  1. On and after the gazetting of this by-law the width of
    the tires of all the wheels of every vehicle drawn on any of the
    county roads by five or more than five horses shall be not less
    than six inches; and any person offending against the provi-
    sions of this section shall be liable to a penalty not exceeding
    ten pounds.

  2. It shall be lawful for any member of the Waitaki County
    Council, or for any person acting under the authority of the
    Council, or for any policeman or constable, to examine and
    measure the width of the tires of the wheels of any vehicle,
    cart, dray, wain, wagon, or other carriage affected by the first
    section of this by-law; and every owner or driver of any such
    cart, dray, wain or wagon, or other carriage, after such
    measuring and examination shall have been lawfully required,
    refusing to permit such examination and measuring, or turning
    or driving out of the road in order to hinder, evade, or avoid
    such examination and measuring, or in any way hindering or
    obstructing the same, shall, for every offence, be liable to a
    penalty not exceeding five pounds.

  3. Nothing herein contained shall apply to any vehicle upon
    springs used exclusively for carrying passengers or other persons
    and their luggage, or for the carriage of Her Majesty's mails,
    or for the conveyance of any piece of heavy machinery which
    cannot be taken apart without great expense, loss, or inconveni-
    ence.

  4. Every vehicle carrying, or constructed to carry, goods or
    merchandise of any kind whatsoever for hire, and every vehicle
    carrying passengers for hire, in actual use on any county road,
    shall have the Christian name and the surname and place of
    abode of the owner thereof painted on some conspicuous part
    on the off-side thereof in white letters on a black ground, such
    letters not being less than one inch in length and of a propor-
    tionate breadth; and the owner of any such vehicle who shall
    neglect to have such name and place of abode painted as afore-
    said, or who shall have the same so painted incorrectly, shall
    forfeit and pay for every such offence a sum of not less than
    five shillings nor more than five pounds: Provided that for
    every day that any such vehicle shall continue to be used as
    aforesaid, and to have the name and abode unpainted or incor-
    rectly painted as aforesaid, the owner thereof shall be deemed
    to have committed a fresh offence.

  5. Every penalty imposed by this by-law shall and may be
    recovered in a summary way.

chambers of the said Council, in the Town of Oamara, this 25th

THE following special order, made by the Thames County
Council, is published in accordance with "The Counties
Act 1876 Amendment Act, 1882."

WATERWORKS BY-LAW.

BY-LAW of the Council of the Thames County, made by
Special Order of the said Council on the 20th March,
1883, and sealed with the Common Seal of the said
County.

IN pursuance of the powers vested in them under "The
Counties Act, 1876," and the several Acts altering and amend-
ing the same, and under "The Public Works Act, 1882," the
Council of the Thames County ordains as follows, that is to
say,-

All regulations and by-laws made by the Thames County
Council in respect of the county water-race are hereby re-
pealed.

Throughout this by-law the word "Council" shall mean the
Thames County Council.

The word "waterworks" throughout this by-law means "the
Thames Water-race" and other property vested in the Chair-
man, Councillors, and inhabitants of the County of Thames by
section 9 of "The Thames Water-Supply Transfer Act, 1880,"
and includes all reservoirs, dams, tanks, and pipes, and all
machinery and appliances used or connected therewith or
incidental thereto.

The word "Engineer" throughout this by-law means any
person appointed by the said Council as Engineer for the pur-
poses of this by-law, and until such appointment the said word
"Engineer" shall mean the person holding the office of En-
gineer for the time being of the said Council.

The following are the rates, terms, and conditions at and
under which the Council will supply water for the under-men-
tioned purposes:-

  1. That the price for water for strictly domestic purposes for
    each building shall be ten shillings (10s.) per annum, and the
    Council reserves the right to determine in any case what shall
    be considered a supply for strictly domestic purposes.

  2. All machines using water continuously shall be charged
    at the rate of three pounds (£3) per sluice-head per week, and
    take precedence of all other machines, except the Queen of
    Beauty pump, during continuance of the present arrangement
    with the Company; and no deduction will be allowed for any
    stoppage of any battery, tailing plant, or other machinery, un-
    less the same be caused from drought, accident to the race, or
    from any cause controlled by the Council.

  3. All machinery not included in the foregoing clause, and
    using water occasionally, shall be charged at the rate of three
    pounds ten shillings (£3 10s.) per sluice-head per week during
    the time they use it, and the owner or owners shall make an
    application in writing when water is so required, stating for
    how long it will be taken and the quantity required; and, in the
    event of there being more applicants than the race can supply
    with water, prior applications will have preference.

  4. Any surplus water in the Karaka and Hape Creeks shall
    be charged at the rate of two pounds ten shillings (£2 10s.) per
    sluice-head per week to consumers.

  5. For ventilating mines, and for purposes not herein speci-
    fied, at rates to be agreed on by special arrangements with the
    Council.

  6. A sluice-head of water shall mean a stream of water
    capable of discharging 60 cubic feet of water per minute, and
    all parties using water from the race which is to be paid for by
    measurement shall provide and fix proper gauge-boxes for the
    measurement of the water used, in accordance with "The
    Mines Act, 1867;" and that such gauge-boxes shall at all times
    be kept in good order and condition for the measurement of the
    water at any time the Engineer may think fit, and at the
    expense of the parties using the water.

  7. All parties using the water from the race shall make due
    provision for carrying away and disposing of the water so used.

  8. The Council reserves the absolute right, without any
    compensation, at any time by day or night to stop the water
    of the race, either wholly or partially, for the purpose of repairs
    or cleaning, or in the event of any accident occurring to any
    part of the race.

  9. Every person supplied with water from the waterworks
    shall provide such proper taps, stop-cocks, and other apparatus
    as the Engineer may require, and shall keep the same in good
    order and repair, so as to prevent the water running to waste;
    and in default of providing or keeping in repair any such
    apparatus, the Engineer may stop the supply of water to such
    person in any manner he thinks fit.

  10. The Engineer, or any other person acting under his
    authority, may, between the hours of 8 o'clock in the fore-
    noon and 6 o'clock in the afternoon of any day (except Sunday),
    enter upon any land or into any dwelling supplied with water
    from the waterworks, to see if such water is being wasted or
    misused, and if such person is refused admittance or obstructed
    in such examination, the Engineer, or such other person, may
    stop the supply of water in any manner he thinks fit.

  11. Any person may remove any pipe or other apparatus
    belonging to him connected with the waterworks, after giving
    to the Council fourteen days' notice in writing of such his
    intention, and of the time of such removal, or shall be liable for
    all damage done to any part of the waterworks thereby; and if
    any person removes any such pipes or apparatus without giving
    such notice he shall be liable to a penalty of not more than five
    pounds sterling (£5), and to pay for all damage done to the
    waterworks by such removal.

  12. No person, corporation, or society shall use or apply the
    water in or to any machinery or implements which in the
    opinion of the Engineer (who shall be the sole judge in the
    matter) may be injurious to the mains or connections, or any
    other part of the waterworks; and upon any breach thereof the
    Engineer may at once, and without notice, stop or cut off the
    water from such machinery or implements.

  13. The County Council claim the sole right to all the water
    at the tail-race of any water-wheel, turbine, or other engine
    supplied from the race, and may trap and convey the same by
    conduit or flume to any other plant on the field, and charge for
    the same as if delivered from the race, reservoir, or mains.

  14. All applications for water shall be made at the County
    offices, where the necessary forms can be obtained.

  15. All connections for supply shall be made at the cost of
    the applicants, and to the satisfaction of the Engineer or such
    other person the Council may appoint; and no person shall
