Land authorized to be taken by the Borough of East
Invercargill for the purpose of widening Ritchie
Street.

A. PROCLAMATION.

WHEREAS by "The Municipal Corporations Act,
1876,"
it is enacted that the Council of a
borough constituted under that Act may take any
land within the borough for any of the purposes of
that Act in the manner provided by the Second Part
of "The Public Works Act, 1876" (hereinafter
called "the said Act"): And whereas the Council
of the Borough of East Invercargill, requiring to
take the land described in the Schedule hereto, for
the purpose of widening Ritchie Street, has laid
before me the memorial referred to by section
twenty-five of "The Public Works Act, 1876,"
praying me to declare, by Proclamation, that such
land is taken for such purpose :

And whereas the Council of the said borough
has, in accordance with the twenty-eighth section of
"The Public Works Act 1876 Amendment Act,
1878,"
laid before me a statutory declaration that the
said Council is authorized by law to undertake the
work for which the land described in the memorial
laid before me under section twenty-five of the said
Act is required, that all the provisions of the said
Act as to taking such land have been complied with,
and that the said Council is of opinion that the
proposed works should be executed, and that no
private injury will be done for which due compensa-
tion is not provided by the said Act:

And whereas it appears to me that all things
required by the said "Municipal Corporations Act,
1876,"
and "The Public Works Act, 1876," to be
done and performed to authorize the taking of such
land have been done and performed, and it is ex-
pedient to declare that such land is taken for the
purpose aforesaid :

Now, therefore, I, James Prendergast, Adminis-
trator of the Government of the Colony of New Zealand, by and with the advice of the Executive
Council of the said colony, in exercise and in pur-
suance of the powers and authorities in me vested
by the said Acts, and of any other power and autho-
rity enabling me in that behalf, do hereby proclaim
and declare that the land described in the Schedule
hereto is taken by the Council of the said borough
for the purpose of widening Ritchie Street as afore-
said; and that, from and after the twenty-eighth day
of February, one thousand eight hundred and seventy-
nine, the said land shall become vested in fee-simple
in the Mayor, Burgesses, and Citizens of the Borough
of East Invercargill, discharged from all mortgages,
charges, claims, estates, and interest of what kind
soever, for the purpose of widening Ritchie Street
as aforesaid.


SCHEDULE.

ALL that piece or parcel of land situate in the
Borough of East Invercargill, in the Provincial Dis-
trict of Otago, Colony of New Zealand, being a sub-
division of Section two (2), Block one (I.), Inver-
cargill Hundred, known as Sylvan Bank Estate, con-
taining by admeasurement thirty-six decimal seven
(36.7) perches, more or less, coloured red, and marked
"A" on the plan attached to the memorial referred
to: Commencing at a point one hundred and
thirty-five (135) links distant from the north-west
boundary of Section fifty-nine (59), and bounded
towards the North by Yarrow Street, a distance of ten
(10) links; thence towards the East by Ritchie
Street, a distance of two thousand two hundred and
ninety-five (2295) links; thence towards the South
by public road, a distance of ten (10) links; thence
towards the West by part of Sections numbered nine
(9), thirty-nine (39), forty (40), forty-one (41),
forty-two (42), forty-three (43), forty-four (44),
forty-five (45), forty-six (46), forty-seven (47),
forty-eight (48), forty-nine (49), fifty (50), fifty-one
(51), fifty-two (52), fifty-three (53), fifty-four (54),
fifty-five (55), fifty-six (56), fifty-seven (57), and
fifty-nine (59), a distance of two thousand two hun-
dred and ninety-five (2295) links to commencing
point.
