Regulations under "The Government Life Insurance Act, 1886."

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixteenth day of December, 1886.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

HIS Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in him by "The Government Life Insurance Act, 1886," and "The Government Insurance and Annuities Act, 1874," and all other powers and authorities in this behalf vested in him, and by and with the advice and consent of the Executive Council of the said colony, doth hereby make and prescribe the following rules and regulations with respect to the transferring of policies from the General Section of the Ordinary Branch of the Government Life Insurance Department to the Temperance Section of the said department:—

Any policyholder whose life is insured in the General Section of the said department, and being desirous of transferring his policy to the Temperance Section of such department, may effect such transfer by executing a memorandum of transfer indorsed on the policy in the manner and form prescribed in the First Schedule hereto, subject always to the following conditions:—

  1. No such policyholder shall be entitled to effect such a transfer unless the date of his policy be prior to the first day of July, one thousand eight hundred and eighty-two.

  2. No such policyholder shall be entitled to effect such a transfer unless he shall have been a total abstainer from the date of his policy, and shall make a declaration and agreement in the manner and form prescribed in the Second Schedule hereto.

  3. No such policyholder shall be entitled to effect such a transfer unless he is at the date of such transfer the absolute owner of such policy.

  4. Every policyholder who has so transferred his policy shall, at such times as the Commissioner may require him so to do, not being more than once in each year, make a declaration of abstinence in the manner and form prescribed in the Third Schedule hereto.

  5. No such transfer shall be allowed after the thirty-first day of January, one thousand eight hundred and eighty-seven, on or before which date the policy, with the memorandum of transfer indorsed thereon, must be received at the Office of the Government Insurance Commissioner at Wellington.

I do hereby request the Government Insurance Commissioner to transfer from the General Section of the Ordinary Branch of the Government Life Insurance Department to the Temperance Section of the said department the Policy No. , printed and written on the other side hereof, subject to the prescribed conditions affecting such transfer.

SECOND SCHEDULE.

FORM OF DECLARATION AND AGREEMENT.

I, A.B. [name in full], of [place of residence, &c.], hereby declare that I have abstained from all intoxicating beverages from the day of , 18 ; and I undertake to continue so to abstain during the time for which the said policy may remain in force. And I do hereby agree that, in the event of my not continuing to abstain from intoxicating beverages at any time during the remaining currency of the said policy, or of my refusing to make a declaration of abstinence as required by the regulations for the time being in force relative to temperance policies, my right to participate in any profits not previously allocated shall be absolutely forfeited. And I do hereby agree that from and after the date of such transfer the said policy shall be subject to the same conditions and regulations as if it had originally been issued out of the Temperance Section. And I do hereby further agree that the above declaration shall be imported into and be read as part of the original contract of insurance; and, if such declaration shall prove to be false,

the said policy shall be voidable at the option of the said Commissioner.

Reserves subject to the Jurisdiction of the Native Land Court.

ORDER IN COUNCIL

At the Government House, at Wellington, this twenty-first day of December, 1886.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section seven of "The Native Equitable Owners Act, 1886," it is provided that the Native Land Court of New Zealand shall have and may exercise the jurisdiction conferred upon it by the said Act in respect of any Native reserve situate in the South Island or in Stewart Island which may be submitted to such jurisdiction by Order in Council, which the Governor was thereby authorized to issue from time to time: And whereas it is expedient to order and declare that the reserves described in the Schedule hereto should be submitted to the jurisdiction aforesaid:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise of the power and authority conferred upon him by "The Native Equitable Owners Act, 1886," and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the several reserves described in the Schedule hereto shall, subject to the provisions of the said Act, be subject to the jurisdiction of the Native Land Court of New Zealand, and the said Court shall have the like authority to deal with the said reserves as it would have if the same were still Native lands within the meaning of "The Native Land Court Act, 1880."

SCHEDULE.

NATIVE RESERVES, STEWART ISLAND.

All that parcel of land known as Native Reserve No. 188, situate at Lord's Harbour, Stewart Island, containing by admeasurement 30 acres, more or less. Bounded towards the North by a road-line; towards the East also by a road-line; towards the South, 1682 links, by a lighthouse and pilot station reserve; and towards the West, 1365 links, also by a road.

All that parcel of land known as Native Reserve No. 189, situate at Port Adventure, Stewart Island, containing by admeasurement 330 acres, more or less. Bounded towards the North by a road-line; towards the East, 3056 links, by Crown land; towards the South by a road-line; and towards the West, 2313 links, by Section No. 2.

All that parcel of land known as Native Reserve No. 191, situate at Patterson Inlet, Stewart Island, containing by admeasurement 400 acres. Bounded towards the North-east, 4000 links, by Crown land; towards the South-east, 11108 links, by Crown land; towards the South-west by a road-line; and towards the North-west, 10514 links, by Crown land.

All that parcel of land known as Native Reserve No. 192, situate at Horseshoe Bay, Stewart Island, containing by admeasurement 40 acres. Bounded towards the North by a road-line; towards the East, 1900 links, by Crown land;
