Governor in Council, and proclaimed in the Government Gazette
twenty-one days at least before the time so fixed respectively:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, by and with the advice and consent of the
Executive Council of the said colony, doth hereby fix that a
sitting of the Court of Appeal of New Zealand shall be held
within the Supreme Courthouse, in the City of Wellington,
upon Wednesday, the sixteenth day of May, one thousand eight
hundred and eighty-three, at eleven o'clock in the forenoon.

Regulations for Thermal-Springs Special Licensing District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this second day of
April, 1883.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN exercise and pursuance of the powers and authorities con-
ferred upon him by "The Licensing Act, 1881," and of all
other powers and authorities enabling him in this behalf,
His Excellency Sir William Francis Drummond Jervois, the
Governor of the Colony of New Zealand, acting by and with the
advice and consent of the Executive Council of the said colony,
doth hereby make and frame the regulations following for the
administration of the said Act within the special district known
as the Thermal-Springs Special Licensing District.

REGULATIONS.

  1. THE several expressions used throughout these regulations
    shall be read, so far as practicable, as defined by "The Licensing
    Act, 1881."

  2. Licenses may be issued for the sale of alcoholic liquors
    within the Thermal-Springs Special Licensing District upon
    payment of a fee of £25; and all such licenses shall be made
    to expire on the 30th day of June next following the date of
    granting the same: Provided that in the case of any license
    issued subsequently to the date of this Order in Council and
    prior to the 30th June, 1883, the fee payable in respect of such
    license shall be such proportionate part of the said sum of £25
    as the period for which such license has to run bears to the
    whole year.

  3. The house and premises in respect of which any such
    license shall be granted shall not be open before 6 o'clock in the
    morning, and shall be closed at 10 p.m. every night: Provided
    that upon payment by the licensee of an additional fee of £5
    an extension of time for the sale of liquors until 11 or 12 o'clock
    at night may (in the discretion of the person or persons for the
    time being authorized to grant licenses) be granted. Any such
    extension of time shall be indorsed on the certificate and license
    respectively.

The restrictions in this regulation contained shall not apply
to the supply of refreshments to bond fide travellers or to
lodgers in the said premises.

  1. No such licensed house or premises shall be open for the
    sale of alcoholic liquors on Sundays, except for the supply of
    refreshments to bonâ fide travellers or to lodgers in the said
    premises.

  2. The accommodation to be provided in respect of any house
    or premises for which a license shall be applied for hereunder
    shall be such as shall be approved by the person or persons
    authorized to grant such license.

  3. Applications for licenses must be in writing, addressed to
    the person or persons empowered to grant the same, and must
    specify the exact locality for which the license is asked, the
    accommodation provided or to be provided for the public, and
    the hours during which it is proposed such house or premises
    shall be open.

  4. All the provisions of "The Licensing Act, 1881," which
    are repugnant to any of the foregoing regulations are hereby
    excluded from operation within the said Thermal-Springs
    Special Licensing District.

Making Regulations for the Management of the Pukeroa
Recreation Reserve.

ORDER IN COUNCIL.

At the Government House, at Wellington, this second day of
April, 1883.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS under the provisions of "The Thermal-Springs
Districts Act, 1881," a block of land known as the

Pukeroa Recreation Reserve has been set apart and dedicated
as a public park or domain: And whereas by the said Act it
is further provided that, by Order in Council, the Governor
may from time to time make and enforce orders and regulations
for the management, preservation, disposition, and care of land
so set apart as aforesaid, and it is expedient to make and enforce
orders and regulations for the purposes aforesaid:
Now, therefore, His Excellency the Governor, in pursuance
and exercise of the power and authority conferred upon him
by the hereinbefore in part recited Act, and by and with the
advice and consent of the Executive Council of the Colony of
New Zealand, doth hereby make the following regulations:—

  1. The said public park or domain so set apart as aforesaid
    shall be managed and administered by the Board of Manage-
    ment of the Town of Rotorua, constituted under "The Ther-
    mal-Springs Districts Act, 1881." (hereinafter called "the
    Board), as a public park or domain.
  2. Any person who shall, without the written consent or
    license of the Board, do or attempt to do any of the following
    things upon or within the boundaries of the said park or
    domain, —
    (1.) Light a fire;
    (2.) Wilfully break a fence or any part of a fence;
    (3.) Wilfully break or cut a tree or plant;
    (4.) Wilfully dig or cut the sod;
    (5.) Wilfully take away any wood, shrub, plant, or other
    thing;
    (6.) Set up, erect, or place any structure, erection, tent,
    or building of any kind or description within the boun-
    daries of the said public park or domain, or use or
    occupy any such structure, erection, tent, or building, —
    shall be liable to a penalty not exceeding the penalty prescribed
    by these regulations.
  3. These regulations shall be painted on boards, or printed
    on paper and pasted on boards, and hung up or affixed and con-
    tinued at one or more of the principal entrances into the
    domain, so as to give notice thereof to the public; and such
    boards shall from time to time be renewed as often as the by-
    laws thereon or any part thereof shall be obliterated or destroyed.
    Such regulations, when so published and affixed, shall be bind-
    ing upon and be observed by all persons, and shall be sufficient
    to justify all persons acting under the same; and for proof of
    the making, publication, and affixing of such regulations it
    shall be sufficient to prove that a printed copy or painted board
    containing a copy of such regulations was affixed and con-
    tinued in manner by this regulation directed; and, in case of
    its being afterwards displaced or damaged, then that such paper
    or board was replaced as soon as conveniently might be.
  4. Any person committing a breach of or offending against
    any of these orders or regulations shall be subject to a penalty
    not exceeding five pounds.

Public Domains Act, 1881."

ORDER IN COUNCIL.

At the Government House, at Wellington, this second day of
April, 1883.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

BY virtue of the powers and authorities vested in me by the
twenty-fourth section of "The Public Reserves Act, 1881,"
I, William Francis Drummond Jervois, the Governor of the
Colony of New Zealand, by and with the advice and consent of
the Executive Council of the said colony, do hereby order and
declare that the reserves made for public recreation in the
Provincial District of Auckland, and known as the Opotiki and
Waioeka Recreation-grounds, and described in the Schedule bereto,
shall be and the same are hereby brought under the operation of
and declared to be subject to the provisions of "The Public
Domains Act, 1881;" and such domains shall hereafter be
managed, administered, and dealt with in manner directed by
the said Acts.

SCHEDULE.

ALL that piece or parcel of land called or known as Lots 168,
169, 170, 171, 172, 173, 174, 175, 176, 177, 207, 208, 209, 210
211, 212, 213, 214, 215, and 216 of Section No. 1, Town of
Opotiki, Parish of Waioeka, Block III., Opotiki Survey District,
Provincial District of Auckland, and containing by admeasure-
ment 5 acres, more or less. Bounded towards the North by
Victoria Street, 1000 links; thence towards the East by John
Street, 500 links; thence towards the South by Princess Street,
1000 links; thence towards the West by Church Street, 500
links, to the point of commencement: be all the aforesaid
inkages more or less.
