Making additional Regulations providing that only one Section in certain Village Settlements shall be acquired by one Person, and that Part III. of the Land Act, relating to Rural and Suburban Lands, shall apply.

At the Government House, at Wellington, this seventh day of July, 1880.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the twenty-first section of “The Land Act 1877 Amendment Act, 1879,” it is enacted that the Governor in Council may fix the terms and conditions upon which the lands comprised in any village settlement shall be disposed of, and the mode of payment for the same: And whereas by Proclamations bearing date the fifteenth day of June, one thousand eight hundred and eighty, certain lands therein described were set apart for sale as village settlements at Hokonui and Menzies Ferry, in the Land District of Southland; at Ormond, in the Land District of Auckland; at Urenui, Tiko-rangi, Huirangi, and Manganui, in the Land District of Taranaki, upon the terms and conditions set forth in certain Orders in Council bearing even date with the Proclamations aforesaid: And whereas it is expedient to add to and amend the terms and conditions upon which the lands in the village settlements aforesaid shall be disposed of:

Now, therefore, His Excellency the Governor, in pursuance and exercise of the powers and authorities conferred upon him by the hereinbefore in part recited Act, and by and with the advice of the Executive Council of the Colony of New Zealand, doth hereby make the following additions to and alterations in the terms and conditions as set forth in the aforesaid Orders in Council of the fifteenth day of June, one thousand eight hundred and eighty, upon which the said village-settlement lands shall be disposed of, that is to say,—

No person shall be allowed to acquire more than one section, upon either immediate or deferred payments, in any or either of the village settlements aforesaid.

The lands to be sold upon deferred payments in the Village Settlements of Hokonui and Menzies Ferry shall be disposed of subject to the provisions of Part III. of “The Land Act, 1877,” that is to say, all sections not exceeding twenty acres shall be sold subject to the terms and conditions relating to suburban land, and all sections above an area of twenty acres shall be sold subject to the provisions of the said Act relating to rural land.

The lands to be sold upon deferred payments in the Village Settlement of Ormond shall be disposed of subject to the provisions relating to suburban land of Part III. of “The Land Act, 1877,” and not to the provisions of Part III. of the said Act relating to rural land, as set forth in the Order in Council aforesaid.

Authorizing T. Carina to build a Wharf in Whitianga Harbour.

ORDER IN COUNCIL.
At the Government House, at Wellington, this seventh day of June, 1880.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the sixteenth, seventeenth, and eighteenth sections of “The Harbours Act, 1878,” it is enacted that the Governor in Council may authorize any person to construct harbour works (other than the reclamation of land from the sea or any harbour, or the construction of any graving dock, dock, or breakwater in any harbour or in the sea) in any harbour where no Harbour Board is in existence: And whereas Thomas Carina, of the Whitianga Hotel, Whitianga, Mercury Bay, desires to build a wharf in Whitianga Harbour, Mercury Bay, a place where no Harbour Board is in existence; and it having been made to appear to the Governor in Council that the said work will not be, or tend, to the injury of navigation:

Now, therefore, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby authorize the said Thomas Carina to build, for the use and benefit of the public, a wharf in Whiti-anga Harbour, Mercury Bay, in accordance with the plan marked M.D. 390, and deposited in the office of the Marine Department, on the following conditions, that is to say,—

That the right hereby conferred shall not exceed the period of fourteen years.

That the said wharf shall be at all times kept in a thorough state of repair.

That the said Thomas Carina shall cause the said wharf to be removed at any time, on receiving six months’ notice to that effect from the Governor; no compensation whatever being paid to him.

That the rights and powers conferred under or by this Order in Council may be resumed at any time by the Governor, on giving to the said Thomas Carina six months’ previous notice of his intention so to do, without payment of any compensation whatever.

Authorizing the Union Steam-saw Moulding, Sash, and Door Company (Limited) to build Two Wharves at Aratapu, Wairoa River, Kaipara.

At the Government House, at Wellington, this seventh day of June, 1880.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

And whereas the Union Steam-saw Moulding, Sash, and Door Company (Limited) (hereinafter referred to as “the Company”), desires to build two wharves at Kaipara Harbour, a port where no Harbour Board is in existence; and it having been made to appear to the Governor in Council that the said works will not be, or tend, to the injury of navigation:

Now, therefore, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby authorize the Company to build at Aratapu, on the Wairoa River, Kaipara, for the use and benefit of the public, two wharves in accordance with the plans marked M.D. 380 and 381, and deposited in the office of the Marine Department, on the following conditions, that is to say,—
