Validating certain Proceedings of Mount Peel Road Board, County of Geraldine.

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of September, 1887.

Present:

His Excellency the Governor in Council.

WHEREAS in pursuance of a ballot taken at a meeting of the Mount Peel Road Board, held on the fifteenth day of April, one thousand eight hundred and eighty-seven, George James Dennistoun and Robert Thew, two of the members of the said Board, retired therefrom: And whereas the ballot should have taken place on the first day of May, one thousand eight hundred and eighty-six, but through misadventure was not taken till the date first above mentioned, and it is expedient to validate the said ballot:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the power and authority conferred upon him by section one hundred and fifty-seven of “The Road Boards Act, 1882,” doth hereby order and declare that the ballot held on the fifteenth day of April, one thousand eight hundred and eighty-seven, for two members of the said Mount Peel Road Board to retire, shall be deemed to have been properly taken, and all proceedings consequent thereon shall

be as valid and effectual as if the irregularity hereinbefore mentioned had not taken place.

Regulations under “The Government Life Insurance Act, 1886.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of September, 1887.

Present:

His Excellency the Governor in Council.

WHEREAS by “The Government Life Insurance Act, 1886” (hereinafter referred to as “the said Act”), it is, among other things, enacted that on the commencement of the said Act all the provisions of “The Government Insurance and Annuities Act, 1874,” and of every other Act amending the same, or that would have applied to the last-mentioned Act if such Act had remained in force, shall, notwithstanding the prior express or implied repeal thereof, and except as expressly provided by the said Act, be and the same are thereby re-enacted so far as such provisions are capable of taking effect:

And whereas by the fifth section of “The Government Insurance and Annuities Act, 1874,” it is, among other things, enacted that the Governor shall have power, by Order in Council, from time to time to do the following things:—

To make rules generally for the purpose of carrying the Act into effect, and to impose penalties not exceeding twenty pounds for breach of such rules;

To make rules respecting the loan of moneys under the Act on the security of the surrender value of policies, and for the effectual recovery of principal and interest accruing on such loans:

And whereas it is expedient that certain of the holders of insurance policies issued and to be issued by the Government Insurance Commissioner should be permitted to join together to create, and continue, a Tontine Savings Fund, which will proceed from the bonuses on such of the said policies as are terminated by death, surrender, and lapse:

And whereas it is expedient that rules should be made with respect to the said Tontine Savings Fund, in manner hereinafter set forth:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in him by the said Act and “The Government Insurance and Annuities Act, 1874,” and of all other powers and authorities in this behalf vested in him, and by and with the advice and consent of the Executive Council of the said colony, doth hereby make and prescribe the rules set forth hereunder; and doth hereby declare that this present Order in Council shall take effect as from the date of the publication thereof in the New Zealand Gazette.

RULES.

  1. In these rules, and in all policies or instruments issued or made thereunder, if not inconsistent with the context,—

“Commissioner” means the Government Insurance Commissioner holding office for the time being:

“Endowment-insurance policy” means a policy the sum assured by which is payable at a certain date, or upon the death of the person whose life is insured if it happen before such date:

“Life-insurance policy” means a policy the sum assured by which is payable upon the death of the person whose life is insured whenever that event may occur, or upon his death if it happen within a specified term:

“Policy” means an instrument in writing, or partly in writing and partly printed, containing any contract whatever upon the contingencies of human life, and entered into by the Government Insurance Commissioner, according to the law and regulations at the time in force:

“Premium” means the periodical or other payment for any policy:

“Tontine Savings Fund policy” means a policy the holder of which is permitted to join the Tontine Savings Fund system:

“Tontine Class” means the whole of the policyholders who are permitted to join together to participate in the Tontine Savings Fund, as provided in these regulations:

“Tontine period” means the period extending from the date of these rules to the 31st day of December, 1900, inclusive.
