Assent to the Construction of the Hutt Park Railway, from a certain Point at Petone, on the Government Railway from Wellington to Masterton, to a certain Point on the West Bank of the Western Branch of the Hutt River where the Waterworks Bridge crosses it.

WHEREAS by “The District Railways Act, 1877,” and “The District Railways Act 1877 Amendment Act, 1878” (herein referred to as “the said Act”), and other Acts, it is enacted that, whenever the Governor shall approve of or object to any proposed railway, he shall, by notice gazetted, declare his assent to or disapproval of the construction of the railway, and such notice when so published shall be sufficient notice to the company of such approval or dissent, as the case may be: And whereas the Hutt Park Railway Company (Limited) propose to construct a railway under the said Act, and have made application to me for my approval of the construction of the said railway, and it appears expedient that such approval should be given:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers vested in me by the said Act, do hereby notify and declare that I do hereby assent to the construction of the Hutt Park Railway, from a certain point at Petone, on the Government Railway from Wellington to Masterton, to a certain point on the west bank of the western branch of the Hutt River where the waterworks bridge crosses it, as shown on the plan and in the book of reference deposited in the Public Works Office, at Wellington, and numbered P.W.D. 13012.

Season for killing Hares in North Canterbury extended.

WHEREAS by a warrant made under “The Animals Protection Act, 1880,” and “The Animals Protection Act Amendment Act, 1881,” dated the twentieth day of March, one thousand eight hundred and eighty-five, and published in the New Zealand Gazette of the twenty-sixth day of March, one thousand eight hundred and eighty-five, it was notified, amongst other things, that hares might be taken or killed, within the North Canterbury District, from the first day of April, one thousand eight hundred and eighty-five, to the thirty-first day of July, one thousand eight hundred and eighty-five: And whereas it is expedient to extend the time for taking or killing hares within the said district:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise of the powers vested in me by the said “Animals Protection Act, 1880,” and “The Animals Protection Act Amendment Act, 1881,” do hereby notify that hares may be taken or killed within the said North Canterbury District until the thirty-first day of August, one thousand eight hundred and eighty-five.

Conditions for Netting Trout in Lake County.

IN pursuance of the powers and authorities conferred by “The Salmon and Trout Act, 1867,” and “The Salmon and Trout Act 1867 Amendment Act, 1884,” and of all other powers and authorities in anywise enabling me in that behalf, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby make the following regulations for netting trout in the Lake County:—

1. The Lakes District Acclimatisation Society shall have the control and management of all salmon and trout now or hereafter to be placed in the lakes in the said Lake County, and for this purpose may divide the lakes into suitable areas. The right of fishing such areas to be let by the said society, from year to year, by auction, tender, or otherwise as may be deemed best for propagation, culture, and conservation of such salmon and trout, and the prevention of poaching.

2. The season for netting shall extend from the first day of October, one thousand eight hundred and eighty-five, to the thirty-first day of March, one thousand eight hundred and eighty-six, both days inclusive.

3. No nets of a smaller mesh than three and a half inches in diameter for the taking of fish shall be used in any portion of the Lakes District, and all fish caught by net not larger than twelve inches in length shall be forthwith returned to the water.

4. No nets for the taking of fish shall be used in any of the rivers, or streams, or creeks within Lake County.

5. No person shall be permitted to use a net for the purpose of fishing unless he holds a valid license so to fish from the Lakes District Acclimatisation Society.

6. Any person holding a fishing license under the provisions of the regulations for fishing in Lake County, hereafter to be published in the New Zealand Gazette, may fish with rod and line in any lake, river, or stream within the said district, anything contained in these regulations notwithstanding.

7. The Lakes District Acclimatisation Society, through their officers, rangers, inspectors, constables, or any other person duly authorized, shall have full power at any time to inspect, examine, and search for any nets, tackle, engines, boats, or any utensils or instruments used and employed for the taking of fish within the area of the said Lake County, and to seize and appropriate, in the interests of the said Lakes District Acclimatisation Society, all and every such nets, tackle, engines, boats, or any utensils or instruments so used and employed in contravention to these regulations, and also to seize and appropriate as aforesaid all and every fish caught and in possession of any person during the close season, or in possession of any person who cannot or does not produce, at the time of catching or disposing of such fish, a license under the hand of the Secretary of the Lakes District Acclimatisation Society empowering him in that behalf.

8. Any person committing a breach of any of the foregoing regulations shall be liable, on conviction, to a penalty not exceeding fifty pounds.

9. Any person who puts, throws, or places, or allows to be put, thrown, or placed, into any river, lake, or stream in the said district of Lake County any dynamite or other explosive substance, or any matter or liquid deleterious to fish, shall, on conviction, be liable to a penalty not exceeding one hundred pounds.

10. Licenses to net salmon and trout in the aforesaid district of Lake County will be issued under the hand of the Secretary of the Lakes District Acclimatisation Society, Queenstown.

11. The moneys realised by the leasing of the lakes for the purpose of fishing therein with nets shall be placed by the President of the Society to the credit of a separate fund, called “The Lakes District Acclimatisation Fund,” and such moneys shall be devoted to the propagation, culture, and conservation of the fish in Lake County; and the surplus, if any, to the credit of the society from such source on the first day of October in each year, shall be disposed of as the Governor in Council may deem fit.

12. It shall be the duty of the President of the said society to forward to the Colonial Secretary, on or before the tenth day of October in each year, a statement of account, certified by the said President, showing in detail the several amounts received and paid to the credit of the said fund, and the amounts disbursed therefrom, together also with a list showing the number and particulars of the licenses issued under these regulations during the year ending the thirtieth day of September previous.

WHEREAS by the fifty-first section of “The Mines Act, 1877,” it is enacted that it shall be lawful for the Governor, subject to the provisions of the said Act, from time to time to make, alter, amend, and revoke rules and regulations for all or any of the purposes thereafter enumerated: And whereas by a warrant issued under the hand of His Excellency the Governor on the tenth day of January, one thousand eight hundred and seventy-eight, certain rules and regulations were made for the several mining districts constituted under the said Act: And whereas it is desirable to revoke Regulations numbers fifteen, one hundred and fourteen, and one hundred and twenty-seven, made by the warrant aforesaid, and to make other regulations in lieu thereof:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby revoke the aforesaid Regulations numbers fifteen, one hundred and fourteen, and one hundred and twenty-seven, and I do hereby make the following regulations in lieu thereof,
