Powers delegated to the Auckland City Council under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of June, 1884.

Present:

His Excellency the Governor in Council.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881” (hereinafter termed “the said Act”), His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke certain Orders in Council dated the twenty-ninth day of May, one thousand eight hundred and eighty-two, and the twenty-fourth day of July, one thousand eight hundred and eighty-two, delegating to the persons and in manner specified in such Orders in Council certain of the powers conferred by the said Act; and doth, in exercise of the like powers and authorities, and with the like advice and consent, by this present order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the said Act, except the powers under or conferred by sections five and twelve thereof, to

The Mayor, Councillors, and Citizens of the City of Auckland

(hereinafter referred to as “the Council”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Council shall meet for the transaction of business on the first Thursday in each month, at seven o’clock p.m., at the offices of the City Council, at Auckland, or at such other time or place as may from time to time be fixed by the Council. The first meeting shall be held on Thursday, the seventeenth day of July, one thousand eight hundred and eighty-four.

  2. Special meetings may be convened by the Mayor, or by any two members of the Council, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. A majority of the members of the Council present at any meeting shall form a quorum for the purpose of transacting any business under the powers hereby conferred. Any meeting may be adjourned from time to time.

  4. The annual meeting of the Council for the purpose aforesaid shall be held on the seventeenth day of January, in each year, unless such day shall fall on a Sunday or a public holiday, in which case the meeting shall be held on the day following, not being a Sunday or holiday. At such annual meeting a report upon the dealings with the land described in the Schedule hereto during the preceding year, and a balance-sheet and statement of the revenue received and the disbursements made in respect of the said land, shall be submitted to the Council for adoption; and it shall be the duty of the Chairman of such meeting to forward to the Minister of Lands for the time being a true copy of the minutes and proceedings at such annual meeting, certified under his hand, together with a true copy of the report, balance-sheet, and statement which shall have been so submitted as aforesaid.

  5. Subject to the provisions of the said Act, and to the stipulations in this Order in Council contained, all meetings of the Council for the transaction of any business under the powers conferred by the said order shall be held, and the like procedure thereat followed, as in the case of ordinary meetings of the Council, so far as practicable: Provided, however, that such meetings shall not be open to the public, and the minute-book of proceedings shall not be open to public inspection, unless the Council shall at a special meeting so resolve.

SCHEDULE.

ALL that piece or parcel of land situate in the Parish of Waitemata, in the County of Eden, containing 196 acres, more or less, and known as the Government Domain or Auckland Park. Bounded towards the North-east by Suburban Section No. 95 120 links, 300 links, 310 links, 306 links, 306 links, 304 links, and 300 links, and by a stream; towards the South-east by a road 1876 links, and by a road 960 links and 560 links; towards the South by a road 569 links, and by a road 1187 links; towards the South-west by a road, 1612 links; towards the West by the Provincial Hospital grounds 299 links, 520 links, 824 links, and 220 links, by a stream dividing it from Suburban Section No. 18 to a marked puriri tree, and by the said Suburban Section No. 18 691 links and 396 links; towards the North-west and North by a mill-race, by a line 175 links, and again by the mill-race and by a line 423 links and 405 links to where the boundary commenced.

ALL that area in the Provincial District of Otago, containing by admeasurement 40 acres 2 roods 38 perches, more or less, being part of the Town Belt of the City of Dunedin. Bounded towards the North-west by the Main North Road from the Water of Leith to the Opho Road, 1535 links; towards the North-east by the said Opho Road, 1410 links; towards the East by the other part of said Town Belt of the City of Dunedin from the Opho Road to the Northern Cemetery Road, 3400 links; towards the South-east by the said Cemetery Road, 200 links; towards the South by Sections Nos. 14 and 15 respectively, Block XXXVII., of the City of Dunedin, and a road-line, 350 links, to the Water
