the provisions of this Act: And whereas the land
described in the Schedule hereto is required to be
taken for the said portion of the branch line of rail-
way from the Washdyke to Opawa, Fairlie Creek,
and Burke's Pass (Hurunui-Waitaki Railway):
Now, therefore, I, James Prendergast, the Adminis-
trator of the Government of the Colony of New
Zealand, in exercise of the powers and authorities
conferred by sections one hundred and thirty and
two hundred and twenty-nine of "The Public Works
Act, 1882," and of every other power and authority
in anywise enabling me in that behalf, do hereby
proclaim and declare that the land described in the
Schedule hereto is taken for the said portion of the
branch line of railway herein last above named.
SCHEDULE.
ALL that piece or parcel of land containing by ad-
measurement 12 perches, being portion of Section
No. 11596, commencing at a point on the north
bank of the River Opawa with its intersection with
the western boundary of public road. Bounded as
follows: Southerly by the Opawa River, 32 links;
South-westerly by a line, 429 links; North-easterly by
lines, 364 and 69 links respectively; Southerly by the
Opawa River to commencing point, 26 links.
All that piece or parcel of land containing by ad-
measurement 1 rood 13 perches, being portion of
Section No. 11596, commencing at a point on the
eastern boundary-line of public road 1950 links dis-
tant from its intersection with the north bank of the
Opawa River. Bounded as follows: Easterly by a
line, 940 links; generally Westerly by public road,
640 and 313 links respectively.
All that piece or parcel of land containing by ad-
measurement 6 acres 1 rood 16 perches, being portion
of Section No. 11593, commencing at a point on the
eastern boundary of main road 807 links from its
westernmost corner. Bounded as follows; Easterly
by lines, 209, 1909, 521, 870, and 881 links respec-
tively; North-easterly by the Tengawai River, 390
links; South-westerly by public road to commencing
point, 4625 links.
All the above areas and linkages being either more
or less; the several parcels of land being situate in
the Opawa Survey District, Provincial District of
Canterbury, and are more particularly delineated
upon the plan marked P.W.D. 7855, deposited in the
office of the Minister for Public Works, at Wel-
lington, in the Provincial District of Wellington.
Given under the hand of His Excellency Sir
James Prendergast, Knight, Chief Justice,
the Administrator of the Government of
Her Majesty's Colony of New Zealand
and its Dependencies; and issued under
the Seal of the said Colony, at the
Government House, at Wellington, this
twenty-eighth day of October, in the year
of our Lord one thousand eight hundred
and eighty-two.

A PROCLAMATION.
WHEREAS by a Proclamation issued under the
authority of sections one hundred and twenty-
two, one hundred and twenty-three, and one hundred
and twenty-four of "The Public Works Act, 1876,"
the middle line of a portion of the railway from the
main line (Amberley-Waitaki) to Upper Ashburton,
being one of the railways specified in "The Immigra-
tion and Public Works Appropriation Act, 1878,"
was defined: And whereas pursuant to the one
hundred and twenty-fifth section of "The Public
Works Act, 1876," the Minister for Public Works
has caused to be made and, on the fifth day of May,
one thousand eight hundred and seventy-nine, to be
deposited in the office of the Registrar of the Supreme
Court, at Christchurch, in the Provincial District of
Canterbury, such maps and plans as were necessary
to explain the said portion of the aforesaid line of
railway and the land through which the same passes,
and such maps and plans were referred to in such
Proclamation as aforesaid: And whereas the branch
line of railway from the main line (Hurunui-Waitaki)
to Upper Ashburton is the same railway as that re-
ferred to in the Proclamation hereinabove recited,
and is one of the railways specified in "The Public
Works Act, 1879;" and it is enacted by the Act
last named that such of the railways mentioned
therein as are unfinished may be completed under
the provisions of "The Public Works Act, 1876,"
"The Public Works Act 1876 Amendment Act,
1878," and "The Public Works Act, 1879:" And
whereas the two hundred and twenty-ninth section
of "The Public Works Act, 1882," enacts as
follows: Any public work authorized under the
authority of any Act repealed by this Act, or of any
Act or Ordinance repealed by "The Public Works
Act, 1876," and any land required to be taken,
purchased, or acquired for such work, or anything
commenced under any such authority as aforesaid, may
be continued, taken, purchased, or acquired, executed,
carried out, enforced, and completed under the pro-
visions of this Act: And whereas the land described
in the Schedule hereto is required to be taken for a
part of the said portion of the branch line of railway
from the main line (Hurunui-Waitaki) to Upper
Ashburton (Ashburton Contract):

North-easterly by Section No. 216, 55 links; South-
easterly by a line to commencing point, 58 links.
All that piece or parcel of land containing by ad-
measurement 20 perches, being portion of Section
No. 216, Township of Tinwald, commencing at the
south-westernmost corner of said section. Bounded
as follows: South-westerly by Section No. 215, 55
links; South-easterly by a line, 186 links; North-
easterly by Section No. 217, 197 links; North-west-
erly by a line to commencing point, 82 links.
All that piece or parcel of land containing by ad-
measurement 2 roods, being Sections Nos. 217 and
218, Township of Tinwald, commencing at the south-
westernmost corner of Section No. 217 aforesaid.
Bounded as follows: North-westerly by a line, 200
