Land authorized to be taken by the Borough of Thames for
Drainage Purposes.

A PROCLAMATION.
WHEREAS by "The Municipal Corporations Act, 1876," it
is enacted that the Council of a borough constituted
under that Act may take or purchase under the provisions of
"The Public Works Act, 1876" (hereinafter called "the said
Act"), any lands within the borough required for the good and
efficient drainage of the borough: And whereas the Council of
the Borough of Thames, requiring to take the land described in
the Schedule hereto for the purpose of drainage, has laid before
me the memorial referred to by section twenty-five of "The
Public Works Act, 1876," praying me to declare, by Proclama-
tion, that such land is taken for such purpose:
And whereas the Mayor of the said borough has, in accord-
ance with the twenty-eighth section of "The Public Works Act
1876 Amendment Act, 1878," laid before me a statutory decla-
ration that the said Council is authorized by law to undertake
the work for which the land described in the memorial laid
before me under section twenty-five of the said Act is required,
that all the provisions of the said Act as to taking such land
have been complied with, and that the said Council are of
opinion that the proposed works should be executed, and that
no private injury will be done for which due compensation is not
provided by the said Act:
And whereas it appears to me that all things required by "The
Municipal Corporations Act, 1876," "The Public Works Act,
1876," and "The Public Works Act 1876 Amendment Act,
1878," to be done and performed to authorize the taking of such
land have been done and performed, and it is expedient to
declare that such land is taken for the purpose aforesaid:
And whereas by the two hundred and twenty-ninth section of
"The Public Works Act, 1882," it is enacted that any public
work authorized under the authority of any Act repealed by
such last-mentioned Act or of any Act or Ordinance repealed by
"The Public Works Act, 1876," and any land required to be
taken, purchased, or acquired for such work, or anything com-
menced under any such authority as aforesaid, may be con-
tinued, taken, purchased, or acquired, executed, carried out,
enforced, and completed under the provisions of "The Public
Works Act, 1882:"
Now, therefore, I, William Francis Drummond Jervois, the
Governor of the Colony of New Zealand, in exercise of the
powers and authorities in me vested by the said Acts, and of
every other power and authority enabling me in that behalf, do
hereby proclaim and declare that the land described in the
Schedule hereto is taken by the Council of the said borough for
drainage purposes; and that, from and after the nineteenth
day of May, one thousand eight hundred and eighty-
three, the said land shall become vested in fee-simple in the
Mayor, Councillors, and burgesses of the Borough of Thames,
for drainage purposes.
SCHEDULE.
ALL that parcel of land containing by admeasurement 12
perches, situated in the Borough of Thames, being portions of
Allotments Nos. 31 and 32 of Section No. 28 of the Town of
Shortland. Bounded towards the North-east by Mackay Street,
100 links; towards the South by other portions of Allotments
Nos. 31 and 32, 180\frac{1}{4} links; and towards the North-west by
Allotments Nos. 35, 34, and 33, 150 links, to the commencing
point.
All those parcels of land containing by admeasurement 2
roods 10 perches and 21\frac{1}{4} perches respectively, situated in the
Thames Survey District, and being portions of the old bed of
the Hape Creek, situated between Fenton Street and the
Kauaeranga Creek, and a portion of the foreshore of the
Kauaeranga Creek:-
Portion containing 2 roods 10 perches: Bounded towards
the North by the Thames and Waikato Railway, 100 links;
Easterly by the eastern bank of the Kauaeranga Creek;
Northerly by the northern bank of the Hape Creek; Westerly
by western boundary of the Hape Creek; and again Northerly
by the Thames and Waikato Railway, 46 links; Easterly by
a portion of the eastern bank of the Hape Creek aforesaid;
towards the South by a portion of the southern bank of the
Hape Creek aforesaid and a line, 43.5 links; and towards the
West by lines, 214.5 links and 191\frac{1}{2} links respectively, to the
commencing point.
Portion containing 21\frac{1}{4} perches: Bounded towards the North
by Fenton Street, 104 links; towards the East by a portion of
the eastern bank of the Hape Creek; towards the South by the
Thames and Waikato Railway, 8 links and 142 links respec-
tively; and towards the West by a portion of the western bank
of the Hape Creek aforesaid to the commencing point.
All that parcel of land containing by admeasurement 11\frac{1}{2}
perches, situated in the Borough of Thames, being portion of
Allotment No. 37 of Section No. 28 of the Town of Shortland.
Bounded towards the North-east by Allotment No. 36, 144.5
links; towards the South-east by other portion of Allotment
No. 37, 50 links; towards the South-west by Allotment No. 4,
144.5 links; and towards the North-west by Grey Street, 50
links, to the commencing point.
All that parcel of land containing by admeasurement 16
perches, situated in the Borough of Thames, being Allotment
No. 36 of Section No. 28 of the Town of Shortland. Bounded
towards the North by Grey Street, 50 links; towards the
