Land set apart on Deferred Payments in Hawke's
Bay.

A PROCLAMATION.

WHEREAS by the fifty-third section of "The
Land Act, 1877," it is enacted that the
Governor, by Proclamation in the Gazette, may from
time to time set apart out of any suburban or rural
lands such blocks or allotments of land as he shall
think fit, and set the same aside for sale on deferred
payments, and in such Proclamation may fix a day
on which the land shall be open for application; and
that he may also in like manner set apart for sale on
deferred payments such blocks or allotments as may
be recommended by any Land Board, and may also
from time to time alter, amend, or revoke any such
Proclamation:

And whereas the Land Board of Hawke's Bay did,
on the twenty-fifth day of February, one thousand
eight hundred and eighty-one, pass a resolution recom-
mending that the land described in the Schedule
hereto annexed should be set apart for sale on
deferred payments:

And whereas it is expedient to give effect to the
aforesaid recommendation, and to set apart the said
land accordingly:

Now, therefore, I, Arthur Hamilton Gordon, the
Governor of the Colony of New Zealand, in pur-
suance and exercise of the power and authority
vested in me by the above-named Act, do hereby
proclaim and declare that the land described in the
Schedule hereto is set apart for sale on deferred pay-
ments; and that Thursday, the nineteenth day of
May, one thousand eight hundred and eighty-one,
shall be the day on which the said land shall be open
for application at the Land Office at Napier, in
allotments as surveyed and marked on the selection
maps in that office.

In pursuance of section four of "The Land Act
1877 Amendment Act, 1879," I do hereby declare
that subsection four of the sixty-third section of
"The Land Act, 1877," shall not apply to any of the
lands described in the Schedule hereto.

And, further, in pursuance of the fifth section of
"The Land Act 1877 Amendment Act, 1879," I do
hereby fix the price at which the land so described
shall be sold to be the price set opposite each allot-
ment in the Schedule hereto.

Zealand and its Dependencies, and Vice-
Admiral of the same; and issued under
the Seal of the said Colony, at Welling-
ton, this seventh day of April, in the
year of our Lord one thousand eight
hundred and eighty-one.

Terms and Conditions of Sale of the Orari Village
Settlement in Canterbury.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
fifth day of April, 1881:

Present:

His Excellency THE GOVERNOR IN COUNCIL.

WHEREAS by "The Public Reserves Sale Act,
1878," it is, amongst other things, enacted that
the lands described in the Schedule thereto may, at
any time after the passing of the said Act, be sold by
the Governor, upon such terms as shall be regulated
by Order in Council:

And whereas the lands described in the Schedule
hereto are required to be sold upon deferred pay-
ments, and it is expedient that the terms of such sale
should be defined:

And whereas by the twenty-first section of "The
Land Act 1877 Amendment Act, 1879," it is enacted
that the Governor in Council may fix the terms and
conditions upon which the lands comprised in any
village settlement shall be disposed of, and the mode
of payment for the same:

Now, therefore, His Excellency the Governor of
the Colony of New Zealand, by and with the advice
and consent of the Executive Council of the said
colony, and in exercise of the powers and authorities
aforesaid, doth hereby order and direct that the land
described in the Schedule hereto shall be sold upon
the following terms, that is to say,—

  1. The land described in the Schedule hereto shall
    be set apart for sale as a village settlement upon
    deferred payments, in allotments as shown in the
    official subdivision plan in the Survey Office, Christ-
    church.

  2. The land described in the Schedule hereto shall
    be subject to the provisions of Part III. of "The
    Land Act, 1877," relating to suburban lands, and to
    the provisions of section nine of "The Land Act
    1877 Amendment Act, 1879."

  3. The land described in the Schedule hereto shall
    be open for application on Monday, the ninth day of
    May, one thousand eight hundred and eighty-one, at
    the Survey Offices at Christchurch and Timaru.

  4. No person shall be allowed to acquire more
    than one allotment.

  5. The price at which the lands shall be open for
    application is ten pounds per acre.

  6. If two or more persons shall make application
    on the same day for any allotment, the right to
    occupy the same shall be determined by public auc-
    tion, the bidding being restricted to the applicants.

  7. Each applicant will be required to make the
    declaration prescribed by section sixty-two of "The
    Land Act, 1877," before making his selection.
