Fixing Rates of Payment for Carriage of Parcels.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fifth day of October, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section four of “The Post Office Act 1881 Amendment Act, 1886” (hereinafter termed “the said Act”), it is enacted, for the purpose of giving effect to the said Act, that the Postmaster-General may from time to time, with or without any such contract as is mentioned in the said section, require the master of any vessel to convey any parcel from any place in New Zealand to any other part thereof in like manner as he may now be required to carry mails; and in like manner may require any person who has entered into a contract with the Postmaster-General for the carriage of mails to carry parcels under the said Act; and in either of such cases the Governor in Council may from time to time fix and prescribe what sum or sums of money shall be paid in respect of such service, and such sum or sums may be so fixed generally or in respect of any particular service: And whereas it is expedient to fix and prescribe the several rates of payment for carriage of parcels hereinafter set forth:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers conferred upon him by the said Act, and of all other powers and authorities enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby fix and prescribe the following general rates of payment in respect of the carriage of parcels to and from places within the Colony of New Zealand, namely:—

To the proprietors or lessees of any railway, or of any tramway constructed under the provisions of “The Tramways Act, 1872,” and to any railway authority, steamboat owner, and mail contractor, on parcels exceeding one pound in weight, one uniform rate of one halfpenny per pound on the net weight of the parcels carried:

Provided that, in all cases where Government and private railway trains run jointly over the same railway line or section of railway line, the above payment of one halfpenny per pound shall only be chargeable or payable in respect of the complete carriage of parcels through from the place of despatch to destination:

Provided, further, that no mail contractor, company, or person who is receiving payment under any contract for the carriage of mails between a post office and any wharf or railway station shall be entitled to receive the foregoing rates in addition to the sums payable under any such contract unless the Postmaster-General shall in writing specially so direct.

Payments to be made at such times (not being later than three months from the date of service) as the Postmaster-General may decide upon.

Parcel mails to be cared for, handled, and delivered in the same manner in all respects as ordinary mails.

A second payment for any conveyance after the first is not to be made for carriage by any steamer owned by the same company or proprietors by whom the first conveyance was made.

And in exercise of the like powers, and with the like advice and consent as aforesaid, His Excellency doth hereby declare that this Order in Council shall take effect as from the first day of October, one thousand eight hundred and eighty-seven.

Terms and Conditions of Sale of Small-farm Allotments in the Woodville Survey District, Hawke’s Bay Land District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fifth day of October, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the one hundred and sixty-seventh section of “The Land Act, 1885,” it is enacted that the Governor in Council may fix the terms and conditions upon which the lands comprised in any village settlement shall be disposed of, and the mode of payment for the same:

And whereas His Excellency the Governor of the Colony of New Zealand has, by Proclamation, set apart the lands enumerated in the Schedule hereto for sale as a village settlement:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the hereinbefore in part recited Act, and by and with the advice of the Executive Council of the Colony of New Zealand, doth hereby fix the following terms and conditions upon which the said village settlement shall be disposed of, and the mode of payment for the same, that is to say,—

  1. The lands enumerated in the Schedule hereto shall be disposed of as small-farm allotments upon deferred payments.

  2. The day upon which the lands shall be open for application shall be Tuesday, the fifteenth day of November, one thousand eight hundred and eighty-seven, at the Land Office, Napier.

  3. The lands will be disposed of by sale upon deferred payments, and shall be subject to the provisions relating to suburban lands of Part III. of “The Land Act, 1885.”

  4. No person shall be allowed to acquire more than one section.

  5. The prices stated in the Schedule hereto shall be the prices at which the lands shall be open for application.

  6. If there should be more than one application for any allotment, the right to occupy the same shall be determined by lot amongst the applicants.

  7. Each applicant for a section in the Schedule will be required to make the declaration prescribed by section one hundred and thirteen of “The Land Act, 1885,” and shall at the time of application deposit with the Receiver of Land Revenue for the Hawke’s Bay Land District one-tenth of the price of the allotment. Such payment shall be deemed to be a discharge of the license-fee for the six months due on the first day of January, one thousand eight hundred and eighty-eight.

  8. The purchaser of any lands described in the Schedule, upon the full payment of the purchase-money, and also the fulfilment of the terms and conditions prescribed by “The Land Act, 1885,” relating to land on deferred payments, will be entitled to his Crown grant, to be issued in the usual way upon payment of the fees prescribed by law.
