"Army Discipline and Regulation Act, 1879."

A PROCLAMATION.

WHEREAS by the forty-fourth section of "The
Militia Act, 1870," it is enacted that, during
the time that any part of the Militia shall be on
actual service, all things contained in any Act of the
Imperial Parliament, which shall then be in force in
New Zealand, for punishing mutiny and desertion,
and for the better payment of the army and their
quarters, and in the Articles of War, made in pur-
suance of such Act, shall apply to, and the powers
thereby created shall be exercised by, such part of
the Militia in all cases not otherwise provided for in
"The Militia Act, 1870," or in any regulations that
may from time to time be issued under its authority:
Provided that no militiaman shall be liable to any
corporal punishment, except death or imprisonment,
for any offence against any such Act of the Imperial
Parliament: Provided also that no such Act of the
Imperial Parliament shall be deemed to be in force
in New Zealand until a Proclamation shall have been
published in the New Zealand Gazette stating that the
Governor has received a copy thereof:

And whereas by the second section of the Act of
the Imperial Parliament intituled "The Army Dis-
cipline and Regulation Act, 1879," it is enacted that
the same shall not come into force except in pur-
suance of an annual Act of Parliament, to be there-
after passed, bringing the same into force, and shall
continue in force only for such time and subject to
such provisions as may be specified in such last-
mentioned Act:

And whereas by the second section of an Act of
the Imperial Parliament intituled "The Army Dis-
cipline and Regulation (Annual) Act, 1880," it is
provided that "The Army Discipline and Regulation
Act, 1879," shall be and remain in force until the
dates therein mentioned; that is to say, as to New
Zealand, from the thirty-first day of December, one
thousand eight hundred and eighty, to the thirty-
first day of December, one thousand eight hundred
and eighty-one:

And whereas I have received a copy of both the
said Acts:

Now, therefore, I, James Prendergast, the Admin-
istrator of the Government of the Colony of New
Zealand, in pursuance of the requirements of "The
Militia Act, 1870," aforesaid, and in exercise of the
powers thereby vested in me, do hereby proclaim
and declare that a copy of each of the said herein-
before in part recited Acts of the Imperial Parlia-
ment has been received by me in the colony aforesaid.

Administrator of the Government of Her
Majesty's Colony of New Zealand; and
issued under the Seal of the said Colony,
at the Government House, at Wellington,
this sixth day of October, in the year of
our Lord one thousand eight hundred

IN pursuance and exercise of the power and au-
thority vested in me by the eighth section of

"The Taranaki Botanic Garden Act, 1876," I, James
Prendergast, the Administrator of the Government
of the Colony of New Zealand, do hereby appoint

THOMAS KINGWELL SKINNER

to be a Member of the Board of Trustees for Public
Recreation, in the room of Thomas Colson, resigned.

and issued under the Seal of the said
Colony, at the Government House, at

Proclaiming Patea a Borough under "The Municipal
Corporations Act, 1876."

A PROCLAMATION.

WHEREAS by section seventeen of "The Muni-
cipal Corporations Act, 1876," the Governor
is empowered, by Proclamation, to declare any district
in New Zealand to be a borough under the said Act,
from and after a day to be named in such Proclama-
tion:

Now, therefore, I, James Prendergast, the Admin-
istrator of the Government of the Colony of New
Zealand, in pursuance and exercise of the power and
authority vested in me by the said Act, do hereby
proclaim and declare that the district described in
the Schedule hereto shall be and the same is hereby
constituted, as from the thirteenth day of October,
one thousand eight hundred and eighty-one, a
borough under the said Act, and that the name of
such borough shall be the Borough of Patea, and
that the boundaries of such borough shall be those
described in the Schedule hereto.

SCHEDULE.

ALL that area in the Provincial District of Taranaki,
containing by admeasurement 1,420 acres, more or
less. Bounded towards the North-east by the Patea
River; towards the South-west by the ocean to a
point at which the production of the north-western
boundary line of Suburban Allotment No. 55 inter-
sects high-water mark; thence towards the North-
west and North by a right line to the most westerly
corner of said allotment, by Allotments Nos. 56 and
17, and by a road-line north-east of Allotments Nos.
18, 9, 6, and 7, and the south-eastern side of that road
produced to the Patea River, the commencing point.

Given under the hand of His Excellency Sir
James Prendergast, Chief Justice, the
Administrator of the Government of Her
Majesty's Colony of New Zealand; and
issued under the Seal of the said Colony,
at the Government House, at Wellington,
this thirteenth day of October, in the year
of our Lord one thousand eight hundred
