Authorizing Messrs. Smith and Larnach to build a
Jetty in Otago Harbour.

ORDER IN COUNCIL.
At the Government House, at Wellington, this
twenty-seventh day of July, 1880.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by the sixteenth, seventeenth, and
eighteenth sections of "The Harbours Act,
1878," it is enacted that the Governor in Council may
authorize any person to construct harbour works
(other than the reclamation of land from the sea, or
any harbour, or the construction of any graving dock,
dock, or breakwater in any harbour or in the sea)
in any harbour where no Harbour Board is in exis-
tence: And whereas by the one hundred and fifty-
second section of the said Act it is enacted that,
where it shall appear to the Governor in Council
that any harbour works are required for the use,
benefit, or convenience of the public within a har-
bour under the control of a Harbour Board, and that
such Board cannot conveniently execute or carry out
such works, then, and in any such case, the Governor
in Council may exercise all or any of the powers
vested in him by the said sixteenth, seventeenth, and
eighteenth sections of the said Act:
And whereas James Smith and William James
Mudie Larnach desire to build a jetty in Otago Har-
bour, and the Otago Harbour Board cannot con-
veniently execute or carry out such work; and it
having been made to appear to the Governor in
Council that the said work will not be, or tend, to the
injury of navigation, or interfere with or injure any
harbour works already constructed by the Board or
under its control, or that may be in progress:
Now, therefore, the Governor of the Colony of New
Zealand, by and with the advice and consent of the
Executive Council of the said colony, doth hereby
authorize the said James Smith and William James
Mudie Larnach to build in Otago Harbour, for the use
and benefit of the public, a jetty, in accordance with
the plan and specification marked M.D. 400, and in
the position shown on the plan marked M.D. 401,
which plans are deposited in the office of the Marine
Department, on the following conditions, that is to
say,-
That the right hereby conferred shall not exceed
the period of ten years, at which time the right shall
absolutely cease without payment of any compensa-
tion whatever.
That it shall be lawful for the said James Smith
and William James Mudie Larnach to levy wharfage
on all vessels coming alongside the said jetty at a
rate not exceeding one farthing per registered ton
per diem: Provided, however, that nothing herein
contained shall authorize the said James Smith and
William James Mudie Larnach to charge with wharf-
age any vessel the property of the Otago Harbour
Board.
The rights and powers conferred under or by this
Order in Council may be resumed at any time by the
Governor on giving to the said James Smith and
William James Mudie Larnach six months' previous
notice of his intention so to do.

Frasertown Recreation-ground brought under "The
Public Domains Act, 1860."

ORDER IN COUNCIL.
At the Government House, at Wellington, this
twenty-seventh day of July, 1880.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
BY virtue of the powers and authorities vested in
me by the eleventh section of "The Public
Reserves Act, 1877," I, Sir Hercules George Robert
Robinson, Governor of the Colony of New Zealand,
by and with the advice and consent of the Executive
Council of the said colony, do hereby order and
declare that the reserve made for public recreation in
the Provincial District of Auckland, and known as
the Frasertown Recreation-ground, and described
in the Schedule hereto, shall be and the same is
hereby brought under the operation of and declared
to be subject to the provisions of "The Public
Domains Act, 1860," and its amending Acts; and
such domain shall hereafter be managed, administered,
and dealt with in manner directed by the said Acts.
SCHEDULE.
ALL that piece or parcel of land containing by ad-
measurement 31 acres 2 roods 14 perches, more or
less, being Lot 152, Town of Frasertown, Wairoa,
Taramarama Survey District, Provincial District of
Auckland. Bounded towards the North-east by a
street, 1250 links; towards the South-east by a
street, 2436 links; towards the South by a street,
1260 links; and towards the North-west by a street,
2598 links: be all the aforesaid linkages more or
less.

ORDER IN COUNCIL.
At the Government House, at Wellington, this
twenty-seventh day of July, 1880.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by the eleventh section of "The
Public Domains Act, 1860," it is enacted that
the Governor, by Order in Council, may from time
to time delegate all or any of the powers by the said
Act conferred upon any person for any period, and
subject to such stipulations as may be specified in
such order, and that every such delegation may from
time to time in like manner be altered or revoked:
And whereas it is enacted by "The Public Domains
Act, 1865," that the word "person" in the herein-
before recited section of "The Public Domains Act,
1860," shall be deemed to include more persons than
one: And whereas pursuant to "The Public Re-
serves Act, 1877," by an Order in Council of even
date herewith, the land described in the Schedule
thereto is declared to be brought under and to be
subject to the said "Public Domains Act, 1860:"
Now, therefore, His Excellency the Governor, by
and with the advice and consent of the Executive
Council of the Colony of New Zealand, doth, by this
present order, delegate all the powers conferred by
the Act first above mentioned, except the powers
under or conferred by subsections five and ten of
section five and section eleven, to the under-mentioned
