By-laws made by the Newmarket Road Board, County of Eden.

THE following by-laws, made by the Newmarket Road Board, are published in accordance with “The Road Boards Act, 1883.”

By-Laws Nos. 1 and 2 of the Newmarket Road Board, acting as the Local Board of Health, adopted by the Board at a Meeting held on the 24th Day of September, 1883.

Each and every occupier of any premises in the Newmarket Road District shall cleanse every earthcloset belonging to such premises at intervals of not more than fourteen days.

Each and every occupier of any premises in the said road district shall, at intervals of not more than seven days, remove or cause to be removed from the said premises all filth, dust, ashes, and rubbish.
And if any such occupier shall allow any such earthcloset to remain uncleaned for any period exceeding fourteen days, or shall not within seven days remove or cause to be removed from the said premises all such filth, dust, ashes, and rubbish, then and in any or either of such cases such occupier shall be deemed guilty of an offence against Part II. of “An Act to amend the Law relating to Public Health,” 1876, and shall be liable for any costs or expenses to be incurred for remedying such default, as particularly provided for in said Part II. of said Act, and to a penalty of not exceeding the sum of ten pounds.
The above by-laws were this day passed by the Newmarket Road Board, acting as the Local Board of Health.

COUNTY OF WAITAKI.—BY-LAW No. 5.
A By-law to regulate the Width of Tires, &c.
SPECIAL ORDER made by the Waitaki County Council.
IN pursuance of the provisions of “The Counties Act, 1882,” the Council of the County of Waitaki doth hereby order as follows; that is to say,—

On and after the gazetting of this by-law the width of the tires of all the wheels of every vehicle drawn on any of the county roads by five or more than five horses shall be not less than six inches; and any person offending against the provisions of this section shall be liable to a penalty not exceeding ten pounds.

It shall be lawful for any member of the Waitaki County County, or for any person acting under the authority of the Council, or for any policeman or constable, to examine and measure the width of the tires of the wheels of any vehicle, cart, dray, wain, wagon, or other carriage affected by the first section of this by-law; and every owner or driver of any such cart, dray, wain, or wagon, or other carriage, after such measuring and examination shall have been lawfully required, refusing to permit such examination and measuring, or turning or driving out of the road in order to hinder, evade, or avoid such examination and measuring, or in any way hindering or obstructing the same, shall, for every offence, be liable to a penalty not exceeding five pounds.

Nothing herein contained shall apply to any vehicle upon springs used exclusively for carrying passengers or other persons and their luggage, or for the carriage of Her Majesty’s mails, or for the conveyance of any piece of heavy machinery which cannot be taken apart without great expense, loss, or inconvenience.

Every vehicle carrying, or constructed to carry, goods or merchandise of any kind whatsoever for hire, and every vehicle carrying passengers for hire, in actual use on any county road shall have the Christian name and the surname and place of abode of the owner thereof painted on some conspicuous part on the off-side thereof in white letters on a black ground, such letters not being less than one inch in length and of a proportionate breadth; and the owner of any such vehicle who shall neglect to have such name and place of abode painted as aforesaid, or who shall have the same so painted incorrectly, shall forfeit and pay for every such offence a sum of not less than five shillings nor more than five pounds: Provided that for every day that any such vehicle shall continue to be used as aforesaid and to have the name and abode unpainted or incorrectly painted as aforesaid, the owner thereof shall be deemed to have committed a fresh offence.

Every penalty imposed by this by-law shall and may be recovered in a summary way.
Made by the Council of the County of Waitaki, at the chambers of the said Council, in the Town of Oamaru, this 26th day of September, 1883.
