Public Works Act, 1876," the middle line of a portion of the
railway from Masterton to Papatu vid Woodville, being one of
the railways specified in "The Immigration and Public Works
Appropriation Act, 1878," was defined: And whereas pursuant
to the one hundred and twenty-fifth section of "The Public
Works Act, 1876," the Minister for Public Works has caused
to be made and, on the tenth day of June, one thousand
eight hundred and seventy-nine, caused to be deposited in the
office of the Registrar of the Supreme Court at Wellington, in
the Provincial District of Wellington, such maps and plans
as were necessary to explain the said portion of the said line
of railway and the land through which the same passes, and
such maps and plans were referred to in such Proclamation
as aforesaid: And whereas the railway from Wellington to
Napier includes the railway referred to in the Proclamation
hereinabove recited, and is one of the railways specified in "The
Public Works Act, 1879:" And whereas "The Public Works
Act, 1879," enacts that such of the railways mentioned therein
as are unfinished may be completed under the provisions of "The
Public Works Act, 1876," "The Public Works Act 1876 Amend-
ment Act, 1878," and "The Public Works Act, 1879:" And
whereas the two hundred and twenty-ninth section of "The
Public Works Act, 1882," enacts as follows: Any public work
authorized under the authority of any Act repealed by this Act,
or of any Act or Ordinance repealed by "The Public Works
Act, 1876," and any land required to be taken, purchased, or
acquired for such work, or anything commenced under any such
authority as aforesaid, may be continued, taken, purchased, or
acquired, executed, carried out, enforced, and completed under
the provisions of this Act: And whereas by a Proclamation
issued under the authority of "The Public Works Act, 1882,"
the middle line of a further portion of the line of railway from
Wellington to Napier (Opaki Contract, portion of), being one of
the railways specified in "The Public Works Act, 1879," was
defined: And whereas pursuant to the one hundred and thirtieth
section of "The Public Works Act, 1882," the Minister for Public
Works has caused to be made and, on the third day of April, one
thousand eight hundred and eighty-three, to be deposited in
the office of the Registrar of the Supreme Court at Wellington,
in the Provincial District of Wellington, such maps and plans
as were necessary to explain the said further portion of the
said line of railway and the land through which the same
passes, and such maps and plans were referred to in such Pro-
clamation as aforesaid: And whereas the land described in
the Schedule hereto is required to be taken for portions of the
said line of railway from Wellington to Napier:

Now, therefore, I, William Francis Drummond Jervois, the
Governor of the Colony of New Zealand, in exercise of the
powers and authorities conferred by "The Public Works Act,
1882," and of every other power and authority in anywise
enabling me in that behalf, do hereby proclaim and declare
that the land described in the Schedule hereto is taken for
the said portions of the said line of railway from Wellington
to Napier.

SCHEDULE.

ALL that piece or parcel of land containing by admeasurement
7 acres 2 roods 24 perches, being portion of Section No. 56,
commencing at a point on the northern boundary of Section
No. 65, Opaki Block. Bounded-Southerly by said block, 102
links; Westerly by lines, 1079 and 6484 links respectively;
North-westerly by subdivisional line of said section, 189 links;
Easterly by lines to commencing point, 6644 and 1101 links
respectively.

Also all that piece or parcel of land containing by admeasure-
ment 2 acres and 27 perches, being portion of Section No. 56,
commencing at a point on the south-western boundary of
Section No. 6, Native Reserve. Bounded-North-easterly by
said boundary, 136 links; Westerly by a line, 2294 links;
South-easterly by a line, 189 links; Easterly by a line to com-
mencing point, 2041 links.

All that piece or parcel of land containing by admeasurement
8 acres and 224 perches, being portion of Section No. 6, Native
Reserve, commencing at a point being the intersection of the
north-western boundary of said section with the western
boundary of public road. Bounded-North-westerly by Section
No. 7, 178 links; Westerly by a line, 460 links; Southerly by
a line, 100 links; Westerly by a line, 7178 links; South-
westerly by a line, 136 links; Easterly by a line, 7271 links;
Southerly by a line, 16 links; Easterly by a public road to com-
mencing point, 599 links.

All that piece or parcel of land containing by admeasurement
7 acres 3 roods 34 perches, being portion of Section No. 7,
commencing at a point being the intersection of the south-
eastern boundary of Section No. 7 with the western boundary
of public road. Bounded-South-easterly by Section No. 6,
178 links; Westerly by a line, 879 links; Easterly by public
road to commencing point, 758 links.

Also commencing at a point on the north-western boundary
of Section No. 7. Bounded-North-westerly by a public road,
661 links; Westerly by a public road, 2843 links; Easterly by
a line to commencing point, 3289 links.

All that piece or parcel of land containing by admeasurement
2 acres 3 roods 3 perches, being portion of Section No. 56,
commencing at a point on the public road forming the south-
eastern boundary of the said section. Bounded-South-easterly
by said road, 146 links; Easterly by a line 2632 links, and
Section No. 11, 200 links; Westerly by a line to commencing
point, 2911 links.

All that piece or parcel of land containing by admeasurement
15 perches, being portion of Section No. 11, commencing at
the north-westernmost corner of subdivision of said section.
Bounded-Northerly by other subdivision of said section, 106
links; Easterly by a line, 212 links; Westerly by a line to
commencing point, 183 links.

All that piece or parcel of land containing by admeasurement
4 acres and 31ยฝ perches, being portion of Section 11, commenc-
ing at a point on the southern boundary of subdivision of said
section. Bounded-Southerly by said subdivision, 106 links;
Easterly by a line, 1627 links; Southerly by a line, 25 links;
Easterly by a line, 749 links; Northerly by a line, 25 links;
Easterly by a line, 1448 links; Northerly by a line, 100 links;
Westerly by a line, 1609 links; Northerly by a line, 25 links;
Westerly by a line, 600 links; Southerly by a line, 25 links;
Easterly and South-easterly by lines to commencing point, 1666
and 16 links respectively.

The above areas and linkages being either more or less, and
the several parcels of land being situate in the Opaki Block,
Survey District of Opaki, Provincial District of Wellington,
Colony of New Zealand; and are more particularly delineated
upon the plan marked P.W.D. 8112, deposited in the office of
the Minister for Public Works at Wellington, in the Provincial
District of Wellington.

Given under the hand of His Excellency Sir William
Francis Drummond Jervois, Lieutenant-General in
Her Majesty's Army, Knight Grand Cross of the
Most Distinguished Order of Saint Michael and
Saint George, Companion of the Most Honourable
Order of the Bath, Governor and Commander-in-
Chief in and over Her Majesty's Colony of New
Zealand and its Dependencies, and Vice-Admiral
of the same; and issued under the Seal of the said
Colony, at the Government House, at Auckland,
this tenth day of May, in the year of our Lord one
thousand eight hundred and eighty-three.

Land set apart on Deferred Payments in Otago.

A PROCLAMATION.

WHEREAS by the fifty-third section of "The Land Act,
1877," it is enacted that the Governor, by Proclamation
in the Gazette, may from time to time set apart out of any
suburban or rural lands such blocks or allotments of land as he
shall think fit, and set the same aside for sale on deferred pay-
ments, and in such Proclamation may fix a day on which the
land shall be open for application; and that he may also in like
manner set apart for sale on deferred payments such blocks or
allotments as may be recommended by any Land Board, and
may also from time to time alter, amend, or revoke any such
Proclamation:

And whereas the Land Board of Otago did, on the eleventh
day of April, one thousand eight hundred and eighty-three,
pass a resolution recommending that the land described in the
Schedule hereto annexed should be set apart for sale on deferred
payments:

And whereas it is expedient to give effect to the aforesaid
recommendation, and to set apart the said land accordingly:

Now, therefore, I, William Francis Drummond Jervois, the
Governor of the Colony of New Zealand, in pursuance and
exercise of the power and authority vested in me by the above-
named Act, do hereby proclaim and declare that the land
described in the Schedule hereto is set apart for sale on deferred
payments; and that Friday, the fifteenth day of June, one
thousand eight hundred and eighty-three, shall be the day on
which the said land shall be open for application in allotments
as surveyed and marked on the selection map in the principal
Land Office of the district.

And, further, in pursuance of the fifth section of "The Land
Act 1877 Amendment Act, 1879," I do hereby fix the price at
which the land so described shall be sold to be the price set
opposite each allotment in the Schedule hereto.
