BY-LAW NO. 1.
For the Regulation and Management of Licensed
Slaughterhouses in that Portion of the County of
Marlborough lying to the North of the River
Wairau, and for the County of Sounds.
License fee.
- It is ordered, by virtue of the authority in us
vested by "The Slaughterhouses Act, 1877," that,
from and after the approval hereof by the Governor,
the license fee payable by persons licensed to slaughter
great or small cattle shall be ten shillings per annum,
or fractional part of a year, payable in advance. All
licenses shall expire on the 31st day of December in
each year.
New licenses.
2. Applications for new licenses shall be in the
form given in Schedule 1 to this by-law, and shall be
posted or delivered to the Clerk of the nearest Resi-
dent Magistrate's Court in the licensing district at
least five weeks before the day fixed for hearing the
same.
Hearing applications for new licenses.
3. On receipt of the application as aforesaid, the
Resident Magistrate having jurisdiction to hear the
said application shall appoint a time and place for
the hearing thereof, and shall return the application,
with notification of time and place of hearing, to the
applicant: Provided that the date fixed for hearing
the application shall allow the applicant time to ad-
vertise notice as required by section 24 of the said
Act.
Renewal of license.
4. Every applicant for a renewal of a license shall
deposit an application, in writing, in the form given
in Schedule 2 to this by-law, with the Clerk of the
Resident Magistrate's Court at Picton or Havelock
(whichever may be the nearest to his licensed slaugh-
terhouse), at least fourteen clear days before the
sitting of the Court at which such applications for
renewal shall be heard and determined.
No slaughterhouse within three chains of road.
5. After the date of approval of this by-law by
the Governor, no license shall be granted for any
slaughterhouse situated within three chains of any
main or district road used as a public road.
Slaughterhouses kept clean.
6. Every slaughterhouse shall be kept clean to the
satisfaction of the Inspector, who may at all times
give such directions concerning the cleansing thereof
as to him may seem needful. Any persons licensed
under the provisions of the said Act who shall not,
without unnecessary delay, obey the directions of
the Inspector shall be deemed to have committed a
breach of the provisions of this by-law.
Cattle fed and watered.
7. Every slaughterhouse shall, at all times, be pro-
vided with a sufficient supply of fresh water, and all
cattle confined on the premises of any slaughter-
house, or in any yard or enclosure connected there-
with, shall be properly fed and watered at least once
in every twenty-four hours.
Filth removed..
8. The filth shall be removed from every slaughter-
house or yard connected therewith at least once in
every twenty-four hours.
Inspectors to visit slaughterhouses.
9. The Inspectors shall visit all slaughterhouses
in their districts at least once every three months,
where practicable, and not later than the first week
in December in each year they shall furnish a report
in writing to the Resident Magistrate having juris-
diction in their district, stating generally the condi-
tion in which the slaughterhouses in their district
have been kept during the past year.
Fees for cattle slaughtered.
10. The fees payable to Inspectors from all persons
holding licenses under the said Act, or any Act
amending the same, shall be as follows: For every
head of small cattle killed for sale, the sum of one
farthing; and for every head of great cattle killed
for sale, the sum of one penny. Inspectors shall
dispose of all fees received according to any law for
the time being in force.
Persons licensed to furnish reports.
11. Every person licensed under the said Act shall,
with the report required to be forwarded under
section 26 of "The Slaughterhouses Act, 1877," also
send, together with the report to the Inspector, the
amount of fees due for all cattle slaughtered for sale.
All fees must be paid before renewal of license.
12. No license shall be renewed unless the Inspec-
tor reports to the Court to whom application has
been made for renewal that all fees due to the date
of sitting of the said Court have been paid by the
applicant for such renewal.
Licenses not to be transferred.
13. No license shall be transferred. In all cases
of change of ownership of any slaughterhouse during
the current year, the new owner shall make appli-
cation in manner provided for new licenses.
Fine for breach of by-law.
14. For any breach of any of the provisions of this
by-law a fine of not less than five shillings, nor
more than five pounds, shall be inflicted. All such
fines shall be recovered in a summary manner before
a Resident Magistrate or any two Justices of the
Peace having jurisdiction as provided by "The Jus-
tices of the Peace Act, 1866," or any Act amending
the same.
Interpretation.
Wherever in this by-law the words "the said
Act" are used, they shall mean "The Slaughter-
houses Act, 1877," or any Act amending the same.
