Amending Notice of assent to Construction of Dun-
troon and Hakateramea Railway from Marewhenua
River Northwards, and Area and Boundaries of
Railway District. Published in New Zealand
Gazette of 21st December last.
NORMANBY, Governor.
WHEREAS by sections eighteen and nineteen
of "The District Railways Act, 1877"
(herein referred to as "the said Act"), it is
enacted that whenever the Governor shall ap-
prove of or object to any proposed railway, he
shall, by notice gazetted, declare his assent to or
disapproval of the construction of the railway,
and such notice when so published shall be sufficient
notice to the company of such approval or dissent,
as the case may be; and that in and by any notice of
approval the Governor shall declare the area and
boundaries proposed to be a railway district for the
purposes of the said Act, and such declaration shall
be sufficient evidence of the constitution of such
district for the purposes of the said Act:
And whereas the Duntroon and Hakateramea Rail-
way Company (Limited) propose to construct a rail-
way under the said Act, and a majority of the whole
body of ratepayers and owners of property in the
proposed district, representing more than one-half
of the value of the rateable property, have con-
sented to the construction of the proposed railway:
And whereas the said Company have made applica-
tion to me for my approval of the construction of
the said railway, and all things have been done and
performed as required by the said Act to obtain
such approval:
And whereas the area and boundaries of the dis-
trict for the proposed railway were incorrectly
defined in a notice by His Excellency the Gover-
nor, dated the twenty-first day of December last,
and published in the New Zealand Gazette of the
twenty-seventh day of December last :
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in exercise and pursuance of the
powers vested in me by the said Act, do hereby
notify and declare that I do hereby assent to the
construction of the Duntroon to Hakateramea Rail-
way, from Marewhenua River northwards, as shown
on the plan and in the book of reference, with
the exception of the lands described therein as
numbered on plan from one to six inclusive: And
I further notify and declare that the area and boun-
daries of the district for the purposes of the said
railway are as follows:-
All that area of land situate partly in the Provincial
District of Otago and partly in the Provincial District
of Canterbury estimated to contain by admeasure-
ment 800,000 acres boundary lines as follow Com-
mencing at the point formed by the junction of the
Maruwenua River with the Waitaki River along the
Maruwenua River and the north branch thereof to
the point formed by the junction of boundaries of
Runs Nos. 17 28 and 362 thence along the boun-
dary line between Runs Nos. 362 445 (Crown lands
unoccupied) 439 403 201 233 429 421 and 189
on the one side and Runs Nos. 17 28 23 243 160
322 2 of C 3 of C and 2 of Con the other side to
the point where the boundary line of Run 2 of C
touches the Ohau River thence along the Ohau
River to its confluence with the Waitaki River
thence along the Waitaki River in a southerly direc-
tion to the point formed by its junction with the
boundary line between Runs Nos. 236 and 261
thence along the boundary line between Runs Nos.
236 311 578 577 296 265 and 318 on the one side
and Runs Nos. 261 295 360 441 197 and 164 on
the other side to the point formed by the junction of
the boundary line between Runs Nos. 318 and 164
with the western branch of the Opawa Stream thence
in a straight line through Run No. 164 to the north-
eastern corner of Run No. 163 thence along the
boundary line between Runs Nos. 163 213 160 and
161 to the south-western corner of Run No. 161
thence in a straight line through Run No. 69 to the
north-eastern corner of Run No. 487 thence along the
boundary line between Runs Nos. 487 and 488 to
the Waitaki River in the Provincial District of
Canterbury thence across the Waitaki River and
along the southern bank thereof in a south-easterly
direction to its confluence with the Maruwenua River
the point of starting.

Governor, this twenty-eighth day of
January, one thousand eight hundred
and seventy-nine.

Additional Regulations under "The Salmon and Trout
Act, 1867."
NORMANBY, Governor.
WHEREAS under the authority of "The Salmon
and Trout Act, 1867" (hereinafter termed
"the said Act"), certain regulations were made for
the purposes of the said Act, and published in the
New Zealand Gazette of the thirteenth day of Sep-
tember, one thousand eight hundred and seventy-
seven, and such regulations are now in force:
And whereas by the said Act it is, among other
things, enacted that it shall be lawful for the
Governor, from time to time as may become neces-
sary, to make such regulations as to the Governor
seems expedient, for imposing or prescribing any
conditions and restrictions in respect to salmon or
trout fishing: And whereas, for the purpose of
protecting salmon and trout, it is expedient that
additional regulations should be made as hereinafter
provided:
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in pursuance and exercise of the
hereinbefore recited power and authority, and of
every other power and authority enabling me in that
behalf under the said Act, do hereby make the fol-
lowing regulations, that is to say,-
- If any person shall by any means take or catch
any salmon or trout in any stream, river, or tidal
water, he shall forthwith return such salmon or trout
alive to the stream, river, or tidal water in or from
which the same was caught or taken. Any person
knowingly and wilfully committing a breach of this
regulation shall be liable to forfeit and pay such sum
of money, by way of penalty, not exceeding one
hundred pounds, as the Justices imposing such
penalty shall think fit.
The expression "tidal waters" has the like mean-
ing as given to such expression in certain
regulations made under "The Fish Protection
Act, 1877," and published in the New Zealand
Gazette of the eleventh of April, one thousand
eight hundred and seventy-eight.

No person holding a license issued under the
said last-mentioned regulations shall be deemed
exempt from these or any other regulations in force
under "The Salmon and Trout Act, 1867." -
These regulations shall be read as part of any
existing regulations for the time being in force under
the said Act, and, whenever any penalty shall be pre-
scribed under any regulations in force under the said
Act as aforesaid, it shall be lawful for the Justices
