Between ROBERT HEATON RHODES and WILLIAM
DONALD, Trustees of the real estate of GEORGE
RHODES, deceased, and the said Robert Heaton
Rhodes, plaintiffs, and THOMAS WADSWORTH,
defendant.

NOTICE is hereby given that, under a writ of
fieri facias, duly issued herein out of the
Supreme Court of New Zealand, Canterbury Dis-
trict, against the real and personal estate of the
above-named defendant at the suit of the above-
named plaintiffs, I have seized and taken into execu-
tion all the estate and interest of the above-named
defendant (comprising his estate in fee-simple in
possession, free from all encumbrances) in all that
piece or parcel of land containing by admeasurement
thirty acres, or thereabouts, situate in the County of
Geraldine, in the Provincial District of Canterbury,
New Zealand, and being the Rural Section numbered
4407 on the map or plan of the Chief Surveyor of
the late Province of Canterbury, now the said pro-
vincial district, setting out and describing the rural
lands in the Timaru District thereof, together with
the hotel known as the "Orari Hotel," and the other
buildings and erections thereon; and that I intend
to cause the same to be sold by public auction, at
the auction-rooms of Messrs. John King and Co., in
the Borough of Timaru, on the twenty-first (21st) day
of February, 1879, at the hour of eleven o'clock in
the forenoon, unless the judgment-debt and the costs
and expenses of and incidental to this execution be
previously paid and satisfied.

The Solicitor for the Execution Creditors is Arthur
Perry, Esq., of the Main South Road, in the said
Borough of Timaru.

APPLICATION TO CONSTRUCT WATER-RACE.

To the Waste Land Board, Southland, and all other
persons whom it may concern.

TAKE notice that it is intended to construct a race
and divert water from the Merton Creek, com-
mencing at a point about 60 chains east of my resi-
dence, and terminating about 5 chains therefrom,
for industrial and other purposes. Length, about 55
chains; breadth, 3 feet; depth, 2 feet. To carry four
heads. Dam on creek and by-wash, near commence-
ment of race. Two months required for construction.

NOTICE OF INTENTION TO CONSTRUCT A WATER-
RACE.

To the Mining Registrar at Naseby of the Mount
Ida Mining District, and all other persons whom
it may concern.

TAKE notice that I intend to construct a Water-
race for domestic, irrigation, and machinery pur-
poses, commencing at a point in the Five-Mile Creek,
through Section 8, Block VI., Rock and Pillar Dis-
trict, and terminating at Section 9, Block VI., Rock
and Pillar District.

The mean depth and breadth of such race is 12
inches in width and 8 inches in depth, its intended
course is S. by W., and is capable of carrying one
sluice-head of water.

The length of such race is 80 chains or thereabouts,
and the time estimated for its completion is thirty
days.
