Powers delegated to the Ormond Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this tenth day of April, 1884.
Present:
THE HONOURABLE THE MINISTER OF LANDS PRESIDING IN COUNCIL.
IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-first day of January, one thousand eight hundred and eighty-four, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Ormond Public Domain Board, namely,—
MICHAEL BOLAND,
ARTHUR KEMPTHORNE,
ALEXANDER MCKENZIE,
ABRAHAM SKILLICORN, and
ROBERT DOUGLAS McDOUGALL
(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

The Board shall meet for the transaction of business on the first Thursday in each month, at two o’clock p.m., at Ormond House, Ormond North, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the fifth day of May, one thousand eight hundred and eighty-four.

Special meetings may be convened by the Chairman, or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the second Tuesday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be Chairman of such meeting.

If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may, at any monthly or special meeting, appoint a Chairman.

All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

ALL that parcel of land in the Provincial District of Auckland, containing by admeasurement 20 acres 2 roods 26 perches, more or less, being Suburban Sections Nos. 11 and 12 of the Township of Ormond.

Notice of Intention to change the Purpose of a Portion of a Reserve.

WHEREAS by “The Public Reserves Act, 1881,” it is, amongst other things, enacted that the Governor may declare his intention to make, change, exchange, or alter the dedication of any public reserve now or hereafter vested in Her Majesty or the Governor for any of the purposes named in Class II. of the Schedule to the said Act, whether the same be granted or not; and, in the case of any reserves made under the authority of section one hundred and forty-four of “The Land Act, 1877,” if it shall, in the opinion of the Governor, be expedient to change the purpose of such reserves or any part thereof from the purpose or presumed purpose for which it was set apart to any other purpose, or if it shall, in the opinion of the Governor, be expedient to exchange any of the land comprised in such reserve for other land of equal value, to be dedicated to one or more purposes named in the said Class II., the Governor may, by notice in the Gazette, declare his intention to make such change, exchange, or dedication, as the case may be, and in such notice declare the manner and terms in which the same is intended to be so made:
Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby, in exercise and pursuance of the powers and authorities vested in me by “The Public Reserves Act, 1881,” aforesaid, declare my intention to change the specific purpose of a portion of the reserve described in the first column of the Schedule hereto, the area of which is described in the second column of the said Schedule, to the specific purpose set opposite such description in the third column of the said Schedule.

For railway purposes. | All that parcel of land in the Katrine Survey District, Provincial District of Canterbury, containing 100 acres, more or less, being part of Reserve No. 869 (in red). Bounded — Northward by the Hurunui River, about 3500 links; Westward by a true north and south line, 2850 links; Southward by a true east and west line, 3500 links; and Eastward by a line parallel to the western boundary, 2870 links: be all the aforesaid linkages more or less; and numbered 2629 (in red) on the official map in the Survey Office, Christchurch. | Recreation and Thermal Springs Reserve. |

Validating Election of Native Assessor under Licensing Acts.

WHEREAS by regulations made under “The Licensing Act, 1881,” and “The Licensing Act Amendment Act, 1882,” it is provided that, where any accidental or unavoidable impediment or omission shall have happened, the Governor may, by warrant under his hand, take all such measures as may be necessary for removing such impediment or rectifying such misfeasance or omission, or may declare all or any of the proceedings at or for any election held under the said Acts valid as to and notwithstanding such impediment, misfeasance, or omission; and that every warrant issued under this regulation shall be published in the Kahiti and New Zealand Gazette, and shall state specifically the nature of the impediment, misfeasance, or omission: And whereas on or about the twenty-seventh day of February, one thousand eight hundred and eighty-four, Himiona te Kani was nominated as Assessor for the Native Licensing District of Tolago, and was on the said twenty-seventh day of February, one thousand eight hundred and eighty-four, declared duly elected as Assessor for the said Native licensing district by Martin Dudley Stagpoole, the person conducting the election: And whereas the said Martin Dudley Stagpoole had no authority to conduct such election, not having been appointed Returning Officer, Substitute Returning Officer, or Deputy Returning Officer for the said District of Tolago; but such election was in other respects duly conducted, and it is expedient to validate the same:
Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of all powers enabling me in this behalf, do hereby validate the election of Himiona te Kani to be the Assessor for the Native Licensing District of Tolago, so conducted as aforesaid.
As witness the hand of His Excellency the Governor, this fourteenth day of April, one thousand eight hundred and eighty-four.
