Defining the Middle Line of portion of the Railway
from Kaipara through Riverhead to Auckland (Wai-
takerei Contract).

A PROCLAMATION.

WHEREAS by the one hundred and twenty-
second section of "The Public Works Act,
1876," it is enacted that every railway shall be made
only under the authority of a special Act, which
shall state as nearly as may be the line of the railway
and the two termini thereof; and by the one hundred
and twenty-third section of the same Act, that the
several railways specified in the fourth schedule to
the said Act shall be deemed to have been made, and
in so far as any of them are unfinished may be com-
pleted, under the provisions of the Act now under
recital, and the said Act shall be deemed to be a
special Act authorizing the construction of each of
the said railways; and by the one hundred and
twenty-fourth section of the same Act, that when any
railway is to be constructed under the provisions of
any special Act the Governor shall issue a proclama-
tion defining the middle line of the railway or any
part thereof, and may from time to time, by a pro-
clamation revoking or amending such former pro-
clamation, alter such line in any manner or to any
extent which may be found necessary for the con-
struction of such railway within the provisions of the
said special Act; and by the one hundred and
twenty-fifth section of the same Act, that the
Minister shall cause to be made and deposited in the
office of the Registrar of the Supreme Court such
maps and plans as may be necessary to explain the
said line and the land through which the same passes,
and such maps and plans shall be referred to in any
such proclamation; and whereas the railway from
Kaipara through Riverhead to Auckland is one of
the railways specified in the said fourth schedule,
and the same is unfinished, and it has been deter-
mined to construct and maintain a further portion of
such railway:

Now, therefore, I, James Prendergast, Esquire,
Administrator of the Government of the Colony of
New Zealand, in exercise and in pursuance of the
powers and authorities conferred on me by "The
Public Works Act, 1876," and in exercise of every
other power and authority enabling me in that be-
half, do hereby proclaim and declare that the middle
line of the said further portion of said railway shall
be that defined and set forth in the Schedule hereto,
commencing at a point within Lot ninety, Parish
of Waikomiti, and terminating at a point in
Lot nine, of the Taupaki Block number two hundred
and eighty-two, all within the Provincial District of
Auckland, Colony of New Zealand. The said middle
line and the land through which the same passes are
set forth in the map and plan marked P.W.D. 6886
and authenticated for the purposes of this Procla-
mation by the signature of the Honorable James
Macandrew, Minister for Public Works, and which
said map and plan is deposited in the office of the
Registrar of the Supreme Court at Auckland, in the
Provincial District of Auckland.

SCHEDULE.

COMMENCING at a point situate within Lot 90, Parish
of Waikomiti, the said point being the termination of
a portion of the railway from Kaipara through River-
head to Auckland, as described in the Proclamation
dated the 18th April, 1877, and published in the
New Zealand Gazette, No. 35, of the 19th April, 1877,
and proceeding thence in a generally westerly and
northerly direction for a distance of twelve miles
sixty-four chains or thereabouts, passing in, into,
through, or over the following lands, Waikomiti
Highway District, Parish of Waikomiti, Lots 90, 14,
and 2, Waitakerei East Highway District, Parish of
Waipareira, Lots 7, 6, 6A, and 10; Waitakerei West
Highway District, Parish of Waipareira, Lots 25
and 27; Waipareira Highway District, Parish of
Waipareira, Lots 70, 73, 74, and 28; Kaipara Dis-
trict, Parish of Waipareira, Lots 3, 4, 5, 6, 7, 8, and
9 of the Taupaki Block, No. 282 (Native); and
terminating at a point on the Riverhead and Kaipara
Railway within Lot 9 aforesaid, all within the Pro-
vincial District of Auckland, Colony of New Zealand:
including all adjoining and intervening places, Crown
lands, roads, reserves, streams, rivers, and
watercourses, in the manner delineated on the map
and plan marked P.W.D. 6886, signed by the Honor-
able James Macandrew, Minister for Public Works,
