Division of the Borough of Newton into Three Wards, under “The Municipal Corporations Act, 1886.”

A PROCLAMATION.

WHEREAS by “The Municipal Corporations Act, 1886,” section twenty-seven, it is enacted that, if not less than one-fourth of the burgesses of a borough petition the Governor, praying him to divide such borough into wards, the Governor may, by Proclamation, divide such borough into not more than six wards, and shall in such Proclamation assign such names and boundaries to each ward as he thinks fit: And whereas not less than one-fourth of the burgesses of the Borough of Newton have petitioned me to divide such borough into wards:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the hereinbefore recited authority, do hereby proclaim and declare that the Borough of Newton shall be and the same is hereby divided into three wards, with the names and boundaries set forth in the Schedule hereto.

SCHEDULE.

Surrey Ward.—Bounded towards the North by the City of Auckland; towards the South-east and South-west by the south-eastern and south-western sides of the Old Great North Road to a point in line with the middle of Williamson Avenue; and thence towards the North-west by a line to and along the middle of the said Williamson Avenue.

Sussex Ward.—Bounded towards the North generally by the City of Auckland; towards the South-east by Surrey Ward, hereinbefore described, to Allotment No. 20 of Section No. 7 of the Suburbs of Auckland; and thence towards the South-west and North-west generally by Allotments Nos. 16 and 3 of Section No. 9 of the Suburbs of Auckland, and Allotments Nos. 45 and 43 of Section No. 8 of the Suburbs of Auckland.

Richmond Ward.—Bounded towards the North-east generally by Sussex Ward, hereinbefore described; towards the South-east by the south-eastern side of the Old Great North Road to a point in line with the south-western boundary-line of Allotment No. 14 of Section No. 9 of the Suburbs of Auckland; thence towards the South-west generally by a right line to the southernmost corner of the said Allotment No. 14; thence by Allotments Nos. 17 and 13 of Section No. 9 of the Suburbs of Auckland to Motion’s Creek, and by that creek to Waitemata Harbour; and thence towards the North generally by the said Waitemata Harbour, Cox’s Creek, and the City of Auckland.

Given under the hand of His Excellency Sir William Francis Drummond Jervois, Lieutenant-General in Her Majesty’s Army, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Companion of the Most Honourable Order of the Bath, Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at the Government House, at Wellington, this thirtieth day of June, in the year of our Lord one thousand eight hundred and eighty-seven.

Borough of Masterton to be subject to Provisions of “The Public Bodies’ Leaseholds Act, 1886.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of June, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section three of “The Public Bodies’ Leaseholds Act, 1886” (hereinafter termed “the said Act”), it is provided that His Excellency the Governor may, by Order in Council, from time to time declare that any leasing authority shall be subject to the provisions of the said Act, but that no such order shall be issued except at the request or on the recommendation of the leasing authority on whose behalf such order is to be issued:

And whereas it has been made to appear that the Council of the Borough of Masterton is a leasing authority within the meaning of the said Act, and has recommended to His Excellency the Governor that the Council of the said borough may be brought under the provisions of the said Act:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the powers and authorities conferred on him by the said Act, doth hereby order and declare that, from and after the date hereof, the Council of the Borough of Masterton shall be subject to the provisions of “The Public Bodies’ Leaseholds Act, 1886.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of June, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by an Order in Council dated the first day of December, one thousand eight hundred and eighty-six, the School Commissioners for the Taranaki Provincial District were declared to be subject to the provisions of “The Public Bodies’ Leaseholds Act, 1886” (hereinafter called “the said Act”): And whereas the said Commissioners have requested that the provisions of sections four, six, and eighteen of the said Act should no longer apply to the said Commissioners or to the reserves vested in them, and it appears expedient to grant the said request and to make the order hereinafter contained:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the powers and authorities conferred upon him by the said Act, doth hereby order and declare that the provisions of sections four, six, and eighteen of the said Act shall not, after the day of the publication hereof in the New Zealand Gazette, apply to the said School Commissioners, or to the reserves vested in them, and that so much of the hereinbefore recited Order in Council as is inconsistent with this present order shall from the day last aforesaid be deemed to be revoked.

Licensing the Akaroa Borough Council to use and occupy a Part of the Foreshore of Akaroa Harbour.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of June, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Harbours Act Amendment Act, 1883” (hereinafter called “the said Act”), it is, among other things, enacted that, where the foreshore has been legally vested in any Harbour Board or other local governing body, it may from time to time, subject to the provisions of the one hundred and fifty-sixth section of “The Harbours Act, 1878,” license and permit any part of the foreshore to be used or occupied, inter alia, for the erection and use of any landing-place or wharf: And whereas by the said Act it is also provided that every licensee shall, subject to the provisions of the said Act, have power to make and construct any necessary reclamation for the purpose of erecting on the foreshore comprised in his license, or upon any land below low-water mark immediately contiguous to such foreshore which shall be specified in such license, any building, structure, erection, or other works to enable him to obtain the full benefit of such license: And whereas by the said Act it is further provided that every such license shall be in writing under the seal of the Board or body granting the same, and may be for any period not exceeding fourteen years from the date thereof, and may prescribe a sum of money to be payable either at stated periods or on or before the granting thereof for the use of the foreshore so granted, and may prescribe any other terms or conditions, general or particular, to be observed or performed by the person to whom the same is granted: And whereas by the said Act it is also enacted that, in any case where there is no Harbour Board, or no Harbour Board empowered to grant any such license as aforesaid, the Governor in Council may in his discretion grant and issue a license for all or any of the purposes hereinbefore mentioned, and all the provisions of the said Act in respect of such licenses shall, mutatis mutandis, apply accordingly:
