ORDER IN COUNCIL.

At the Government House, at Wellington, this ninth day of August, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work authorised to be constructed by the Government, to wit, the Wellington-Napier Railway :

And whereas the said land is held or occupied by Native owners :

Now, therefore, in pursuance and exercise of the powers vested in him by “The Public Works, Act, 1882,” and the amendments thereof, and of all other powers in anywise enabling him in this behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the Government work known as the Wellington-Napier Railway shall and may be constructed on or through the parcels of land more particularly mentioned in the Schedule hereto.

THE several parcels of land mentioned in list hereunder:—

All in the Provincial District of Wellington; as the said parcels of land are more particularly delineated on the plan marked P.W.D. 14839, deposited in the office of the Minister for Public Works at Wellington, in the Provincial District of Wellington, and thereon coloured green.

WHEREAS by the two hundred and twenty-seventh section of “The Land Act, 1885,” it is enacted that the Governor may from time to time, either by general or particular description, and whether the same has been surveyed or not, reserve from sale temporarily, notwithstanding that the same may be then held under pastoral license, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned :

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in me by the said Act, do hereby temporarily reserve from sale the land in the Land Districts of Auckland, Nelson, Canterbury, Otago, and Southland, described in the Schedule hereunder written, for the purposes in the said Schedule specified.

SCHEDULE.

AUCKLAND.

ALL that piece or parcel of land in the Provincial District of Auckland, containing by admeasurement 5 acres, more or less, being Lot No. 167A of Section No. 2 of the Parish of Pukekohe. Bounded on the North-west by a road, 771 links; on the North-east by a road, 624 links; on the South-east by Lot No. 167 of Section No. 2, 849 links; and on the South-west by Lot No. 168 of Section No. 2 aforesaid, 617 links: be all the aforesaid linkages a little more or less. For a school site.

All that piece or parcel of land containing by admeasurement 2 acres 2 roods, more or less, situate in the Town of Alexandra East, in the Provincial District of Auckland, being Section No. 524A of the said town. Bounded towards the North by Section No. 524, 500 links; towards the East by Franklin Street, 500 links; towards the South by Crozier Street, 500 links; and towards the West by Section No. 524 aforesaid, 500 links: be all the aforesaid measurements a little more or less. For police purposes.

All that piece or parcel of land containing by admeasurement 3 roods 23 perches, more or less, situate in the Town of Ngaruawahia, in the Provincial District of Auckland, being Sections Nos. 83, 84, 85, 86, and 87 of the said town. Bounded towards the North-east by the Esplanade, 39 and 323 links; towards the South-east and South-west by Jesmond Street, 30, 432, and 50 links; and towards the North by Princes Street, 360 links: be all the aforesaid measurements a little more or less. For police purposes.

All that piece or parcel of land containing by admeasurement 2 acres 2 roods 5 perches, more or less, situate in the Town of Raglan, in the Provincial District of Auckland, being Allotment No. 2 of Section No. 19 of the Town of Raglan aforesaid. Bounded towards the North-east, East, and South by high-water mark of the Whaingaroa Harbour; towards the West by Main Street, 645 links; towards the North and again towards the West by Allotment No. 1 of Section No. 19 aforesaid, 204·6 and 250 links; and towards the North by Kaitoke Street, 75 links: be all the aforesaid measurements a little more or less. For police purposes.

NELSON.

All that piece or parcel of land in the Borough of Nelson, containing by admeasurement 3 roods 5 perches. Bounded on the North, 230 links, by the Eel Pond Reserve; on the East partly by the Eel Pond and partly by Section No. 204, 221 links; on the South, 230 links, by Hardy Street; and on the West, 346 links, by other part of Section No. 202, and by the Eel Pond: as the same is delineated and more particularly described on the plan in the District Survey Office, Nelson. For a recreation-ground.

CANTERBURY.

All that piece or parcel of land in the Provincial District of Canterbury, containing by admeasurement 6 acres 3 roods 9 perches, more or less, being Section No. 2767 (in red), situate in the Waitaki Survey District. Bounded towards the North-east by Lot No. 92 of the subdivision of Reserves Nos. 642 and 1644, 620 links; towards the North-west by Lot No. 97, 1067 links; towards the South-west by a road-line, 623 links; and towards the South-east by a road-line, 1126 links: be all the aforesaid linkages more or less; as the same is delineated on the plan deposited in the District Survey Office, Christchurch. For a school site.

OTAGO.

All that piece or parcel of land in the Provincial District of Otago, containing by admeasurement 5 acres, more or less, situate in the Tiger Hill District, and being Section No. 35 of Block V. of said district. Bounded towards the North-east by a road-line, 707 links; towards the South-east by Section No. 28 of same block, 707 links; towards the South-west by Section No. 29 of same block, 707 links; towards the North-west by said Section No. 29, 707 links: be all the aforesaid linkages more or less. For a gravel reserve.

All that piece or parcel of land in the Provincial District of Otago, containing by admeasurement 5 acres, more or less, situate in the Tiger Hill District, and being Section No. 36 of Block V. of said district. Bounded towards the North-east by Section No. 16 of same block, and by a road-line, 707 links; towards the South-east by Section No. 17 of Block IV. of same district, 707 links; towards the South-west by Section No. 16 of Block V. of same district, 707 links; and towards the North-west by said Section No. 16, 707 links: be all the aforesaid linkages more or less. For a gravel reserve.

All that piece or parcel of land in the Provincial District of Otago, containing by admeasurement 24 acres 2 roods 36 perches, more or less, situate in the Blackstone District, and being Section No. 53 of Block II. of said district. Bounded towards the North-west by a road-line, 2857 links; towards the East by Section No. 49 of same block, 1100 links; towards the South by said section, 2818 links; and towards the West by a road-line, 642 links: be all the aforesaid linkages more or less. For a quarry.

SOUTHLAND.

All that piece or parcel of land in the Southland Land District, containing by admeasurement 4 acres and 19 perches, more or less, being Section No. 6, Block II., Eastern Bush Township. Bounded on the North by Section No. 7 of said block, 400 links; on the East by Wairaki Street, 800 links; again on the North by Wairaki Street, 60 links; again on the East by Wairaki Street, 200 links; on the South by Southern Road, 460 links; and on the West by Section No. 5 of said block, 1000 links: be all the aforesaid linkages more or less;
