Delegating Powers under “The Cemeteries Act, 1885,” to the Grey County Council.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-first day of December, 1886.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN exercise and pursuance of the powers vested in him by “The Cemeteries Act 1882 Amendment Act, 1885,” and of all other powers enabling him in that behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby delegate to the Grey County Council the powers conferred upon him by section six of “The Cemeteries Act, 1882,” as to the appointment and removal of Trustees for the cemetery described in the Schedule hereto; and doth declare that this Order in Council shall take effect as from the first day of January, one thousand eight hundred and eighty-seven.

SCHEDULE.

BARRYTOWN CEMETERY.

ALL that piece or parcel of land in the Provincial District of Nelson, containing by admeasurement 3 acres, more or less, starting at a point on the Beach Road distant 3208 links from the south-western corner of Section No. 6, Block III., Barrytown; thence in a westerly direction along the said road, 600 links, and having a depth of 500 links.

Regulations for the Mode of Application and Expenditure of Revenues arising from the West Coast Settlement Reserves, and for Appointment of Fees.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-first day of December, 1886.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The West Coast Settlement Reserves Act, 1881” (hereinafter termed “the said Act”), it is enacted that the Governor in Council may from time to time make, alter, and revoke regulations, inter alia, for the mode of application and expenditure of all revenues arising from the West Coast Settlement Reserves, and by any such regulations may from time to time appoint fees to be paid in respect of anything done under the said Act in relation to any such reserve: And whereas the Governor did, by Order in Council dated the eighth day of September, one thousand eight hundred and eighty-five, make regulations and appoint fees to be paid under the said Act: And whereas it is expedient to revoke the said regulations and fees, and to substitute others in lieu thereof:

Now, therefore, His Excellency the Governor, in pursuance and exercise of the power and authority conferred upon him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the hereinbefore recited Order in Council, and the scale of fees and charges made thereunder, and in lieu thereof doth hereby make the following regulations as those upon which the revenues arising from the said reserves may be applied and expended, that is to say,—

The Public Trustee may from time to time, out of the revenues of the said reserves, apply such portion as he may determine in repayment to the colonial revenue of any advances which may have been, or may hereafter be, made out of the Consolidated Fund for defraying the cost of advertising, preparing, and issuing leases prior to the leasing of the said reserves.

And by and with the like advice and consent, and in exercise of the like power and authority, His Excellency the Governor doth hereby appoint the following fees as those to be paid in respect of such of the matters following as may be done in relation to the said reserves, that is to say,—

There shall be deducted from all moneys received by the Public Trustee on account of the said reserves a commission of seven pounds ten shillings per centum on the total amount so received in any way whatsoever in the course of his management of the said reserves, which commission is to and shall include all expenses of any kind soever other than legal expenses if and when incurred, and other expenses herein otherwise provided for.

All costs and expenses of receiving and distributing rents, travelling, and other disbursements that may be required, incurred, and paid shall be borne and paid by the Public Trust Office as ordinary office expenditure.

The Public Trustee may charge a fee of ten shillings for and in respect of his consent to any assignment or other disposition of any leasehold.

Constituting Awatere Rabbit District.—Notice No. 211.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-first day of December, 1886.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS a petition from the majority of the stock-owners in that part of the colony specified in the Schedule hereto has been presented to His Excellency the Governor, praying him to constitute such part of the colony a district for the purposes of Part II. of “The Rabbit Nuisance Act 1882 Amendment Act, 1886” (hereinafter termed “the said Act”), and it appears expedient to grant the prayer of the said petition:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth constitute all that part of the said colony described in the Schedule hereto a district for the purposes of Part II. of the said Act, and doth hereby declare that such district shall be known by the name of “The Awatere Rabbit District.”

SCHEDULE.

ALL that area in the Provincial District of Marlborough, commencing at a point on the shores of Cook Strait in transit with the northern boundary of Section No. 10 of Block II., Clifford Bay Survey District. Bounded generally towards the North and East by a right line to the north-eastern corner of that section, and by the northern boundaries of that section and Sections Nos. 8 of Block I., 9 of Block II., 7 of Block I., 13, 14, and 15 to the north-western corner of the last-mentioned section; thence by that section and the northern boundaries of Sections Nos. 16 and 17 in the said district to the north-western corner of said Section No. 17; thence by Sections Nos. 23, 26, 27, 30, 32, 34, 36, 38, 40, 42, and 43, Taylor Pass Survey District, to a road-line fronting said Section No. 43; thence by that road-line and a road-line fronting Sections Nos. 49 and 48 in the said survey district to the western bank of the Taylor River; thence by that river to a road-line fronting Section No. 98 in the said district; thence by that road-line to the north-western corner of Section No. 44 in the said district; thence by a road-line and Sections Nos. 85 and 86 in the said district to the north-western corner of the last-mentioned section; thence by a road-line fronting the said Section No. 86 for a distance of 155 links; thence by a line bearing N. 29° 59′ E. to a road-line intersecting Section No. 42 in the said district; thence by that road-line to the Renwick New Road; thence by that road to the Middle Renwick Road; thence by that road to a point in line with the eastern boundary-line of Section No. 157, Onamalutu Survey District; thence by that boundary-line and its production to the north-east corner of Section No. 35 of Block I. in the said district; thence by a right line to the mouth of the Onamalutu Creek; thence by that creek to the south-western corner of Section No. 106 in the said district; thence by that section and Section No. 107; thence by a right line to the nearest point on the summit of the watershed between the Onamalutu and Kaituna Valleys; thence by that watershed to the summit of the dividing range between the Pelorus and Wairau Valleys; thence by that summit to the boundary-line between the Provincial Districts of Marlborough and Nelson; thence towards the West by that line to Barefell Pass; thence by the Guide River and the Acheron River to the confluence of the latter river with the Clarence River; thence towards the South by the boundary-line between the Provincial Districts of Marlborough and Nelson to the Clarence River aforesaid; thence by that river to the ocean; and thence towards the East by the ocean to the commencing-point.
