Declaring Malvern Water-race, County of Selwyn, subject to the Provisions of “The Counties Acts Amendment Act, 1883.”

A PROCLAMATION.

WHEREAS the Council of the County of Selwyn, purporting to have constructed, under the provisions of “The Malvern Water-race Transfer Act, 1878,” a certain water-race, known as the Malvern Water-race, has forwarded to His Excellency the Governor a petition praying him to proclaim the said water-race as subject to the provisions of “The Counties Acts Amendment Act, 1883,” hereinafter specified; and it appears expedient to grant the prayer of such petition:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby proclaim and declare that the said Malvern Water-race shall, as from the first day of March, one thousand eight hundred and eighty-four, be subject to the provisions of sections numbered thirty to fifty, both inclusive, of “The Counties Acts Amendment Act, 1883.”

Given under the hand of His Excellency Sir William Francis Drummond Jervois, Lieutenant-General in Her Majesty’s Army, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Companion of the Most Honourable Order of the Bath, Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-eighth day of February, in the year of our Lord one thousand eight hundred and eighty-four.

Special Order made by Patea County Council.—Okutuku Road District constituted.

THE following special order, made by the Patea County Council, under “The Road Boards Act, 1882,” is published in accordance with “The Counties Act 1876 Amendment Act, 1882.”

I, the undersigned, Chairman of the Patea County Council, hereby certify that the following resolution was duly passed at a meeting of the Council held on the 3rd January, 1884:—

That the Okutuku Road District be proclaimed a new road district. Number of members, four.

OKUTUKU ROAD DISTRICT.

Commencing at the most northerly angle of Section No. 461, Okutuku; and bounded generally towards the East by the road forming the eastern boundaries of Sections Nos. 461, 462, 463, 282, and 283, by the road forming the southern boundaries of Sections Nos. 72, 71, and 76, and the western boundary of Section No. 64, by the road forming the northern boundaries of Sections Nos. 65 and 347 to the Momahaki Stream, by the last-mentioned stream until it reaches the eastern boundary of Section No. 61, and by the eastern boundaries of Sections Nos. 61, 60, 57, 55, and 44 (crossing all intervening public roads); bounded generally towards the South by the main road from Wanganui to Waverley from the south-eastern angle of Section No. 44, Okutuku, to the eastern boundary of the Waverley Town District, by the said eastern boundary, by a road forming the eastern boundary of Section No. 42 until the said road reaches the Mangatangi Stream, and thence by the Mangatangi Stream to its junction with the Kohi Stream; bounded generally towards the West by the Kohi Stream from its junction with the Mangatangi Stream to the boundary-line between the Provincial Districts of Wellington and Taranaki, and by the last-mentioned boundary-line to the point of commencement (crossing all intervening public roads).


Special Order by Kaikoura County Council.—Merging Kaikoura Road District.

THE following special order, made by the Kaikoura County Council, under “The Counties Act, 1876,” is published in accordance with “The Counties Act 1876 Amendment Act, 1882.”

SPECIAL ORDER.

THAT, in order to preserve and maintain the unity of the local government of the County of Kaikoura, this Council resolves that the petition of A. W. Ingles and 82 of the ratepayers shall be given effect to, and that the Kaikoura Road Board shall be merged in the County Council.

I hereby certify that the special order to merge the Kaikoura Road Board in the County Council, made the 31st December, 1883, and confirmed the 28th January, 1884, has been duly made in the manner required by section 32 of “The Counties Act 1876 Amendment Act, 1882.”

By-law respecting Pedlars and Hawkers made by the Grey County Council.

THE following by-law, made by the Grey County Council, is published in accordance with “The Counties Act 1876 Amendment Act, 1882.”

BY-LAWS FOR LICENSING PEDLARS AND HAWKERS.

  1. EVERY person trading or carrying on the business of a pedlar or hawker within the County of Grey shall apply to the Grey County Council for a license authorizing him or her to do so, and the Council shall, if it thinks fit, grant such license.

  2. Such license shall be an annual license, and be in force for twelve months from the date of the issue thereof.

  3. The fee to be paid for every such license shall be—for a pedlar the sum of £2 10s., for a hawker the sum of £5.

  4. The County Clerk shall cause the names of all persons to whom licenses are granted to be entered in a book to be kept for that purpose.

  5. Such license shall be issued by the Chairman on behalf of the Council on payment to the County Treasurer of such license fee.

  6. Any person committing a breach of these by-laws shall be liable, on conviction, to a penalty not exceeding £5.

  7. A pedlar shall be deemed to mean any person who sells goods, wares, jewellery, or merchandise, and who carries such goods, wares, jewellery, or merchandise on foot.

  8. A hawker shall be deemed to mean a person who sells goods, wares, jewellery, or merchandise, and carries such goods, wares, jewellery, or merchandise on horseback or by vehicle for sale.

  9. Any person solely engaged in selling works of literature shall be exempted from payment of a license fee.


EXTRACT from Minutes of Special Meeting of 15th January, 1884, of Grey County Council.

Resolved, That this Council doth hereby adopt the by-laws for licensing pedlars and hawkers within the County of Grey, and that they be sealed with the seal of the Council.

Resolved, That the by-laws for licensing pedlars and hawkers within the County of Grey come into force on the 1st day of March, 1884.

I, James Payne, Clerk, Grey County Council, do hereby certify that, as required by section 33, “Counties Act 1876 Amendment Act, 1882,” all necessary steps have been taken by this Council for carrying into effect the resolution of the 29th November last in the matter of adopting by-laws for licensing pedlars and hawkers within the County of Grey, and that the said by-laws were finally adopted at an adjourned special meeting held on Tuesday, the 15th January, 1884.
