shall be taken away by the said Rutland Turner and deposited above high-water mark, or at such place as may be approved of by the Minister or by the Collector of Customs at Auckland.

  1. That the rights, powers, and privileges conferred by this Order in Council shall continue in force for fourteen years computed from the date of this Order in Council, unless in the meantime such rights, powers, and privileges shall be altered, modified, or revoked by competent authority; and the said Rutland Turner shall not assign, charge, or part with any such right, power, or privilege without the previous written consent of the Minister first obtained.

  2. That the said rights, powers, and privileges may be at any time resumed by the Governor, without payment of any compensation whatever, on giving to the said Rutland Turner six calendar months’ previous notice in writing. Any such notice shall be sufficient if given by the Minister, and delivered at or posted to the last known address of the said Rutland Turner.

  3. The said Rutland Turner shall be liable for any injury which the said wharf may cause any vessel or boat to sustain through any default or neglect on his part.

  4. In case the said Rutland Turner shall—
    (1.) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them;
    (2.) Cease to use or occupy the said wharf;
    (3.) Fail to pay the sums specified in clause two of these conditions; or
    (4.) Become bankrupt or be in any manner brought under the operation of any Act for the time being in force relating to bankruptcy;
    then and in any of the said cases this Order in Council, and every right, power, or privilege, may be revoked and determined by the Governor in Council without any notice to the said Rutland Turner or other proceeding whatsoever, and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the said Rutland Turner, and to all persons concerned or interested, that this Order in Council, and the rights and privileges thereby conferred, have been revoked and determined.

  5. In these conditions the term “Minister” means the Minister having charge of the Marine Department, as defined by “The Shipping and Seamen’s Act, 1877,” and includes any officer, person, or authority acting by or under the direction of such Minister.

Extending Close Season for Mud Oysters, Waimea, Nelson.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of July, 1886.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Fisheries Conservation Act, 1884” (hereinafter termed the said Act), it is, among other things, enacted that the Governor in Council may from time to time make, alter, and revoke regulations for the purposes therein mentioned, which said regulations shall have force and effect only in any waters or places specified therein:

And whereas by an Order in Council dated the twenty-seventh day of March, one thousand eight hundred and eighty-five, certain regulations were made, in exercise of the powers conferred by the said Act, prescribing, amongst other things, a close season for shore and mud oysters:

And whereas it is expedient to extend such close season in respect of the part of the colony hereinafter set forth:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise of the powers conferred on me by the said Act, and by and with the advice and consent of the Executive Council of the said colony, do hereby make the following regulation:—

The close season for shore and mud oysters prescribed by the regulations made under the said Act by Order in Council bearing date the twenty-seventh day of March, one thousand eight hundred and eighty-five, is hereby declared to commence from the date hereof, and is also extended, as also the operation of the said recited regulations, until the thirty-first day of January, one thousand eight hundred and eighty-eight, in respect of that part of the colony within the following boundaries, namely:—

Starting at the eastern corner of section eighty-five, Suburban South, Nelson; thence by a straight line to the nearest point of the Rabbit Island; thence by high-water mark of the Rabbit Island to its most westerly point; thence by a straight line to the most easterly point of section three, Moutere Hills; and thence by high-water mark of the Waimea mud-flats to point of starting.

Vesting Reserves in the Geraldine Road Board.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the lands mentioned in the Schedule hereto were reserved for gravel reserves, site for Road Board offices, and a timber-yard: And whereas, in the opinion of the Governor, it is expedient to vest the said lands in the Geraldine Road Board:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the said reserves shall become vested in the Road Board of the Geraldine District, in trust, for the purposes set opposite each reserve.
