Changing the Purpose of a Reserve.

thousand eight hundred and seventy-nine, under the
eighty-fifth section of "The Public Revenues Act,
1878," and published in the New Zealand Gazette
No. 67, of the nineteenth day of June, one thousand
eight hundred and seventy-nine, should be added to:

Now, therefore, His Excellency Sir Hercules
George Robert Robinson, the Governor of the Colony
of New Zealand, in exercise and pursuance of the
powers and authorities conferred upon him by the
said eighty-fifth section of "The Public Revenues
Act, 1878," and by and with the advice and consent
of the Executive Council of the said colony, doth
hereby make the additional regulation contained in
the Schedule hereto; and, with the like advice and
consent, His Excellency the Governor as aforesaid
doth hereby order that this present Order in Council,
and the additional regulation hereby made, shall come
into force from and after the first day of July, one
thousand eight hundred and seventy nine.

SCHEDULE.

  1. In clauses 3, 6, 26, 48, and 46 the expression
    "Under Secretary;" in clauses 17, 19, 21, 23, 36,
    and 38, the expression "Under Secretary or per-
    manent head;" in clause 31 the expression "per-
    manent head;" and in clause 48 the expression
    "heads of departments," shall, so far as relates to
    the Public Works Department, be construed to mean,
    in the North Island, "the Engineer in Charge for the
    North Island," and, in the Middle Island, "the
    Engineer in Charge for the Middle Island."

Land temporarily reserved in the Provincial District
of Otago.

HERCULES ROBINSON, Governor.

WHEREAS by the one hundred and forty-fourth
section of "The Land Act, 1877," it is enacted
that the Governor may from time to time, either by
general or particular description, and whether the
same has been surveyed or not, reserve from sale
temporarily, notwithstanding that the same may be
then held under pastoral license, any Crown lands
which in his opinion are required for any of the pur-
poses in the said section mentioned:

Now, therefore, I, Sir Hercules George Robert
Robinson, the Governor of the Colony of New Zea-
land, in exercise and pursuance of the powers and
authorities vested in me by the said Act, do hereby
temporarily reserve from sale the land in the Pro-
vincial District of Otago described in the Schedule
hereunder written, for the purpose in the said Sche-
dule specified.

SCHEDULE.

ALL that area in the Provincial District of Otago,
containing by admeasurement two (2) roods, more
or less, situated in the Township of Hyde, being
Sections numbered respectively 3 and 4, Block II.,
on the map of the said township. Bounded towards
the North-east by Eton Street, two hundred (200)
links; towards the South-east by Section 5, two
hundred and fifty (250) links; towards the South-
west by Sections 25 and 26, two hundred (200) links;
and towards the North-west by Section numbered 2,
two hundred and fifty (250) links: as the same is
delineated on the plan in the Chief Surveyor's Office,
Dunedin. As a site for athenæum buildings.

As witness the hand of His Excellency the
Governor, this eleventh day of June, one
thousand eight hundred and seventy-nine.

WHEREAS by "The Public Reserves Act Amend-
ment Act, 1878," it is, amongst other things,
enacted that the Governor may declare his intention
to make, change, exchange, or alter the dedication of
any public reserve now or hereafter vested in Her
Majesty or the Governor for any of the purposes
named in Part II. of the Schedule to the said Act,
whether the same be granted or not; and, in the case
of any reserves made under the authority of section
one hundred and forty-four of "The Land Act,
1877," if it shall, in the opinion of the Governor, be
expedient to change the purpose of such reserves or
any part thereof from the purpose or presumed pur-
pose for which it was set apart to any other purpose,
or if it shall, in the opinion of the Governor, be
expedient to exchange any of the land comprised in
such reserve for other land of equal value, to be
dedicated to one or more purposes named in the said
Part II., the Governor may, by notice in the Gazette,
declare his intention to make such change, exchange,
or dedication, as the case may be, and in such notice
declare the manner and terms in which the same is
intended to be so made:

Now, therefore, I, Sir Hercules George Robert
Robinson, the Governor of the Colony of New Zea-
land, do hereby, in exercise and pursuance of the
powers and authorities vested in me by "The Public
Reserves Act Amendment Act, 1878," aforesaid,
change the specific purposes of the reserves described
in the first column of the said Schedule hereto to the
specific purpose set opposite such description in the
second column of the said Schedule, and such land
shall henceforth be deemed to be reserved and set
apart for such last-mentioned specific purpose, and
no other.
