ANY holder of a license as hereinafter mentioned may fish for trout with rod and line, and may use a landing-net to secure any trout caught with such rod and line, in each river or stream in the Provincial District of Nelson which flows into Blind Bay, from the first day of October, one thousand eight hundred and eighty-seven, to the thirty-first day of March, one thousand eight-hundred and eighty-eight, both inclusive. Such licenses will be issued under the hand of the Honorary Secretary of the Nelson Acclimatisation Society, and for every such license a fee of ten shillings will be charged.

  2. The Secretary of the said society may issue day licenses to bonâ fide travellers and strangers not resident within the district aforesaid, on payment of a fee of two shillings and sixpence for each day’s fishing.

  3. Any holder of a license may fish with one rod and line for trout, and may use a landing-net to secure any trout caught with such rod and line, in the above-named rivers, from the first day of October, one thousand eight hundred and eighty-seven, to the thirty-first day of March, one thousand eight hundred and eighty-eight, both inclusive.

  4. No license shall authorise any person other than the person named therein to fish.

  5. Any person fishing either without a license, or who shall, on demand of any person holding and showing a license, or on demand of any ranger, police officer, or constable, fail to produce and show to such person, ranger, police officer, or constable his license, or the contents of his creel, basket, or bag, shall be liable to a penalty of not less than twenty shillings and not exceeding twenty pounds.

  6. No cross-line fishing, stroke-hauling, or any other unsportsmanlike device shall be used for the purpose of taking, catching, or killing trout.

  7. All trout not exceeding seven inches in length taken by any person shall be immediately returned alive to the water; and any person convicted of infringing this regulation shall be liable to a penalty of not less than twenty shillings and not exceeding twenty pounds.

  8. Except as aforesaid, no person shall fish or use any net or other engine, instrument, or device for taking fish in any river or stream within the district aforesaid, or at the mouth or entrance of any such river or stream; and all persons offending against this regulation shall be liable to a penalty of not less than forty shillings and not exceeding fifty pounds.

  9. For the purposes of these regulations the mouth of every such river or stream shall be deemed to include every outlet of the same and the sea-shore between such outlets, and shall extend over a radius of one-quarter of a mile from the point or line where the waters of such river or stream meet those of the sea or of any harbour at low-water.

  10. Any person who puts, throws, or places, or allows to be put, thrown, or placed, into any river or stream in the said district, or at the mouth or entrance of any such river or stream, any dynamite or other explosive substance, or any matter or liquid deleterious to fish, shall be liable to a penalty of not less than forty shillings and not exceeding fifty pounds.

  11. If any person shall be convicted of any offence against these regulations the license, if any, held by the offender shall thereupon become void.

  12. These regulations shall come into force as from the date of the publication thereof in the New Zealand Gazette.

Extending Time for the Return of the Writs for the Marsden and Buller Districts.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighteenth day of October, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS in pursuance of the provisions of “The Regulation of Elections Act, 1881,” the Clerk of the Electoral Districts of Marsden and Buller writs directing them to proceed according to law to the election of a member to serve in the House of Representatives for each of the said districts: And whereas such writs should have been returned to the Clerk of the Writs on or before the fifth day of October, one thousand eight hundred and eighty-seven, being the day fixed in the said writs for the return of the same: And whereas the Returning Officers for the said Marsden and Buller Districts, upon the declaration of the result of the polling in their respective districts, duly indorsed on the writs the names of the persons elected, and posted the said writs to the Clerk of the Writs at Wellington; but, owing to unavoidable delays in transmission, the writs were not received by the Clerk of the Writs until after the day fixed for the return thereof as hereinbefore mentioned: And whereas by the seventy-sixth section of the said “Regulation of Elections Act, 1881,” it is, inter alia, enacted that, within twenty-one days after the day appointed for doing any act, matter, or thing by that Act required to be done on or before a day certain, it shall be lawful for the Governor in Council to extend the time allowed for doing any such act, matter, or thing: And whereas, therefore, it is desirable, in pursuance of the above-recited power, to extend the time for the return of the said writs as hereinafter appears:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby, in pursuance of the powers and authorities conferred upon him by the above-recited section, and of all other powers and authorities in anywise enabling him in that behalf, order and declare that the time within which the said writs above mentioned, with the names of the persons so elected indorsed thereon, may be returned by the said Returning Officers to the Clerk of the Writs, shall be on or before the eighth day of October, one thousand eight hundred and eighty-seven, in lieu of the fifth day of October, one thousand eight hundred and eighty-seven, as specified in the said writs.

Time for Elections, Borough of Patea, extended.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighteenth day of October, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Municipal Corporations Act, 1886” (hereinafter termed “the said Act”), it is, among other things, provided that, in any case in which, by any misadventure or accident, anything is at any time not done at the time required by the said Act, the Governor may, by Order in Council gazetted and publicly notified, from time to time make provision for any such case, or may extend the time within which anything is required to be done, so that the true intent and purpose of the said Act may have effect: And whereas the Town Clerk of the Borough of Patea, through negligence, did not take the necessary steps for holding an election of three Councillors for the said borough on the second Thursday of September last past as required by the said Act; and it appears expedient to make provision for such case, and to extend the time within which the said election may be held:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities vested in him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the time for election of Councillors for the said Borough of Patea shall be and the same is hereby extended until the third Thursday in November, one thousand eight hundred and eighty-seven.
