  1. Each applicant shall deposit one-tenth of the
    purchase-money with the Receiver of Land Revenue
    for Canterbury, which deposit shall be deemed to be
    a discharge of the license-fee due on the first day of
    July next, but in the case of the sections which
    are to be submitted to auction, the person who is
    declared the purchaser of the land shall forthwith
    pay to the Receiver of Land Revenue, in addition to
    the sum he has deposited, an amount equal to one-
    tenth of the increased price obtained for the land at
    auction over the upset price thereof.

  2. The purchaser of any lands described in the
    Schedule hereto, upon the full payment of the pur-
    chase-money, and also the fulfilment of the terms
    and conditions prescribed by "The Land Act, 1877,"
    and "The Land Act 1877 Amendment Act, 1879,"
    relating to land on deferred payments, will be
    entitled to his Crown grant, to be issued in the usual
    way upon payment of the fees prescribed by law.

SCHEDULE.

ALL that parcel of land in the Geraldine Survey
District, Provincial District of Canterbury, con-
taining 577 acres, more or less, being portions of
Reserves 349 and 1650. Bounded-Northward by the
road running through Trig. Station G 12; Southward
by the road north-west of Lot 41 of Reserve 1650;
Westward by the Orari River; and Eastward by a
road-line.

Making Provision for Election of Mayor of Borough
of Queenstown.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
fifth day of April, 1881.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS on the twenty-fourth day of Novem-
ber, one thousand eight hundred and eighty-one,
Frederick Henry Daniel was, after a poll of the bur-
gesses of the Borough of Queenstown, in the County
of Lake, declared to be duly elected as Mayor of the
said borough: And whereas, in accordance with the
provisions of "The Regulations of Local Elections
Act, 1876,"
the said election was, on the eighteenth
day of January, one thousand eight hundred and
eighty-one, declared by the Resident Magistrate hold-
ing inquiry as by the said Act provided to be void:
And whereas, therefore, from such said eighteenth
day of January, one thousand eight hundred and
eighty-one, there was an extraordinary vacancy in the
said office of Mayor within the meaning of the forty-
sixth section of the said Act: And whereas the
Returning Officer of the said borough failed to
appoint a day for the election to fill such vacancy
within the time prescribed by the said forty-sixth
section: And whereas, owing to such failure by the
said Returning Officer, no election has yet been held,
and there is no power to hold the same except as is
hereinafter provided, and no sufficient provision is
made by the said Act or by "The Municipal Corpora-
tions Act, 1876,"
or any amendment thereof, for such
a case: And whereas by the twelfth section of "The
Municipal Corporations Act, 1876,"
it is provided

(inter alia) that in any case in which no sufficient
provision is made by that Act the Governor may, by
Order in Council gazetted and publicly notified from
time to time, make provision for any such case:

And whereas, therefore, it is desirable that provision
should be made for the case of the election of the
Mayor of the said Borough of Queenstown, as is
hereinafter done:

Now, therefore, His Excellency the Governor of
the Colony of New Zealand, in pursuance and in
exercise of the powers vested in him by the said
twelfth section of "The Municipal Corporations Act,
1876,"
and of all other powers in anywise enabling
him in that behalf, doth, with the advice and consent
of the Executive Council of the Colony of New Zea-
land, hereby order that the Returning Officer for the
Borough of Queenstown may, by public notice, appoint
a day, not less than twenty nor more than twenty-five
clear days from the gazetting of this Order in Council,
for the holding of an election for the office of Mayor
of the said borough, notwithstanding that the period
provided by the forty-sixth section of the said "Regu-
lation of Local Elections Act, 1876,"
has expired, but
so that such election shall be conducted in all respects
as if the same had been held within the said period.

HIS Excellency the Governor of the Colony of
New Zealand, in pursuance and exercise of the
powers vested in the Governor by "The Electric
Telegraph Act, 1875,"
and of all other powers en-
abling him in that behalf, doth, with the advice and
consent of the Executive Council of New Zealand,
hereby make the regulation contained in the Schedule
hereto.

SCHEDULE.

ALL telegrams despatched to or forwarded from the
under-mentioned stations shall be exempt from the
extra charge of sixpence on each telegram, imposed
by Order in Council dated the 30th day of October,
1880.
